I need to reopen the case as I had not received any emails (inbox or spasm) on my complaint until today from Ms*** *** after calling her for the status(1) For the gutters, we want a 100% refund of $2,(2) On the basement, Brett M*XXXXXXXXX came to our home on 4/17/with Robert ** Z***XXX to sign the contract for the basementWe paid 50%, $3,600.00, to Robert *Z***XXX on the same dayThe signed contract stated the work would start on 4/20/Robert later told us that Bret got $3,from him, saying this was his moneyWithout the money Robert could not start the projectRobert claimed that he was working for Brett and asked several times for the money for the project but was refused with comments like "I don't care." So Brett has the $3,that we are asking backI can provide details if you needThank you!

Forza only had the contract to do the roof and the guttersThe roof has been completed, and Ms*** has refused to allow us to do the guttersWhen she is prepared to allow us to do the gutters we will come out and do the guttersAlso, because we did her roof, we agreed to do the gutters at cost (less than $2,000)
I introduced Ms*** to a guy who performs drywall work and she entered into a contract with him directly to do her basementShe has never had a a contract with Forza to do her basement

The response
from Forza Restoration Group, Incis unacceptable. The only acceptable resolution to this
complaint is a full refund of the money paid ($5,066.70). When Forza Restoration Group, Incacquired
*** ***, effective May 2015, they also acquired *** ***’s
contracts and responsibilities. This is
clearly outlined in a letter we received January 2015. The letter was sent certified mail, December

The letter,
from Forza Restoration Group, Inc., stated (in part), “As of May 2015, ***
***’s Ohio operation will be acquired by Forza Restoration Group,
Inc. If you currently have a contract
with *** *** or have had a contract with *** *** in the past,
this transition will be seamless, as all contracts and warranties, past and
present, will be fully honored by Forza Restoration. If you currently have a contract with ***
*** your points of contact will remain the same, along with all
tentative performance schedules.”
The letter
clearly states that Forza Restoration Group, Incwould be responsible for all
past and present contracts and warranties.
When Forza Restoration Group, Incresponded to the complaint I filed
with the Revdex.com they were mistaken when they wrote, “Any issue this client has
with *** *** is between him and *** ***.” The above mentioned letter makes all past and
present contracts with *** *** the responsibility of Forza Restoration
Group, Inc. Further, the statement, “Out
of the kindness of our heart, we told Mr*** that we would honor his contract
but we are under no contractual obligation to do so.” I spoke with *** *** and this was
never said to me. Forza Restoration
Group, Incis in breach of contract that was signed September 5, 2014. The contract states, “All labor is performed
within days of executing this agreement.”
It has been over nine months since the contract was signed and no work
has been started
In a letter we
received from *** ***, at the outset of the process, it stated (in
part), “With over 2,happy clients, *** ***, Incis one of the
largest insurance restoration companies in the State of Ohio, and we have achieved
an “A” rating with the Revdex.com.”
Since signing the contract, we have learned that *** *** was
never a member of the Revdex.com and the claims made in that letter
were fraudulent and deceptive. This is evidence
of how *** *** and *** *** set out to systematically steal client’s
money (theft by deception). Further, ***
*** and *** *** would string customers along by giving them
installation dates that would come and go with no work being done. This tactic is currently being used on us
My investigation
revealed that the initial scheduling of our project, October 2, 2014, was
nothing more than a ploy to make us believe things were progressing with our
contract. The material was never ordered
and the company to install the roof was never contacted by *** ***, contrary
to what the representative from *** *** had stated. We had hoped things might be different when
we received the letter stating Forza Restoration Group, Incacquired ***
*** but things have not changed.
*** *** is affiliated with the company and he is the senior
vice president of Forza Restoration Group, Inc.
It is in this capacity, *** *** has continued to mislead us
and not fulfill the terms of the contract
When I last
spoke with *** ***, on April 28, 2015, he asked that I give Forza a
chance to make things right. ***
*** stated that he would have the roofing material delivered by May 8,
and have the roof installed on or before May 15, 2015. Both dates have passed and I still do not
have a new roof. I have called ***
*** eight times since May 12, and I have left messages for him to
call me. As of the date of this response,
*** *** has not returned my phone calls
On May 22,
2015, *** *** came to my door and stated that *** *** sent him
to put a new roof on “your house.”
*** *** stated that he was only at my house to see what kind of
job needed to be completed. ***
*** stated that he was not there to do any work that day. When asked what company *** *** was
with he stated he had a crew that would put a roof on “your house.” *** *** stated that he was a
sub-contractor, but he did not work for a particular company. There is no evidence that *** *** is
licensed, insured, and bonded. I cannot
find any information to show *** *** has any roofing credentials
Again, I ask
that Forza Restoration Group, Incand *** *** refund the $5,
paid as a down payment to have a new roof put on my house. We have a signed contract; Forza Restoration
Group, Incand *** *** are in breach of that contract. And let me be perfectly clear, if we cannot resolve
this issue through the Revdex.com; we are prepared to use the other options available
to us (criminal and civil)

Mr*** needs to contact our office immediatelyWe did not place a lien on Mr***'s home and have no control over what another company does. Any lien on the property would be illegal, because we were the original contractor and have been paid in full. Our office manager can
provide Mr*** with a letter that he can send to the company which will require them to remove the lien within days

Mr. [redacted] accepted delivery of building materials.

Wrong company. Forza does not have a contract with Mr. [redacted] nor would have Forza acquired a contract for siding, if indeed, his roof was completed by another company.
I would suggest he file a complaint with the Revdex.com against Mac.

Forza's response is not consistent. Please reference a similar complaint where they replied:

Forza is MAC and they should be held accountable.

Forza is not Mac. A simple search with the Ohio Secretary of State's Office will demonstrate this.
We agreed to honor all Mac warranties and outstanding roofing contracts. We acquired no contracts for siding. This was a strategic acquisition.
As a good faith gesture, we will do Mr. [redacted] siding although we are not contractually obligated to do so.
But if Mr. [redacted] is seeking a refund, only Mac Contracting can pay that as they were the ones who accepted funds, not our company as much as Mr. [redacted] would like to presume.

I begrudgingly accept. What is the recourse when it doesn't get done? Much like MAC, Forza does not return phone calls either.
