Initial Business Response /* (1000, 6, 2015/11/17) */
*** *** has falsified large portions of his Revdex.com testimonyI have been blessed to be a part of hundreds of projects across the front range over the last years- with zero complaints or unresolved issuesThe truth is that this client is
the one exception- he is the perfect example of an unreasonable client trying to stir up trouble and get things for freeHe assumes the majority of responsibility for the delay of this project*** is an un-educated client in the process of general construction, he is unwilling to listen and/or take advice, does not pay timely and is completely un reasonable to sub contractors
I have testimonies from the majority of sub contractors and vendors who have been a part of this project agreeing to the complete ignorance and lack of ability to reason in regards to the finish of this projectIts almost impossible now to get any subs to go to his house because he constantly is telling my subs not to do projects as I have directed them- on different occasions he has stopped sub contractual work completelyWe are currently working through ***'s punch list and only have a few cosmetic touch ups left before this project is completely finished
*** thinks the Arch' plans for the project are to be followed down to the exact inch and has no concept of build out variationsI have multiple examples of ***'s lack of understanding on this matter if you would like me to elaborate
To this point we have completed over $10k in extras not part of the original contract which were ordered by the client, this has added a little extra timeThe following is a list of changes or owner ordered materials that have resulted in the delay of this project-
-After Electricians roughed in job homeowner changed lighting in wine cellar, changed sconce wiring outside of wine cellar, changed wet bar layout completely, changed all locations for appliances in wet bar, changed entertainment cabinet layout and all entertainment wiring and insisted on adding multiple additional under cabinet lights and multiple in cabinet lightingAt trim out homeowner insisted on changing outlet color for wet bar outlets and stone wall outlets times- causing the purchase and re-install of said outlets
-After trim carpenters had been rolled out on job for weeks homeowner changed the following items- replace all baseboards with baseboards that were 3/of an inch larger in profile, change out all doors in the basement to have antiquated arch to match upstairs (after verbally agreeing to go with smooth roman top arch doors to match all arches and contours in arch plans), rip out and replace wine cellar door because the top arch was not round enough, rework railing to go downstairs to what he wanted (not what was agreed upon), replace all hallway baseboards going downstairs after they had all been installed to match the upstairs exactly, Add an exposed stair stringer to sides of stairs because he thought it would look better, then had carpenters rip out exposed stringer and replace with with another that had a different routed edge on it, Homeowner ordered all cabinets for main room in basement then could not provide a drawing or plan for install of crown molding build out after both carpenters and contractor had requested multiple timesHomeowner caused month delay in project by not ordering his cabinets early enough, Homeowner mis-ordered built inn wall cabinets and contractor had to wait and additional month to get correct cabinets to fixHomeowner changed entertainment wall layout to have radius build out one month after drywall was complete- so contractor had frame a wall with a radius in it months after framing was completed
-Additional homeowner delays include but are not limited to the following: *** had the stone mason rework the fireplace wall timesWe installed the fireplace wall as planned in the Arch'sthen homeowner requested a mantel and we agreed upon a stone mantel- but when the material arrived and was installed he said he didnt like the way it looked and wanted to replace it with a wood mantelSo in essence we installed the fireplace wall times to try to appease this man
-In an attempt to frustrate us, homeowner brought in his painter over weeks ago to paint the basementI informed homeowner that the basement was not ready for painting and that it has to be built before its paintedhe scoffed at my remarks and said there was plenty of areas ready for paintthen two weeks ago when we began to do our final punch list and drywall touch ups he said he could see the little touch up and patch areas and insisted he wanted the whole ceiling re-textured so the small areas would not show upi explained if the ceilings were not painted, as he insisted, we would have been able to blend the patches almost perfectely on a un disturbed drywall surface that had not been primed nor paintedAt that point one of the homeowners basically called me a liar and the verbal harassment has not stopped since
We are at the tail end of this project and I refuse to do any more change orders for this clientMy drywaller's will be back one more time to patch two small areasIf the homeowner wants to bring in another company to retexture his whole ceiling he can, but we are not taking any more responsibility for his actions
Thanks,

Initial Consumer Rebuttal /* (3000, 8, 2015/12/01) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Every item in our initial complaint is absolutely true and we stand by our statements 100% Not only do we have pictures and measurements to prove our assertions, we have a professional floor plan and contract that unequivocally dictate how our basement was to be finishedIn addition to the above items, we have the consult of a reputable custom home builder that not only verified our claims but supports our views of the inferior quality of *** ***'s work
Example Our floor plan clearly depicts the re-location of a window and position of a new wall so as to leave 28" after the placement of a wet bar with 24" depth cabinets and refrigerators*** not only moved the window to the wrong location, but after he finished, the window was not levelAfter immediately rejecting my claim he preceded to measure and was forced to admit his mistake and proceeded to level the windowThe window was still in the wrong location leaving only 23" of wall space for a 24" refrigerator, meanwhile charging us an extra $above the initial bid, which we paid in fullWhen the time came for the cabinet supplier to finalize the order, it was discovered that our carefully planned and designed wet bar would no longer fit with the window in the wrong locationWe were forced to reconfigure counter tops, cabinets and appliances which caused a significant delayThis also created the need to relocate outlets to accommodate new appliance locationsThe alternative would have been to move the window yet again to its proper locationAlthough this would have been entirely possible as proven by pictures taken during framing which is contrary to statements made by ***, we elected the former option in order to avoid an even longer delay
Example Our contract clearly states that all doors and trim to match existing door and trim used on the main floorTo our surprise, *** took it upon himself to change this contractual item without consentHis claim of having it in his "notes" is not only without merit but it is an illegitimate and unprofessional way to conduct businessWhen pressed for further explanation, *** stated that he sent his door and trim supplier to the house to pick the items and stated that he thought our existing doors were "antiquated"This again is unprofessional at best and disrespectful and unwarranted at worst*** clearly oversteps his bounds and disregarded our contractHe tried to take a shortcut with the trim by using a cheaper product and claiming that our trim was no longer availableAfter one simple phone call to a local trim supplier I was able to locate the exact trim to matchWeeks later he shows up with correct trim provided by his original supplier, which makes us wonder why he lied
Example The most egregious error made by *** *** was the blatant disregard of our contract which clearly states "recessed cans inclusive to bid" *** also sent us a document titled "Extras for *** which states in line
"recessed can upgrade-original bid included recessed cansCurrently we have a total of recessed fixturesadditional recessed cans at $a unit equals $1200"
Line states:
"LED can conversion of cans will be LED recessed cansUpgrade of $per unitIncludes can, trim and LED reflector$648"Both items were paid in full and in advanceMuch to our surprise again *** installed surface mount lighst akin to an oversized puck lightWe had never seen these lights prior to installation, despite the claim that *** said we "saw them at *** *** and picked them" that statement is not only categorically but another example that shows ***'s unprofessional and inept business practicesAny substitutions to the above stated contract and extras documents are unacceptable
Example The floor plan clearly depicts the shape and size of the wet bar island*** decided to build the island 1/2" too long causing another delay of several weeks***'s mistake caused the following problems:
Island curve did not line up with curve on tray ceiling as shown on floor plan
Walk- through space significantly reduced degrading the functionality of the wet bar space
Cabinets and appliance no longer fit properly as planned
After a prolonged delay of several more weeks *** finally sawed the support wall in two, re assembled the island to planned specifications but left an unsightly drywall patch at junction of two piecesThis destroyed the once smooth radius curve and left us with a patched up island
Example *** also left us with a mess of several drywall patches on the ceiling that are clearly visibleWhether the ceiling was primed or not (never painted) does not change the fact that the flaws were created by his drywallersThe mistake of patching a seam and patching over an existing electrical box that was there for a future pendant light is directly his responsibility and cannot be blamed on anyone but himself
*** is completely unwilling to fix his remaining mistakes and is acting in bad faith
As far as ***'s other claims of delays and additions requested by us, he leaves out very important truthsThe trim on the stairs that we requested was discussed at the very beginning of the project although suspiciously absent from his "notes", and again when railings were being installed on our stairsPuzzled by his aggressive resistance to this simple request, we consulted a contractor as well as other professionals and received a resounding consensus that this was a "no-brainer"and would take only hours to completeThis is hardly a delay of any significanceAfter finally complying, *** failed to communicate to his carpenter to route the edge as requestedThis is only one of many miscommunications *** had with his sub-contractors
In response to our request for a railing, it was determined that a strategically placed railing on the bottom of the stairs would greatly enhance the safety of everyone and is a requirement of the Douglas County Building codeEven ***, we would hope, should understand the importance of this simple request and was time and money well spent
There are almost countless other mistakes and omissions made by *** that we will have to live with but suffice it to say that our biggest mistake was hiring *** *** in the first place
In conclusion, this dispute is not about ***'s petty squabbles with his sub-contractors or following our floor plan to the exact inch, (*** cannot even come to within inches)It is about the blatant disregard of our contract and floor plan and ***'s arrogant denial of any responsibility to the outcome of our project
This dispute has not been resolved and is very much still active
We are requesting that Forrest Associates make good on installing lights per contract and restoring drywall to remove unsightly patches
Needless to say, we couldn't more strongly state that we do not recommend anyone to hire *** *** ,dba, Forrest Associates Inc

Final Business Response /* (4000, 10, 2015/12/14) */
Again I re-iterate these clients are the exceptionWe have had zero issues on all projects for the last years*** *** does not understand the general contracting processBesides the drawer fronts on his toy bench- 100% of the materials and labor have been provided and installed at his homeWe have provided *** with his final billing twice now but have not heard anything from him
Currently we are owed over $24,from this familyWe are working through *** third evolving punch listI will not be doing anymore drywall work or changing out any can lighting as these items have been completed for months*** directed the painters to move forward months ago when I told him the walls were not ready for paint until we could do all our troubleshooting and final patchworkSo now *** will have to live with his patches
The installed LED lights were also approved by *** before drywall- only because they are not what he thought they would look like, does not warrant grounds for replacement
sincerely,
*** ***
