They routinely cheat by drilling deeper than necessary. I am over the largest aquifer in Washington state. I had another well company quote me 1500 and was going to get started for 500 down. But my X husband ,his Boss who had credit with Fogal and Fogal themselves took over and forced themselves on my land. I'm was literally telling everyone get the blank off my property but I was ignored. They would call my husband's boss for instructions and ignore me like I wasn't there. I saw water shoot at least 50 feet in the air like a fire hydrant and I was excited cause it was only 80 ft or so and my neighbor was 66 ft so that would have been about right depth but they said it was surface water. They punched right thru the water table and went 400 ft and charged 24,000 . They messed up the water table now our seasonal creek and pond dried up and never came back. Sue Fogal is a disgusting horrible woman with no class or honesty she will lie, cheat say and do whatever she has to to cover up her crimes

This is in response to Sue Fogal. I just found this on Google surfing sites. Everything Ms Fogal says is a complete lie. This company has been ripping people off in Stevens county for years. They are rich and employ crooked low life attorneys who help them get away with flat out fraud ,cheating and lies. They take advantage of the poor and women. They forge documents and have a family member who is a notary put her stamp on illegal documents that they forged my signature on. I never ever ever signed a damn thing they are lying but because I was abused by my X husband and left with no income after 35 yr s of marriage they are trying to steal part of the only thing I got in the divorce.

The following is a description of the chain of events to the best of our memory and knowledge regarding the work Fogle Pump did on the property owned by *** and *** ***
On October 27, a contract for drilling services was signed by Tom B*** representing Fogle Pump and ***
& *** ***, signed by *** ***We were contacted by *** *** to drill this well and at that time *** stated he would pay for the workWe asked *** to sign the contract since as the legal owner of the property, her signature in essence gave us permission to do the work and be on the property plus acknowledge what we were doingSee item marked
It was our understanding at that time the ***’s were living on the property in a "shed" or similar structure insulated with hayAt the time of this contract, *** *** was working for Mr*** and Mr*** intended to move in a single wide trailer onto the property for them to live in
The well log shows that we drilled the well during the dates of November 11th through the 12th, The log shows the total depth is feet, with a static level of 60’ and an estimated gallons per minute of Amount due for the drilling was: $12,See items marked #2, the invoice copy and #a copy of the well log
Mrs*** claims in her complaint that we drilled past the water and she saw water shooting up into the air at feet deep; we use water in the drilling process and according to the driller he would have cleared the water out the next morning before continuing to drill the wellThis was not an indication of us hitting waterIt is true the wells in her area are under 100’ however they are in more of a "valley" landscape and per our driller’s memory this well is more along a rock outcroppingI have attached two well logs from the surrounding area (labeled #and 34A) and the well log from the *** well (#3)As you can see, the wells that are shallower have a different formation than the *** wellDifferent formations produce water from different sources and at different depthsThere is NO advantage to Fogle Pump to drill past a water source or go deeper than necessary to secure a usable source of water for a customer
Mrs*** also makes claim that no one would speak to her; the driller spoke with her husband and with Mr*** regarding the drilling processThere is one note that mentions she is upset, presumably because Mr*** had given the o.kto drill to a depth of 400’Mrs*** contends there is "poop all over the ground"Our driller states when he moved the equipment on site there was an area about 30’ south of the rig that was a "large area" full of human fecesThe "poop" was present before we were ever on site and has nothing what so ever to do with our work
It is our recall that *** and *** *** were making payments to a *** *** in the amount of $a month for the propertyThey also owed *** *** money for something and Mr*** owed us for the well drilling
The ***’s had given *** *** a deed of trust on the property as security for whatever debt they owed him (see item #Deed of Trust and #5A promissory note BOTH of which are notarized); *** in turned assigned that deed to Fogle Pump with the agreement that the ***’s would start paying Fogle Pump $when they finished paying Mr***See items #and #6A for those assignment documents
At some point the ***’s filed bankruptcy; there are several letters regarding the bankruptcy and the security to *** and the deed of trust to *** assigned to Fogle PumpWith the exception of a letter from our attorney *** *** to the ***’s bankrupt attorney (item #7), I did not include any of those other documents since we were not an actual party to this bankruptcy and I do not have a completed bankruptcy file that would speak to that situation
Periodically, we would hear from *** *** making threats against us if we did not release the "illegal lean"It is actually a deed of trust
In April of Mr*** came into Fogle Pump with a "new" proposition and to try to resolve the situation with the ***’sIt involved the ***’s making $a month in payments to Fogle Pump and a new deed to be signedThe deed did not list Fogle Pump in any manner and only listed *** ***, I declined to sign that document but offered to settle for $15,cash if paid with days from that dateHe said he would take that offer to the ***’sThere was no response
Starting in January of Mrs*** started coming into our business and making phone calls to usAfter a visit the end of January I was compelled to send her a letter notifying her she was no longer welcome to come into our business and that any further communication would need to be by phone or mailSee item marked #
After she received that letter she called our Republic branch office (all work and communication came from the Colville branch) and left a voice message which I have attached in a separate emailAfter that voice message, we contact the local police department to make them aware of the situation**Please be advised that the voice mail recordings have graphic language in them
As I am preparing this letter *** ***-*** called here at approximately 12:p.mThe call was answered by our AP Assistant who immediately got me on the lineMrs*** said she was going to post YouTube video’s of all the "crimes" Fogle Pump has committed and the harassment we have done to her and how we "forged" her name on documentsWe are to go after *** *** for the money and leave her alone and unless we do she is going to post all these videos’ and that she has recordings of usShe gave a deadline of one week for Fogle Pump to send her a "registered" letter saying we will "cease and desist" our harassment and release the lienShe has a new attorney and she is "coming after us"We are to watch a YouTube video titled: "*** *** *** *** *** ***" and that the next video she puts out will be about usThen she hung upI did not say one single thing
Mrs*** made a lot of accusations in her complaint; I have answered those to the best of my ability and our group memoryHer main complaint actually seems to be against *** *** and her ex-husbandI cannot speak to any of the issues that may be between her and Mr*** or her ex-husband
As to her "harassment" complaint against Fogle Pump; we have not sent her a *** or made any attempt in the last several months if not years, to collect payments from herAs I explained to her in the letter dated January 26th, if he were to sell then Fogle Pump would only be paid the amount owed to us that is secured by the Deed
Please advise where this issue goes from here
Respectfully submitted,

Review: In October of 2009 we had Fogle Pump and Supply drill a well for us on our cabin property in Chewelah, WA. The well was never right and took time each time we used it had to run it quite a while before getting clear water. We had called several times and we're told that we just needed to keep running it and it would clean itself up. It never did and in July the pump went down after pumping out very muddy water that would not clear up at all. We called Fogle and spoke with [redacted] about this and he said he would send someone out to look at it. They did and [redacted] told us that he would make it right. He sent his installers out to fix it. No estimate on paper was given till the bill was received, and we were assured in the phone conversation that it would be a minimal amount. The well was fixed and we were happy. Then the bills came and the estimate at the same time. The amount was by far more than we expected and in less than a month received several more bills which were inconsistent with the first bill. We asked for an itemized statement and the total again was different. We intend and intended always to pay this bill but we needed a correct amount. There was never one given on paper but eventually we came to an agreement with [redacted] and the owner of $3500.00. We took out a government loan and then the government shut down and prevented us from getting it approved till yesterday. We were in contact with [redacted] and others at Fogle explained the issue and told them that this loan was only issued on the 1st or the 25th of the month. They told us that unless they had it by Friday the 18th they would put a lien on our property, terminate the agreed amount the ( going back to the inflated amount) plus $1000.00 for the lien.As a resolution we want to pay the amount agreed on of $3500.00 as soon as the loan money arrives, which should be no later than November 5th most likely much sooner. We will retract this complaint and this issue will be considered as a satisfactory interaction with Fogle.Desired Settlement: We pay agreed amount of $3500. As soon as we receive loan money (no later than 11/5/13)Fogle posts paid in fullNo lien on property We retract this complaintEveryone is happy

Response:

Good morning,

We were just wondering if you ever heard back from Fogel Pump regarding our complaint? We still want to pursue our complaint, as we were treated unfairly as well as charged an extra $200.00+ for using credit cards to pay. It has caused us a lot of grief working with these people. We got a shoddy well in the beginning that they would not stand behind and way overcharged to the tune of more than we paid for the actual well, harrassed and threatened nearly on a daily basis and most importantly they did not give us a written estimate for correcting the shoddy well they drilled saying they would make it right then way overcharged and double charged for the repair to fix what should have been done to begin with.[redacted] also called the Revdex.com a joke saying that you couldn't do anything about it.

Thank you,[redacted]

Dear [redacted];

This letter is in response to complaint ID [redacted]. Fogle Pump & Supply was contacted by the [redacted] in July 2013 for help

in cleaning up their water. A pump technician was sent to the property and

removed 20' of pipe raising the pump up 20' to pump out the cloudy water. Since

the water did not clean up, Fogle Pump set back up over the well and continued

drilling as the current water source was not usuable. In the well drilling

business, there is no for sure guarantee as we have no way of knowing the final

outcome or results.

As far as there not being an estimate, I had filled out a contract and went over it with Mr. [redacted]

on the phone and he gave his verbal OK. The first invoice sent them was to pull

the pump up to see if the water would clear up. The next invoice sent them was

for the drilling and mistakenly sent from our Airway Heights branch from a new

office gal that was not aware of the invoicing to be done in Colville. The

charges on this invoice were outlined on the drilling contract and gone over

with Mr. [redacted]. The next invoice was for pulling & replacing the pump,

which was on the contract also. The other invoice sent them was for a credit on

casing. Fogle Pump’s policy is to get a deposit of 50% based on the estimate to

be scheduled for drilling. We did not have the [redacted] do this based on their

past payment history of promptly paying nor did we charge a move in fee or a

rig labor fee to trip in.

Contractors only have 90 days

to place a lien on property for non-payment. Fogle Pump starts contacting

customers at the 70 day mark to get payment and notify customer a lien is being

placed on their property. The [redacted] were contacted on October 3 by letter

that a lien was going to be placed on their property. In various conversations

with Mr. [redacted] over the following days, I offered him several options for

payment. All included a deep discount due to "hard financial times"

of the [redacted]. He would always suggest something else and then not follow

through. This took us right up to the time for the lien to be processed by the

attorney.

Mr. [redacted] was asked to have

payment to us by October 22, 2013 and on that day he phoned in with 3 different

cards for payment. The credit card slips and receipts were photo-copied,

e-mailed to him, and sent by regular mail. On his copy were the words paid in

full as they were left off the original copy. Although some of this account was

written off, Fogle Pump did our best to get the [redacted] water and work with

them on the financial side also.

Sincerely,

Well Drilling Foreman

There was and is no lien against the property at

3031-C Quarry Browns Road, Chewelah, WA 99109.
