This letter is in response to a complaint filed by [redacted] concerning a property located at [redacted] **We have never performed work for [redacted] other than some good will work stated belowThere has never been an exchange of money between Foster Construction and *** [redacted] In July [redacted] contacted our office to inquire if we had ever performed work on a house located at [redacted] in the past and we hadHe asked if someone would meet him at the home and an appointment was made for July 27, at amDuring our visit he explained that during heavy rain events he would get water seeping into his basement primarily in the laundry areaI explained to him that during extremely heavy rain events it is possible for the water to build up on the wail and enter at a higher point than is covered by the waterproofing membraneI pointed out likely areasOne at the entrance of the Air conditioning ine set, and two dryer vent locations, one is in use and the other is no longer usedI also noticed that [redacted] had greatly changed the terrain or grading of his yardAfter we had performed our work, we had left the yard with the grading going away from the home to a swale to drain the water away from the foundationA rear patio had been added that now drains toward the home and a swale no longer existsIn an act of good will, I decided to send a crew out on August 6th to extend the rubber waterproofing membrane above the new grade level on the left and rear of the home at no charge to [redacted] ***While our crew was there, they asked [redacted] what had been done with the exit drain for the footer drain on the right hand side of the home that we had installed years agoHe stated that during construction of a large parking area and retaining wall, his contractor had gotten into a drain but it was only for a downspout but the contractor reinstalled the drainOur crew informed him that there were two drain linesOne is the downspout and the other the footer drainAt that time [redacted] rented a camera so we could investigate the situationUpon inspection of the right hand footer drain, there was standing water at the right front corner [redacted] indicated that he wanted us to repair the drain for him at no charge claiming our drain had failed and it was our responsibilityThe drain was installed properly when we performed our work and now that extensive work has been done to the yard, the drain appears to be blockedI do not feel I am responsible for the footer drain due to the changes made to the yard and etcAfter we extended the water proofing membrane above the new grade, we contacted [redacted] after a heavy rain to inquire if the changes we had made had resolved the water issue, he indiacted that it hadAfter this, [redacted] began to call our office to ask that we reapir the footer drain at the right front corner and request a copy of the warrantyThe warranty covered the original home owner in He was informed that in order to repair the drain, we would have to charge him as a project [redacted] continued to call and became very hateful with our secretary, which at that time I told her to stop taking his callsI did the work to extend the waterproofing at no charge which was not due to anything we did, and I offered to repair [redacted] ***'s drain, but I would have to charge him to do soI have gone above and beyond what I am required to help [redacted] ***Thank You, [redacted] Foster Construction

[redacted] In July 2015 [redacted] contacted our office to inquire if we had ever performed work on a house located at [redacted] in the past and we had. He asked if someone would meet him at the home and an appointment was made for July 27, 2015 at 11 am. During our visit he explained that during heavy rain events he would get water seeping into his basement primarily in the laundry area. I explained to him that during extremely heavy rain events it is possible for the water to build up on the wail and enter at a higher point than is covered by the waterproofing membrane. I pointed out 3 likely areas. One at the entrance of the Air conditioning ine set, and two dryer vent locations, one is in use and the other is no longer used. I also noticed that [redacted] had greatly changed the terrain or grading of his yard. After we had performed our work, we had left the yard with the grading going away from the home to a swale to drain the water away from the foundation. I do not feel I am responsible for the footer drain due to the changes made to the yard and etc... After we extended the water proofing membrane above the new grade, we contacted [redacted] after a heavy rain to inquire if the changes we had made had resolved the water issue, he indiacted that it had. After this, [redacted] began to call our office to ask that we reapir the footer drain at the right front corner and request a copy of the warranty. The warranty covered the original home owner in 2012. He was informed that in order to repair the drain, we would have to charge him as a normal project. [redacted] continued to call and became very hateful with our secretary, which at that time I told her to stop taking his calls. I did the work to extend the waterproofing at no charge which was not due to anything we did, and I offered to repair [redacted]'s drain, but I would have to charge him to do so. I have gone above and beyond what I am required to help [redacted]. Thank You, [redacted] Foster Construction
