In December of I realized that my bank account had been garnished by *** * *** for approx$ Shortly after that I received two letters from *** *** One stating that my account was set to be garnished altho the garnishment had already happened and then later one stating that it was illegal for them to garnish this account as the deposits were from my Social Security and VA benefits At this time I reached out to RAB Performance Recoveries to see what was going on and if they would settle the account for $1, They informed me that a settlement would not be allowed and that I would need to pay the balance in full They also stated that the account would continue to accrue interest at 4% per month and that I could not stop them from taking it out of my bank account

This company has falsely placed a lawsuit against me for debt that I do not owe to them or any other company They have my name incorrect, *** ** *** - this has never been my name I keep close monitoring on my credit score and know the debt that I owe The debt of $12,is not my debt and I do not owe such an amount to any company or business, nor have I ever My complaint is that this lawsuit happened without my knowledge and without Rab Performance ever contacting me so I could clear my name Now they are threatening to levy and seize my belongings for a debt I do not owe I want Rab Performance to clear my name and to acknowledge that this is not my debt and to stop any further action against me for this debt that is not mine
Back in 2012, I filed for bankruptcy and my debt with RAB Performance Recoveries was included in this bankruptcy They were notified as were all other parties However, after looking into purchasing a home and applying for a mortgage, I have found RAB is still listing themselves on my credit report as an open judgement/debt owed I have tried to contact them but finding a phone number was difficult With the phone number I did obtain, I left a message but never heard back This has been sitting on my credit report for years and should not be
RAB holds a lein on my property based on a judgement I have tried to contact RAB directly and through their lawyers I've made a good faith offer through their lawyers who refused to present it to RAB I then tried to contact RAB directly via written letter and by phone I again made a good faith offer directly to RAB in a letter They did not respond to my offer So, it is my feeling that their lack of response indicates that they do not have an interest in negotiating in good faith As a creditor, I believe that it is their obligation to respond to my good faith offer
