I have reviewed the response made by the business in reference to complaint ID# ***, and have determined that my complaint has NOT been resolved because:
I do not recall ever having received the referenced letter. Again, the Associate Conference Minister led me to believe that I would have complete control over funds invested, including transfers to another provider, after a separation of service. The Pension Board is the Pension Board "of the" United Church of Christ, so it is fair to assume that conference ministers should be subject matter expects with regard to clergy compensation and benefits packages. If this matter is not resolved, then I will continue to file complaints with the Board of Trustees, Department of Labor, New York Attorney General's Office, and through social media. My request falls well within standard industry practices regarding separation of service from employers. Furthermore, the Plan allows for PBUCC discretion with these types of requests, and my request is a more than reasonable one. I have Masters and Doctorate degrees from a prominent UCC seminary and served the United Church of Christ with distinction for over years. I expect the PBUCC to serve my needs with the same regard. A copy of the referenced letter will be sent to the member.  A Conference Minister may be an expert regarding the benefits plans that are included in clergy compensation and benefits packages. However, expertise in clergy compensation and benefits packages does not mean that the Conference Minister is an expert in the administration of the Annuity Plan or any other benefits plans. As the member knows, the  Conference Ministers are employed by the United Church of Christ and are not employees of the Pension Boards.  The Pension Boards is an affiliated ministry of the United Church of Christ  and it has its own Board of Trustees.  As an experienced UCC clergyperson, [redacted] should be aware of the UCC’s structure and polity.   Although the response is not favorable, we have not changed our position.  We must administer the plan the same for all our members and an exception cannot be made.

[redacted] indicated he had been informed by the then, associate conference
minister, he could execute a rollover upon separation of service. The
associated conference minister is not an employee or representative of
the Pension Boards. Upon enrollment in the Annuity Plan for the...

Church of Christ, [redacted] was sent a letter dated November *, 2004
which included the following statements. “Should you terminate
employment with a United Church of Christ employer prior to your
retirement, your account will remain in the Fund and continue to
participate in the investment experience. At retirement, you may choose
how to receive your benefits as described in the enclosed Annuity Fund
Rules booklet.” Contributions were made to [redacted]’s
account by United Church of Christ employers for several years after the
November *, 2004 letter. [redacted] could have elected not to
participate in the plan, or at any time he could have requested that the
employers cease contributions to this plan, and commenced contributions
to another plan of his choice. As [redacted] has been
informed, the plan allows for a rollover or transfer under limited
circumstances. However, he does not meet the criteria for a rollover or
transfer. At retirement [redacted] may withdraw 20% of the
employer contributions plus earnings. The remaining 80% will provide
lifetime benefits for him and a joint annuitant, if he elects the joint
annuitant option.
