To Whom It May Concern:
At the request of *** ***, serving The Revdex.com of Metro Washington DC and Eastern Pennsylvania, we at Foremost Industries would like to respond to the complaint filed above by *** *** *** on 4/15/15:
While the facts presented by *** *** are generally accurate in an objective manner, he failed to mention other specifics in his complaint which precluded us from building his home in a timely fashion. After placing his order for a new modular home with us in May 2013, he decided to not follow thru at that time with the post Hurricane Sandy private insurance reimbursement funds and the approved SBA loan he had secured shortly thereafter. Instead, he asked to delay the project for a year to explore other ** residential grant/state funding programs. While this was of no consequence to us, we certainly would have been ready to move forward with his project in fall of or spring of at the latest. When he did get enrolled in a new **-funded program in August of 2013, there were still several months of delays getting his project moving locally with obstacles he faced that had nothing to do with Foremost Industries.
In November of 2014, we at Foremost DID decide, as a company, to terminate and withdraw from all ** post Hurricane Sandy rebuilding efforts and modular home building projects. After building a half dozen homes, we realized that the sheer distance and difficult coordination with local builders was not in the best interests of ourselves, the builders or customers looking to replace their lost homes.
As a general rule here at Foremost, any deposits for the creation of Permit Plans (blueprints) for homes are NON-REFUNDABLE. This is stipulated in the Agreement/Contract. At this point in the process, even if customers do NOT build with us, there are countless hours of “mind space” and engineering which have already occurred. Therefore, *** ***’s particular case and outcome was treated as any other that would have occurred here at Foremost. Additionally, customers have the opportunity to take these copywrited, specific plans we’ve created and go elsewhere to get their home built…which some customers explore. Therefore, there is an inherent value or investment in the plans once they’ve been created…hence the NON-REFUNDABLE clause in every Agreement
I PERSONALLY handled the sales process with *** *** myself after meeting him in early 2013. I always strived for constant and honest communication throughout the process with *** *** and made several trips to Union Beach, ** (miles) to meet with he and his contractor personally regarding his project. While it’s very unfortunate we could not build his home, given the circumstances and the information he failed to interject in his complaint and the fact we treated him as any other customer under “Agreement/Contract”, I respectfully disagree regarding his overall assessment of the situation and our role in not repaying the $2,in funds

I am trying to REJECT the answer from Foremost industries and I cannot enter text to reply, I have tried 2 different browsers and all I see is a Blue background where you would enter text.
 
Attached also is what I tried to attach but was not successful
 
I started asking for a refund less then 2 months after the contract was signed, see attached email and I have more leading through the end of 2013 I can provide. At that time [redacted] only trips to Union beach on our behalf was 1 trip in May the day of the signing of the contract. That was it. There was not another trip on our behalf until spring of 2014, 1 trip, and then again 1 trip in the summer of 2014 where we met at [redacted].
 
at this point only mileage on [redacted] time had been spent. Plans were not generated until Sept or October of 2014.
