Complaint: [redacted] I am rejecting this response because: Much of what Dani A [redacted] has said is slanted or at times completely false Seabrook is a beach town, I asked for a beach shoot when speaking with her on the phone initially before I booked the session, and the opening shot on her company website is a beach scene An hour before the shoot when I called to ask if we could meet at the beach in order to ensure the most time with her was the first time she explained to me that she does not do beach photos because it might damage her equipment She refused to meet anywhere other than Mill She stated on the phone that she would have cancelled the shoot but knew that a reshoot was impossible for us as the participants were there from three different states and soon to be overseas What we wanted was an heirloom picture of a once in a lifetime family gathering She has conveniently ignored this information and insisted on only offering gift cards for additional shoots rather than a refund No one from the shoot has plans to vacation there again, and no one lives anywhere near that spot We know no one else to gift the shoot to, which I have explained to her repeatedly She has not addressed this After her responses to my emails continued to be counterproductive and unprofessional, I called her and left a polite message asking to speak to her in person so that we could come to a solution that we both felt good about After a few days of no call back, I called her business number, and the number in my phone that she had used to call me to convince me to book a shoot with her, and repeated my request Her response was another unprofessional email attacking me and my family I called and left another message stating that I needed to speak with her, what she was offering as a solution was impossible for me to use/accept, and that if she would not talk to me by phone I would file with the small claims court which would then mandate a mediation session All I wanted was to talk to her because I really thought we could work out our differences in real time She has refused to speak to me by phone since the day of the shoot When I realized that I could not meet the time frame of the small claims court (my husband is already on orders out of the country with the military and we will be joining him in a few weeks) I chose to work through the Revdex.com instead It was not a threat, it was a head's up At no time did I ever say that I liked the photos I did say that I looked forward to seeing all the pictures in the hopes that I would like one that she did not choose to edit She had told me in no uncertain terms during our pre-booking phone conversation that I had no say in which photos were edited, or in how the editing was doneBased on that conversation, I waited patiently to receive all the photos before expressing concern Needless to say, there were no hidden gems The family member to whom she refers did not decide to purchase further pictures because she did not think they were well done, and is considering legal action for slander after Dani's post Dani says it herself, she expected me to come up with indoor locations, (our house was not conducive to a shoot with that many people) She knew the weather well in advance and chose not to cancel so that she would not have to offer a refund She did no prep and had no alternative sites to proposed either indoors or out She organized only one picture in the minute session, and it only included five of the participants She was overwhelmed, frustrated and out of her league Additionally she never delivered the CD that was a part of the contract (per her attachment), requiring me to share the pictures with my family only via Dropbox which is not my area of expertise In order for me to accept her offer to re-edit certain photos, I need to speak to her so that she knows exactly which ones I need changed and how Because she did not honor her end of the contract to provide minutes of professional photography, professional editing and a CD of all pictures, I still feel that a refund is in order Sincerely, [redacted]

This letter is in response to the complaint you received: ID ***First and foremost, this session was scheduled at Seabrook, with a meeting destination of the Mill 109.This session was never to take place on or at a beach location.When the complainant received all of her sneak
peeks of ALL of the edited images online, she was happyand never mentioned any issues or concernsI have that proof in electronic correspondence betweenher and meThroughout the editing process, I updated the complainant with new images and neveronce did she complain or voice her opinion on the black and white edits or that the photos were notedited to her standardsThe complainant seemed happy and never once said she thought the photosession went badly or that I did not manage it wellShe had ample opportunity to voice her concernbefore receiving the FINAL edited imagesIn fact, I have in writing that after she had received andviewed all of the edits, she wished to have FAST delivery of the finished photosI quickly and diligentlysent the final images to her two weeks before the deadline I had originally promisedNot only did shereceive these early as requested but the package that she purchased included 10Medited images and Iprovided her with an added value for FREE of $
The day of the shoot
The complainant and I were set to meet at Mill by the community of SeabrookThis is a standardmeeting place for all of my clients when having a session at this locationThe complainant arrived 10minutes late to the meeting spotOnce she did arrive, she had me follow her to another location tomeet up with her familyOnce arriving, I was still missing two of the family members that showed up anadditional minutes lateDuring this time, not all of the family members where prepared for theshoot to startThis left approximately minutes for me to complete this sessionI managed thissession just like I would any othet as well as using the same locations spots for photos like I do for all mySeabrook sessionsI did however ask if they would like to use their rented house or any covered areaslike gazebos or cabanas but it was stated they wanted outdoor photos only
All photo sessions are nonrefundable and all sales are final once the invoice is paid as stated on theactual invoice, which I have included in this correspondenceOnce I received notice that the client wasunhappy, I went out of my way to offer a solutionThe solutions I offered were to retake their familyphotos immediately at their next soonest convenience or a $gift certificate for herself or a$gift certificate that she could give as a gift neither of which had an expiration dateIn additionto this I offered to rework the edits to her standards and the complainant refused all offers to resolvethis issue. The complaint against Forever Moments Photography has passed the line of a refund or settlement.The complainant has reached a level of harassment and bullying to the extent that I am having to reportit to the local police departmentI have received four emails that are multiple pages long of complaintsthat not only make no sense but go beyond my professional photography business The complainant hasharassed me and my family and taken it upon herself to call my business line repeatedly leaving longand bullying messagesThroughout the past weeks, she has made threats against me and my business.She has somehow also obtained my personal house number and has left in appropriate messages at myhome that have nothing to do with my business or pictures.The complainant had her family believing that I did not send her all the pictures that came with thepackageOne of the family members reached out to me and asked what images I had sent to thecomplainant so I resent all the photos to her family member and received a response that stated thatshe had deceived them into believing that she had been sent none of the finished imagesI state again, Isent the complainant (package included 10-20)I am proud of and stand by the images she receivedalong with the non edited photos that came with the full disc packageI was informed by a familymember of the complainants bullying tactics and techniquesI was also informed that this familymember has been a victim of harassment with emails sent from complainant recently as wellThisfamily member apologized for complainant and her behavior, thanked me for my photos and remarkedthat I did a great job.I wish the complainant would have accepted one of my many offers so we could come to a resolutionbut she refused anything I could offerI wish her the best in her new endeavors and hope she can findhappiness in the wonderful memories Forever Moments captured of her family while at Seabrook.In regards to the desired settlement - I have gone above and beyond in my offerings to resolve thisissueAs stated on the enclosed invoice complainant received and paid all sales are final and no refunds

In order for me to accept her offer to re-edit certain photos, I need to speak to her so that she knows exactly which ones I need changed and how.  Because she did not honor her end of the contract to provide 60 minutes of professional photography, professional editing and a CD of all pictures, I still feel that a refund is in order.
