Good morning I have attached an original copy of the violation to this email As stated in our previous emails to [redacted] we have documentation of his violation This parking lot is a parking lot which is customers strictly pay a mobile app to make payment we do not have a kiosk We have two banner in the parking lot which states this along with signs in the parking lot which states this along with instructions on how to make payment through the mobile application As a parking business we have adequate signage in this parking lot As [redacted] can see the letter which he received the the violation which I have attached to this email the fine is the same there is no increase in the fine As for not receiving a violation on his vehicle As you can imagine we hear this all the time and my enforcers have been with me for over years and they always place the violation in a bright pink envelop on the windshield of ever vehicle I am not saying you are not telling the truth about not getting the violation but I am just stating how my enforcers are in making sure the violation gets on each vehicle when issuing a violation I will do one thing for your *** I will reduce your fine to $if you pay within two weeks from today On another side note just always remember anywhere you go downtown there is No Free Parking anywhere [redacted]

I am rejecting this response because:The pictures from my "violation" clearly show that there is no "pay to park" sign or instructions to pay in the spot that I parkedThe claim that they have provided adequate signage in the lot is practically a jokeOn the opposite side of the lot (facing the other other building) there are the four small signs instructing people to pay to park in those spots, but I did not park in those spotsI DID NOT receive a pink ticket of any kind, and my girlfriend who was with me at the time can testify to thisThe company did recently put up vinyl banners along the back fence, but they were NOT there when we parked on the 25th - my girlfriend can also testify to this and you can see it that there is no apparent signage or banners posted in the attached image from google street viewTake a look at the attached view (my view on the 25th) from the street (red arrow showing where I parked on the 25th), and please tell me how I was supposed to know to pay!!! Also there are plenty of businesses in Rhino that do provide parking for guests (I work at one), so your claim that I should have known it was your lot and I needed to pay is unfounded

Second the two banners on the fence have been on that fence for over your year so your claim that they just have been installed and were installed after you parked there on the 25th is false. For me to better research your violation and what lot you were parked at since we own and operate several lots in downtown Denver I would need your violation number or your license plate off your vehicle which you parked in our parking lot Once I receive one of the items which I requested

I have looked up both of these violations to see if there were any notes of you contacting our office in regards to appeals on violation *** and *** and there are no notes of you contacting our office This lot is not a *** *** Parking lot it is owned by *** **
*** and operated by Focus Parking Systems No where in this parking lot does it state this is a parking lot for *** *** *** *** does rent out the building from us at *** *** but they pay for monthly parking in that parking lot *** *** was informed at the time of signing the lease at this property that parking was not free for them or anyone else working directly with them and that they needed to let all subcontractors and employees know this Since you were working for *** *** I would reach out to them in regards to this issue since they were informed from day one of their lease the parking lot was not a free for people to park there. *** * ***

I have attached the photos of our signage which when you enter into the parking lot.  The sign says Public Parking and on each Corner of the sign you will see the symbol for VISA and MasterCard (picture attached) which is the indicator you mist pay.   There is also a sign at both entrances coming into the parking lot that say "DO NOT PAY ATTENDANT MUST PAY MACHINE" AND another sign which is located on the back of the pay machine it clearly states on the sign NO FREE PARKING (picture attached). With signage at both entrances into the parking lot and at the main drive way on the back of the pay machine we have enough signage to cover any entrance point into the lot where everyone is notified of no free parking.  I am unable to do anything in regards to your violation. [redacted]Parking Manager

If this company is going to have the authority to give tickets they should have the responsibility to properly identify the areas in the parking lot where you are not allowed to park. They claim that they do not know of any parking lot that have signs yet they should look around any city streets where public officials are responsible for giving out tickets and you will notice that the curves are either painted in red or there is a sign indicating that in the area NO PARKING is allowed. This measure justifies the action of giving out a ticket, especially if it is for $155.00 . This company clearly benefits by not making it very clear to their clients that they are parked in a improper zone. They should be required to disclose how many parking tickets they give out on a daily basis vs. how much they make based on just the parking fee they charge . It is obvious they have a conflict of interest. We contend that if they are going to give tickets they should be required to post signs or maintained properly painted the area with RED lines .

The indicator of it not being a parking space is because there are no painted lines in that spot. Where they are no painted lines means it is not a parking space. Just as drive ways in a mall shopping center or Walmart, hotel parking ect.
