The customer's collision insurance and associated benefit paid through it would be deemed a benefit of an agreement related to the propertyTherefore, we (Ford Credit) reserve the right to manage the proceeds as we see fitWe have many options available to assist our customers and would be happy to consider each of them as, they relate to this, particular situation.Thank you

In response to complaint ID ***, attached, please see the below summaryWith respect to the customer concerns regarding contractual information, the Retail Installment Contract outlines the following: Section (32): Buyer may not see or rent the property and must keep it free of all
encumbrances of claims of othersAny payment of encumbrances by Seller shall be an additional part of Buyer’s obligationBuyer will not use or permit the use of the property outside of the province or territory in Canada where the Vehicle was first registered without prior written consent of Seller, except for a period of days or less in (1) another province or territory in Canada, (2) the United States or (3) MexicoSection (34): Buyer shall keep insurance for all risks on the property and give Seller evidence of the insuranceBuyer may purchase the insurance from the company of Buyer’s choice, provided that Seller has the right to disapprove, on reasonable grounds, a company selected by BuyerIf Buyer does not maintain insurances as required hereunder, Seller will have the right to obtain the insurance for Buyer and to charge the cost to BuyerSection (37): If Buyer defaults in any way in performing Buyer’s obligations under this contract, the remaining time balance shall be due and Seller may, subject to applicable law, at its own discretion: a) require Buyer, or Buyers jointly and severally, to pay the balance with interest theron at the annual percentage rate (item 21); and b) repossess the propertySubject to applicable law, Buyer shall reimburse all cost incurred by Seller for such default including court ordered costsSeller may retain any payments made as liquidated damagesIf Buyer has not redeemed the property, Seller may sell the property at public sale (at which Seller may purchase) or dispose of the property by sale or otherwiseThe proceeds of any sale or disposition of the property of the property, less the expenses of retaking, holding, preparing for sale and selling the property and reasonable lawyer’s fees and legal expenses incurred by Seller, shall be applied to the satisfaction of Buyer’s obligations hereunder, Buyer shall be entitled to any surplusUnless prohibited by applicable law, any deficiency shall be paid buy Buyer to Seller Immediately with interest at the annual percentage rate (Item 21)If requested by Ford Credit, Buyer agreed to promptly and accurately complete, execute and deliver to Ford Credit its then current form of vehicle condition and/or accident reportBuyer also agrees to pay Ford Credit on demand any cost that Ford Credit may obtain to determine any information required regarding the condition of history of the Vehicle, including information required to satisfy requirements under applicable lawSummary of Actions to Date: The customer has asked Ford Credit to provide her permission to take and retain her vehicle in the State of FloridaWe have requested that she maintain insurance on the vehicle during her stay in the United States and current have provided her permission to maintain the vehicle in that country until November 5th, 2017, the date of her insurance expiryThe customer has requested that she be able to register the vehicle in the State of Florida which would entail Ford Credit being required to release our lien on our propertyThe lien on the vehicle will only be released upon the debt being satisfied in fullWe have provided the following options to the customer: 1. Maintain the scheduled monthly payments on the loan and provide insurance on the vehicle demonstrating coverage in the United States to maintain your Ford Credit Canada loan and continue driving2. To register and insure the vehicle in the State of Florida, arrange financing in the United States and payout Ford Credit CanadaOnce payout in full is received we would release our lien and advise the titling authority of such3.
