Thank you for your letter of September 11, 2015, concerning the complaint you received from Mrs. [redacted]. In her complaint, Ms. [redacted] states that she has accounts with Forest Lawn Memorial Gardens and that she wishes to get her money refunded for the grave spaces and marker that she...

purchased. In order to consider this matter fully, we provide the following account information for Mrs. [redacted].
On or about May 24, 1988, Mrs. [redacted] and her husband, [redacted]., purchased two interment rights at the cemetery. This contract was subsequently paid in full in May 1991 and a Certificate of Ownership was issued to the [redacted]s.
Next, on June 4, 1991, the [redacted]s purchased a companion bronze memorial for themselves to be installed on a granite base. This contract was paid in full in June 1994.
Finally, on January 6, 1997, Mrs. [redacted] executed a contract for the purchase of a bronze
memorial on a granite base for her nephew. This marker was manufactured and delivered to the [redacted]s for installation in another cemetery.
We were initially contacted by Mrs. [redacted] on July 27, 2015 when she came to the cemetery office and requested to transfer her cemetery property and bronze memorial to her daughter. The cemetery was agreeable to making this transfer, but for some reason, Mrs. [redacted] balked at completing the required paperwork, and at which point, she changed her request and stated that she wanted to have her contract cancelled and her money returned to her. We informed Mrs. [redacted] that there was no requirement under Indiana law that the cemetery cancel her contracts for these purchases and refund her money, given these circumstances. Since that time, the cemetery has received a number of additional phone calls from Mrs. [redacted] with the same request to refund her money, which we decline to do.
As mentioned above, the cemetary has no legal obligation, nor any contractual obligation to refund Mrs. [redacted] her money on either of the purchases she made at the cemetery. However, we are still agreeable to processing a transfer of contractual rights to her daughter, provided that any such request is properly signed by both Mrs. [redacted] and her husband, the purchasers on these agreements.
