As I explained before the NY State Attorney generals office is who says which used vehicles sold has or does not have a warranty applied to it. These warranty infos are available to anyone they can simply google NY Attorney Generals rules and regulations for warranties on used vehicles. Once again these are not our rules we are governed by NY State and follow all rules and regulations applied to us. We have done everything necessary to the letter of the law. We tried helping [redacted] they refused the help we offered and we have advised her to take her issue up with the NY State Attorney Generals office. The vehicle purchased had in excess of 100,000 miles as per NY State law the vehicle has no warranty is also not covered under any lemon laws.

Good Afternoon, My name is Chris and I am the sales manager for 613 Automotive Group INC. I am responding to the complaint from [redacted] and the 2007 Chevrolet Express ls 1500 she purchased on 1/**/2016. The first time [redacted] informed us of any issues with the vehicle was on 2/**/2016....

The vehicle was purchased with 144,090 miles. In NY State the rules that are applied for warranties on vehicles is state law and any vehicle over 100,000 miles officially their is no warranty as per NY State DMV as well as the NY state attorney generals office. Also any vehicle over 100,000 miles is not covered under the NY State lemon law. With that said we did offer [redacted] to have the vehicle towed by us to a location we use to repair any transmission needing repairs. We also offered to cover half of the expense of the repairs. The complaint is that the transmission is slipping our cost to have the transmission rebuilt with a 3 year 36,000 mile warranty is approximately $2000.00. [redacted] contacted us again on 2/**/2016 and her opinion was we should pay for all of it. Seeing that as per NY State law we are not required to pay anything or cover anything us being willing to cover half of the expenses as well as the cost of the tow should be more than generous but she declined our offer and contacted you. We have all the necessary documentation to prove the vehicle was sold with no warranty based on the mileage and the customer signed this paperwork knowing they were purchasing the vehicle as is. We also offered the customer a aftermarket purchase-able warranty that they declined at the time of the sale also.

The customer can reject our response all he wants. [redacted] is not the only person we sold one of these classic cars to with garagemans lien paperwork. Every other customer had no issues getting the paperwork taken care of. Like I said I sold 8 other units with the same paperwork and one of them was to [redacted] Its pretty funny that [redacted] had no issues. I am sorry where [redacted] went wrong is he had to apply car insurance to the vehicle and pay the taxes on the vehicle then he would receive the transferrable registration. I am sorry by threatening us he has lost our willingness to help him. Next time do not kick the gift horse in the mouth when the gift horse is trying to help. Time is money and I have spent multiple hours on this and also spent money on fedex sending the paperwork to DMV. I am sorry but if he wants help from this point forward he can pay for it.

That is not true the car was sold to me with 143,885  and there was never a warranty offered to me. There is a paper for warrantys but nothing was checked off and was I asked if I wanted and any. 'Also if there was any problem with the car I would not have bought it. I asked iF it was in good condition and the sales person said yes. I also tried to reach this business by phone before the [redacted] of Feb and no one answered. By then I had to have brakes and others parts for brakes to be fixed and after things where fixed and payed for I finally got a hold of the business and I asked to speak to the person that sold me the car and there reply was he's not in and he'll call you back . He never called back. Chris is saying that they will pay half but I've already put more then $ 1,161.37 in for parts to go to brakes, Rotors, Tie Rods inner and outer, also the U-joint at the transmission and also the Hub Assy w/ sensor so I think it's far the they fix the transmission . The $ 2,000.00 dollars is only a  quote  It could be more took the car to a transmission place and the price to rebuild the transmission is $3,000.00. I don't have any extra money to put into the car because I already put that much into it . Thanks  order for the Revdex.com to appropriately process your response, you MUST answer the question above.

by an outside source. 613 Automotive is not nor has ever been an authorized NY State Inspection station. Quite simply [redacted] did not and could not because of NY State law automatically give another repair shop authorization to make any repairs on a vehicle without our permission and expect us to pay the bill. Under NY state law any and all repairs requested by a customer for a vehicle that is under a dealer warranty all work must be done by the selling dealer unless so authorized by the selling dealer. Effectively [redacted] issued a blank check to a repair shop in Connecticut to do repairs on the vehicle without my permission. Also under NY State law [redacted]'s vehicle had no warranty the mileage on the vehicle at time of purchase was 141,837 miles exactly. Under NY State law for retail dealers all rules governing us as well as all warranties are issued and stated by the NY State Attorney General we as the dealer have absolutely no say in these things. The cutoff for eligible warranties in NY State is 100,000 miles. At no point in time did we tell [redacted] that we were not going to help we simply stated we will not pay any more than what the repair would have cost us to do. We have a full repair facility as well as multiple qualified technicians can do the work for us. The fact of the matter is that the cost of the parts as well as the labor the shop in Connecticut charged were gretly inflated compared to our cost also tax was added to the bill and we are tax exempt. We are willing to work with [redacted] on this issue but we are 100% not paying the full bill. We are here to help our customers but we also refuse to be ripped off. We are fully prepared to help [redacted] out with the bill and cost of the repair but we are only willing to pay the sum of which the parts would have cost us which is $603.29 as compared to the price of the parts charged by the shop of $1,066.87 we are also willing to compensate [redacted] for the full cost of the labor which is $577.50 for a combined total of $1180.79. I spoke with Heather Mesceda yesterday 8/2/2016 and she stated that she believes that will be acceptable.

I purchased this vehicle on [redacted] on 4/*/16. The ad specifically states CLEAR Title. 613 Automotive sent me a unsigned NY registration that was not in there name, and there lien fileing documents. The Florida DMV could not issue me a title since my Bill of sale was not from the registered owner. I called Chris and he said to send the paperwork to NewYork DMV, and I did. New York DMV sent paper work back to me because I was not the lien holder.Chris said to send it to him and he would get the NY registration that could be transfered to me. I sent that to him certified mail on 6/*/16. Now after Four months when I called yesterday to inquire as to the status of the Title, All I got was its the end of the month and Im too busy to check on it. I now have $25,000. invested in this car with the new paint and repairs and can not sell it. All I need is a signed NY transferable registration in ( 613 Automotives Name) and the Bill of sale that I already have, to get a Florida Title. It is not possible for me to file their lien on their behalf, and get the title, They have to do that. I am not sure about NY DMV regulations, But as a licensed Motor Vehicle dealer in Florida ,When I sell a vehicle or even advertise a vehicle for sale I must have a free and clear title to transfer to the buyer.

So here is the deal we sold a 1937 Cadillac to the customer and we made it very clear to the purchaser ([redacted]) before purchasing the vehicle that the vehicle was owned under a garagemans lien. We did not hide this info this customer purchased this vehicle knowing full well the paperwork that...

was coming with it. In ny state we can absolutely sell the vehicle with the garagemans lien paperwork. The customer once they received the vehicle and the paperwork found that because he is in florida it is a little more difficult to obtain the transferrable registration. Because they are not in ny state they have to mail the paperwork to albany dmv. The customer was being lazy and asked if we could help we obliged. Today the customer called making threats therefore we told him we would no longer help him. Thats the long and short of it. If someone is trying to help you with something that they do not have to do and are not charging for then you should be patient and happily wait not make threats so the ones that are helping you will continue to help you
