*** *** was sent out on a "Conditional Sales Agreement", the condition is that in the event that we cannot obtain financing for her the car would be returnedShe agreed and signed the document stating this stipulationDuring the process we unable to contact the customer due to her
cellular phone being unreachable for whatever reasonSince she wanted to take possession of the vehicle while we worked on securing financing for, she of course had to have full coverage insuranceWhile we worked hard on this process for Ms***, because of driver irresponsibility the vehicle was impoundedMs*** was unwilling participate in the cost of retrieving the vehicle so at this point we thought it would be in the best interest of everyone to end this dealWe chose not to charge her for miles or usage of the vehicle despite the verbal and signed agreement to do soOf the deposit money given to us we elected to only deduct the impound chargesIn addition to that Anthony, out of the kindness of his heart, gave her additional monies of his pocket to try and help the issueMs*** then signed one last form agreeing to not hold Diamond Automotive responsible for any liability nor recourse and accepting the majority of her deposit backIn regards to her credit being affected, we can assure her that it was notShe was a sub-prime or second-chance applicant due to her sub-par credit and nothing has changedThe money deducted was due to her own actions and the insurance money she paid was an obvious necessity. There is nothing further we can do for Ms.*** at this time however we wish her the best with all her future endeavors

I am rejecting this response because:  One all my telephone numbers listed on the application are still active until May and I was still speaking with your finance Director [redacted] up until April when he called to tell me he was sending the temporary plates because mine had not been located. I also have my work number listed. Secondly if you had the plates since March why was I still being given temporary plates in April? I have an original copy of the forms I was asked to sign at my job. I never signed anything at the dealership. It says credit application. I signed this document and was told it was being submitted and and once Diamond received approval we would work out everything else. If this is not what was submitted what credit application was submitted and who signed it? You sent the contract by mail. Who initialed for the warranty. I have the original 5 documents I was left with at my job. My initials are not on the warranty. That's an extra 2,000 added on. Yes you sent a contract which you said you would FedEx Overnight on the 26th and I'd have them Saturday the 27th ,but instead you sent them in the mail and they were not DELIVERED SATURDAY the 27th. In fact I asked you to delivered to my job which is a 24 hr business nothing came. I had to go to the post office and pick it up on Monday the 29th which is the day it was signed for. Please check your records before posting incorrect information. Oh I never agreed to the amounts listed. 25.1% that's insane. Where did that amount even come from???? I will attach the documents I have. I never agreed to a $417 monthly payment. $300 was what was discussed when I came in to pick up the vehicle. and I never gave Diamond $2000 down payment. You yourself admitted I was not the only one this happened to and that the employees are no longer with you. I can accept that. I'm not trying to carry this any further than I have to. As I stated in the email I sent to [redacted] dated 7/6/15 I just want my money back. $1000. At this at this point I should sue for more but I'm done.  I have to find a new lender to refinance this joke of a contract that you are holding me accountable for, when you know good and well something went wrong, and I have to  come up with $1200 before Weds. for the back pay [redacted] is wanting. So all I'm asking from Diamond is my $1000 down payment back payable to me. I don't want you to help with the payment as we talked about earlier and you offered, though I appreciate the kind gesture. I just want this nightmare over. It has me stressed out and at this point I haven't driven the car in 2 weeks because I'm being threatened with repossession and Im scared i'll be stranded. I've missed worked and I'll probably be fired with no car because I work out of town and its vital for my job. I know you that's none of your concern but the neglectful and mischievous acts of some of your former employees should be. I will asked to be contacted at 830-583-0019 only. Thank you

Let us begin by saying how much we appreciate the opportunity to serve you. We are very bothered to hear of your dissatisfaction as we very much aim for customer satisfaction. Having said that, we have hopes of keeping you as part of the Diamond family. All of Diamond...

Automotive management & ownership has been made aware of your particular circumstances. After the concerns that were mentioned there was an investigation done of your concerns that we will touch on.    First the issue of credit and the necessary down payment needed to put your deal together. The lender that was utilized for you loan is a Sub-Prime lender, meaning that they deal primarily with 2nd chance credit or worse. Without getting into too much detail about your personal credit history, I can say with certainty that the type of loans that your credit warrants are less than ideal and are not in the "good" category. We arranged a loan for you with the finance company that best suited our application. The down payment was a result of a few factors, credit worthiness, vehicle selection and payment affordability. Going through the initial paperwork, it seems as though you were offered a more suitable vehicle multiple time by management. By suitable, you would've not had to have such a large initial cash investment (down payment). [redacted], attested to the case that the desire of this particular car, 2009 Mercedes C350, was very high and the customer offered more and more money down to accommodate the purchase of this car even after management tried to give more reasonable solutions.   The minor breakdown of the windshield isn't abnormal, especially for a 6 year old car even though the vehicle had very low miles, 34,222 to be exact. To keep good customer relations, we fixed the wiper at no cost to the customer. The same day there was a concern about a possible leak. We tested this issue and found the vehicle to not have any leak. However the water in the floor of the driver's side was apparent and after further investigating several Diamond employees noticed even lined residue surrounding the car. Both managers ([redacted] & [redacted]), mechanic ([redacted]), service manager ([redacted]) and the salesperson ([redacted]) all came to the same presumptive conclusion, the car was in a flood. Coincidentally, there was severe flooding in the area of Natalia at that time. We still went further to try and help by offering a trade.   The process of the deal had gone too far to just back out and considering that the vehicle more than likely had slight flood damage it would be quite unfair for Diamond Automotive to absorb this expense. We suggested calling in an insurance claim in the event that the vehicle suffered substantial damage. After, we offered to trade the car in for another but that didn't seem to be an option wanting to be explored.  From what I gather the car is in good running condition and we will still offer to trade the customer out of the vehicle for a fair market value. All in all, damages occurred to the vehicle while in the owner's possession and the dealer should not and will not be held liable. However we will maintain an effort to help the customer with any reasonable repairs at a reasonable rate and still extend the offer to trade. We hope this has shed light on the situation and our efforts to maintain great customer relations, our good name and our good standing with the Revdex.com.

In response to the Revdex.com Statement that was sent 6/25/2015. At the time of sale we provide customers with a copy of the contract, and a second copy when a customer picks up their license plates to insure a customer receives their documents. We have had her license plates since March of 2015. We have...

made numerous attempts to contact Mrs. [redacted] about her plates but the numbers we have listed for her are disconnected.  After receiving the Revdex.com complaint and getting her new phone number we have sent another copy of her contract and her license plates on 6/26/2015 and were delivered and signed for on 6/27/2015.  As for the Social Security number being wrong we have done internal investigation and all of our records such as credit apps, and credit reports all match the social that was provided to us from Mrs. [redacted] and were submitted to the finance company correctly. There has been an admin error and we are in contact with the finance company about the situation and are trying to correct it now.

In regards to the Revdex.com complaint sent by [redacted] The contract and license plates sent to Ms. [redacted] were not Fed Ex the documents were sent USPS to the address she provided to us. We asked for delivery confirmation from USPS. If no one was available at the time of delivery or refused to sign they are returned to the post office where Ms. [redacted] would indeed have to pick them up. Which she did receive on the 27th.There also shows to be some deception and deceit in Ms. [redacted] story throughout this ordeal. We did try to come up with a agreement with Ms [redacted] and also looked in to the situation as much as possible but she was being uncooperative. Ms. [redacted] said she didn't make any payments because she didn't have the Finance Company's information which is incorrect, when we contacted [redacted] they stated they were in contact with Ms. [redacted] and have set up payment arrangements with her, including pushing her first payment from April to May 2015. As for the Payment and Interest Rate on the contract she is claiming not to know about, there is no excuse, everyone should read what they sign in this day and age.We recently received a phone call and certified letters from Ms. [redacted] attorney so we no longer have any contact verbally or through email. It is unfortunate that we could not handle the situation without any attorneys involved, so we as well have turned over our information to our attorney.
