Response to Case # To Whom It May Concern, We appreciate your contact and the opportunity to reply to the noted complaint by [redacted] Before going into details on this particular individuals chain of events with our office, I'd like to highlight that during our entire tenure in business in the financial industry we take great pride in our ability to help others in the community As important we have never had a complaint take place with your organization in the 8+ years we've been doing business In short, we in fact have no personal information of [redacted] on hand outside of notes that we've taken from our appointments, and her contact information that is within our CRM management (Digital) Outside of that, the only personal information that would be stored would be based on the E-Application *** completed with [redacted] with [redacted] *** That information being stored is legally required by state and federal regulations whenever an individual completes financial applications for a specific product or contract We take pride in our long standing top quality customer service, and unfortunately in our dealings with [redacted] did see some signs of concern on our end as well, which we will highlight within this response Thanks for your time and please see the remainder of our response to this complaint In regard to her complaint the information pertaining to her attending one of financial seminar dinners on 10/24/is accurate In addition her appointment in person here at our office on 11/9/at 4pm is also accurate During her first visit she met with [redacted] in our office, which is very and matter of fact we set that expectation during our dinner seminars that the first appointment can and in this case would be with one of [redacted] associates based on his availability, proper expectations is very important to us as individuals and a company and this is something we make sure to do at every dinner event we host During the first meeting on 11/9/our goal as financial professionals is to better understand the individuals goals of retirement, income needs, health issues (to help plan long term income needs), and of course their current positions of financial accounts, pensions, IRA's, Annuities, etc During that first appointment [redacted] let us know about her two children in college, and her personal situation, which helps us understand more about her income needs and long term planning In addition [redacted] was very clear her biggest concerns for her long term plan was based on where and how to pull money from her accounts to minimize tax implications, minimize penalties, and still have safety/protection of her accounts with the ability for growth [redacted] was very clear that she wanted zero risk with her accounts and the current account she was in was in fact a [redacted] *** Fixed account at 2.25% After reviewing the account details [redacted] realized she had just recently purchased that contract from [redacted] and was in a period in the financial industry which is called "The Free Look Period" which gives client/owners of these contracts the ability to go back on their decision without any penalties and issues [redacted] let her know we had options for a "Fixed" annuity that are better than 2.25%, however he also suggested she look at some options in "Fixed Indexed Annuities" that have lower fees and options for higher growth based on the market performance She let us know she was open to look at both options, and we would do some research, review her needs, and upon our next appointment have some suggestions for her Her next meeting took place on November 14th at 4pm Between the 1st and 2nd appointment, [redacted] and [redacted] in our office had reviewed her situation, goals, conservative needs for investment (per her request of no risk to loose money), and had come up with some suggestions based on those factors After review we helped [redacted] better understand the fee's within her [redacted] Contract Helped her understand the difference between Fixed Annuities and Fixed Indexed Annuities being she wasn't willing to risk any loss in her investments and these two avenues had been the best two options [redacted] spent an hour and half going through her situation and explaining her options and our suggestion based on her goals expressed in the first meeting we had Once his review of her options was completed, she had asked for his recommendation, she decided to move forward with that, complete paperwork, however the agreement once that conversation was over was to hold off on any funding or moving forward with the application until we had emailed her some information on the company the following day, which was November 15th On November 15th [redacted] called in during the morning and was concerned she hadn't gotten an email She spoke with our VP of operations [redacted] and he let her know [redacted] has a scheduled time at the end of the day he sends out follow up emails and information folks are requesting from the prior days appointments and she should get an email prior too him leaving the office, and the email was sent out that day as [redacted] 's expectation earlier Prior to [redacted] sending that email on the 15th [redacted] was expressing her concerns on not receiving the information right away and asked our receptionist here in the office to have the forms she completed cancelled, which in fact was done that day, and not forms or financial applications had been sent out of the office [redacted] per [redacted] s request reached back out to [redacted] on November 17th, explained the emails being sent at the end of the day and [redacted] set an appointment to come back into the office to meet with [redacted] to assure her questions and needs where answered and to review the information discussed in the 2nd appointment once again [redacted] came back into the office on November 28th at 2pm and again this appointment lasted over an hour and a halfDuring that appointment [redacted] again had reviewed her current [redacted] contract, They actually called [redacted] together to verify the fee's she was paying, which she explained she wasn't aware of They asked to "Free Look" the [redacted] Policy per ***'s request, and [redacted] personally assisted her with the phone call and letter required for [redacted] to send to them per her request Once that portion of the meeting was complete [redacted] (in his notes outlines) he made it very clear he wanted to go very slowly through her options, make sure she felt comfortable, and even upon reviewing her options for "Fixed Annuities" only, she made a decision based on the interest rate and company name [redacted] They completed an E-Application at that time, [redacted] set expectations with her on the process, our communication, and if she had questions to call During that appointment [redacted] had told [redacted] she is very concerned about people stealing her information and in fact has a PO box because she believed that there are people who are trying to steal her mail After this appointment ended our office ( [redacted] ) received a call around 6:05pm (after working hours for our business) [redacted] and [redacted] happened to still be in the office notating appointments from the day and reviewing client files [redacted] had called in and expressed her concern for [redacted] *** company, that it only had companies and wasn't [redacted] During that call, it lasted roughly minutes, [redacted] attempted to answer ***'s questions and was very firm about the fact he never at any point suggested [redacted] *** to be [redacted] During that call [redacted] even said "I guess I shouldn't have assumed that, and I don't know all there is to know about the financial companies out there, I should have asked more details about that" By the end of the call [redacted] and her had come to the conclusion we aren't going to be a fit for you and vice versa, she asked [redacted] if she could pick up the paperwork and statements she had left at our office, [redacted] obliged and personally asked [redacted] to hold her statements and specific documents involved in the "Free Look" for [redacted] so she had that The following day [redacted] took those statements, organized them in a folder and per his understanding shredded the rest of her file outside of the internal elements still required by the state and federal regulations, which would be digital files done through [redacted] *** application, and her basic contact information in our CRM Management tool (Digital) When [redacted] came by the office she got her packet and wasn't satisfied, asked where her license was, and her other information At this time our front desk receptionist was trying to explain to [redacted] that was the only information we had left on her file and the rest of the notes and personal info on the intake form was shredded to assure her information wasn't available (Internal Documents) At this point [redacted] happened to come out to make a copy of a file he was working on and noticed the situation was escalated He then got involved and personally explained to [redacted] that all the personal statements and documentation pertaining to her accounts and file that she had given us was within that packet and that her personally shredded and got ride of the internal documents with her information along with the copy of the license we had She was upset and very frustrated being she told [redacted] she wanted her files back [redacted] explained he had put all her files together they had with her information and again, shredded the internal documents on her and the copy of her license At that point he then assured her the company didn't have anything of hers on file that she had given us and if she had any problems or issues with cancelling her application she completed the night before he would personally assist her He gave her his business card for contact needs Since that time, there has been one phone call and two emails to [redacted] to make sure her application with *** was properly cancelled During that call she seemed thankful for [redacted] 's help, he as well followed up with *** to get written confirmation the application had been cancelled and her file was closed During our time with [redacted] we did have some concerns about working with her based on the back and forth nature of her making a decision and quickly going back on that decision Our goal is always to make sure our clients are well educated prior too making decisions, and assuring their comfortable when leaving the office After the 3rd meeting with [redacted] he had expressed his concerns with [redacted] based on her comment about people stealing her mail, and changing her mind twice within 24hours of our appointments, which seemed to be a trend based on her decision to attempt to cancel her " [redacted] ***" policy as well Internally we had made the decision regardless of what happens we aren't a good fit for her and vice versa We again take pride in doing business ethically, morally, and of course legally We can assure all parties involved ***'s information is not held here internally outside of the State and Federal regulations we are required to have on file once we I have reviewed the response made by the business in reference to complaint ID 12530043, and have determined that this proposed action would not resolve my complaint. For your reference, details of why I am rejecting this response appear below:I have never complained to the Revdex.com for any company that I have ever dealt with (in my entire year in service). But this company, which had my personal information has not been truthful, and all I wanted was my personal information back - not copies of my personal information back. They gave me copies of the documents that I gave them (this is proven by the notes that *** had made - was a copy of his notes - not his original writing on my documents). I asked where my original documents were at and they stated that they shredded them, why would they make copies to give me, only to shred the originals??? It doesn't make sense, that is why I'm complaining. There are other situations that I was not comfortable dealing with this company, and Yes, I changed my mind because I was mislead with changing my accounts from *** *** (a AA+ company) to a company (less than Revdex.com- company) that had *** in it's name, very misleading. I do not know how to get any resolution from this situation, other than to voice my concern about some of the dealings I had with this company. I feel everyone should be careful with their personal information with so much Idenity Fraud out there. I didn't know this company, other than the dinner event I went to. Everything sounded good on the surface, but deeper down in dealing with this company, I felt uncomfortable and just want my documents back. I know there is no way this will be resolved, since they state they gave me everything and I have no proof other than I have copies of my documents, and I can only "trust" my personal information will be safe
