The contractor did contact us after receiving the complaint from the Revdex.com and we were able to set up a time to meet and resolve the issues that were outstandingThis list of complaints included a buzzing outlet, a loud vent fan, nail pops, an incomplete back door, unpainted doors (that were in fact part of the contract, not an “extra” that they were providing us), and cleanup of the yard (that was destroyed by them placing dumpsters in it rather than the driveway where they were instructed to put them.) The “additional” changes that were made to the house were discussed on day one, and therefore to say that this is what caused the delay is incorrectOur house fire occurred in June and work did not begin on the house until late October (around the same time period that they stated we would be back in the house.) They did later say that we were looking at another month and from then on when I contacted them regarding the completion time they would never give me an answerPart of the issues included blueprints that were drawn up by their company were incorrectThe upstairs on the blueprints had more square footage than the downstairsWe had to draw up new blueprints for the crew and this caused some delay (an issue that should have been addressed by Hays and Sons, not us.) As far as the outstanding balance that has not been paid, those funds are being held in an escrow account by our mortgage companyWe have completed everything that we needed in order to get those funds released to Hays and Sons, however the mortgage company is stating that Hays and Sons has not provided them the required documentation to release these funds (something Hays and Sons has been aware of for several months.) In addition Hays and Sons has authorization to contact the mortgage company to discuss the required documentation themselvesDuring the visit in August the nail pops were reset and the buzzing outlet was replacedWe are still waiting to hear about the loud vent fan, the incomplete back door, and the paintingI contacted Brian Bell on the morning of August 26th and asked him if they could get out there any time during that week, he stated he would call me backI never received a call back from Brian until Friday morning and they wanted to be there in an hourAt this point my spouse and myself had both went back to work as we had not anticipated a call since we had not heard from them in days and was unable to meet back up with themIn addition they wanted to send out the same project manager that I had made clear I did not want to work with anymoreI asked Brian to please let me know in advance when he could get a crew out to the house as I have to make arrangements for work if I need to be thereI had previously notified Hays and Sons that all summer my wife was available every Friday afternoons to get the house completed and never once was contacted about making arrangementsI also told them we could meet any day as long as we have notice for our employersI cannot leave work with an hour’s notice to resolve something that they have been delaying for over a year! We now have new issues occurring in the house that need to be resolved including an outlet that is hanging out and doors that are stickingIn addition the yard repairs have yet to be addressed

Our initial call on this project was 8/6/and the actual date of loss was 8/5/stating that air conditioner had previous leak causing damage to the flooring in the bathroom, hallway, and mechanical closet areaJosh K*** initially wrote the estimate for repairs and submitted to Mrs
***'s insurance company for approvalWe received the approval to begin repairs and the job was put into production on 8/12/and was assigned to TR M***, Project ManagerThe issue began with the first installers of Mrs***'s kitchen floor*** *** was contracted to complete this portion of the job which was not installed correctlyThey agreed and set up to have it reinstalledWhen the second flooring installers that came out from *** *** they noticed that a nail had been put through the bottom board of the cabinets by the previous installersConcerned that they would get accused of doing it they advised Mrs*** of the dilemma and Mrs*** was able to take photos of the issue. TR M*** left the company in late October or early November and a new Project Manager was assigned and that was Ian M***Ian M*** had meet with Mrs*** on 11/11/to see where the project was left by TR M*** and what remained to be completedThe install of the second floor by *** *** was not of quality so it had to be scheduled for a third timeDuring this timeframe Mrs*** did not want to deal with Ian M*** and at this time Allan S***, SrProject Manager and Greg K***, (Director of Operations) were the only people that she wanted to deal with which occurred on 12/5/Ian M*** was able to communicate with Mrs*** after this date and trying to get the cabinet issue resolved and moving forward with other items that needed to be finalizedFinally, the third set of installers from *** *** installed the vinyl in the kitchen which still have some minor issues that need resolved. Allan S***, SrProject Manager, was in communication with *** *** to resolve the issue of the nail in the bottom board of the cabinets to get a resolutionIn February, *** *** was not taking responsibility for their installers mistakeThe decision was made to send our in-house carpenter out to address the cabinet issue which was done on 2/12/and 2/13/Hays and Sons carpenter redid the cabinet and counter topPlease see photos attached to file to address the broken piece at the bottom of the cabinet.On 2/19/Ian M*** was discussing cabinet issue with Allan S*** and Josh K*** (General Manager) to get a resolution to a new issue that occurredMrs*** advised that the cabinet dropped near the sink and now there is a slight bow and she would like to have the wood that was installed to match the rest of her cabinetsJosh K*** attempted to reach Mrs*** on 2/24/and 2/26/to arrange a meeting with her to discuss cabinets.Josh K*** had a meeting with Mrs*** on 3/4/Mrs*** called in on 3/6/requesting to speak to Greg K*** as she did not want to deal with Josh K*** on this issueGreg K*** met with Mrs*** on 3/10/to look at the cabinet concerns and we decided that we need to see if we can find a match for the cabinets before we proceeded with addressing the slight bow in the counter topHe advised that he would get with Allan to see what could be done for a suitable matchAllan S*** went and met with Mrs*** to see if a prefinished piece of wood was going to be a suitable match for herAllan S*** advised Greg K*** this option was not suitable for Mrs***Greg K*** arranged a meeting on 4/21/with Mrs*** to look at the option that Allan S*** had presented her withGreg K*** committed to look as well to come up with another option other than this one Greg K*** reached out to Jay A*** on 4/22/via phone of *** *** and Henry P*** in Lafayette, IN to assist in getting a resolution to this Greg K*** emailed Jay A*** again on 5/15/as after my initial phone call with him Mrs*** had not received a call from him as of yetGreg K*** emailed Jay A*** again on 5/22/to see when the appointment was scheduledGreg K*** emailed Jay A*** again on 5/26/to see when the appointment was scheduled.Greg K*** emailed Jay A*** again on 6/2/to see when the appointment was scheduled and supplied him with her new cell phone numberJay A*** met with Mrs*** on 6/6/14Greg K*** spoke to Jay A*** on 6/6/to see if we had any pictures of the crawl space as he wanted to view the picturesI advised that we did not but would be willing to get them if it helps in bringing a resolution to this issueWeek of June 9th Greg K*** sent Hays and Sons technician out to take photos of crawl space and supply them to Jay A*** from Henry P***Jay A*** talked to Mrs*** on 6/27/and advised he was getting a meeting time arranged with Greg K***Greg K*** and Jay A*** set to meet Mrs*** on 7/7/at 9am at her homeMrs*** talked to Greg K*** as he arrived before Jay A*** who was bringing a stain person to address the color match and advised the only two items that she wanted addressed was the matching of the wood and to level the counter top and she would be happyJay A*** was speaking to Mrs*** and Mrs*** explained to Jay all the issues that we have had with her companyAfter a period of time she advised both Jay A*** and Greg K*** to leave as she was done and would take care of it herselfGreg K*** asked Jay A*** to give him some time with Mrs*** and she expressed her dissatisfaction with Jay and *** ***Greg K*** asked what he could do an Mrs*** responded, "I don't want anything, the only thing I want is for you to leave"Greg K*** advised Mrs*** that he was going to do something to make this right with her and she said that it not about money but the principle of the entire situationGreg K*** agreed with Mrs***Mrs*** did ask Greg K*** to make certain that the heating and air-conditioning person got paid and gave him the contact information to ensure that it got taken care ofHays and Sons regrets that we did not meet Mrs***'s expectation level throughout the process, nor our own and is willing to make it right with her to make certain she some sort of satisfaction from the inconvenience she has endured over this length of timeGreg K*** is working on another solution for Mrs*** and does not quite have all the details worked out yet but once he does he plans on reaching out to Mrs*** to present her with that solution even though she advises she wants nothing and is hopeful Mrs*** will be in agreement. Mrs*** has shown great patience and understanding up until the 7/7/meeting and Hays and Sons was hoping that meeting was going to end in a reasonable resolution to this situation which unfortunately did not and caused more frustration which was definitely not the intentIf you need additional information please feel free to contact Greg K*** at 765-412-

I would’ve been satisfied with the stain matching & the cabinets level. They had since the end of Dectil July to accomplish this themselves. If they couldn’t accomplish this, how do they expect me to accomplish matching and leveling? Futhermore, my kitchen matched and was level when came into my home to do the jobNow they expect me to settle for unmatched cabinets. Who is to say the countertop will work because of it being bowed for so long. I did not create tis problem, the people they hired did

Mrs. [redacted] advised that she would be satisfied with matching the color and leveling the counter top. We are willing to provide her $500.00 so she can pay someone to accomplish this on her behalf. If that option does not suffice we would be willing to provide her with $1050.00 which would cover the material and labor costs of replacing the lower cabinets only and reusing the existing countertop. The suppliers attached layout is for full wood box base cabinets with maple door and drawer fronts. These cabinets will be a drastically different product than what is currently in the home as the existing cabinets are face frames only supported with a metal drawer glide. This layout omits the filler piece to the left of the stove and the cabinet to the right which we have included in the pricing for labor and materials above.

Hays and Sons does not see it necessary to contact our insurance carrier as we are attempting to facilitate an agreeable solution with Mrs. [redacted]. We have provided two solutions in previous responses which do not appear from the rejections to be acceptable. It would be helpful if Mrs. [redacted] would be specific in her desired outcome to move closer to an agreeable solution.

I want matching cabinets,  and the countertop to be level, not bowed. I want the symmetry of balance they once had before the flooring installation began.  Since they are bonded and insured, I want them to send out their insurance adjuster.

After receiving this
correspondence I immediately contacted the homeowner and set an appointment to
address their areas of concern. The soonest they were available was Friday,
August 1st 2014 at 12:00pm. I arranged to have a drywaller and
electrician meet me on site to take care of the...

issues (nail pops, loud vent
fan, and buzzing GFI plug). These issues were addressed and I am currently
working with the owners to set a time for a painter to return and touch up
paint where drywall repairs were made. We are also going to paint a front and
back door for them at no additional cost when the painter returns.
The original repairs would have
been a 3-4 month process as we were mainly restoring the same footprint of the
home. The timeline greatly increased when we collectively agreed to turn an
attic and porch space (totaling over 1,000sf additional) into finished living
space in exchange for the homeowners completing and purchasing there own flooring.
Along with the additional square footage, came additional permits, inspections,
and time. The homeowners have occupied the home since February, all while
completing the flooring. These punch list items, that would fall under their 5 year warranty, are being completed while that warranty is actually suspended due to an outstanding balance of over $63,000.
These issues are taken very
seriously and will be taken care of, as we sincerely care about giving our customers the best possible experience. Thanks!

This is after Hayes & Sons tried fixing cabinets..Pictures were taken 20 July 2014. We pulled string line on top of cabinet. This is more than a slight bow.

When the rejection was received I called Mr. [redacted] immediately to address the areas of concern. I thought the response and solution was submitted right after that discussion took place with him, but obviously was not completed/sent properly. I apologize for the delay/mistake on my part of the response as it was taken very seriously. I want to add that this did NOT delay the action on repairs. The rejection came as somewhat of a surprise. In fact, I thought we were waiting on a return call from them to begin. When I met Mrs. [redacted] on site to address the original outlet, fan, and drywall concerns she informed me that she would let me know what day would work for her to address the painting that could not be completed until the drywall work was complete and cured. Mr. [redacted] informed me that his wife would be home and available all week when we called to send out a crew on Friday. I assured him that it was a busy week, but he was a priority and I would see to it that he was squeezed. When discussing this with Mr. [redacted] on September 3rd, he decided that their first day of availability moving forward would be September 15th. We completed the painting and fixed the "new" concern of an outlet that fell out of the wall on September 15th as he requested. It was simply a loose screw that was tightened and reset. The only issues left to address are plugs that go in the vinyl trim around the back door windows where screws are exposed. The were misplaced at some point in the process as they were taped to the window during installation. We are finding out that these are nearly impossible to find without purchasing the door itself. The other item is the yard. I have agreed multiple times to apply more grass seed, not covered by the insurance company, to repair the yard affected by dumpsters. Mr. and Mrs. [redacted] agreed we would do the seeding when mowing season is over and heat is no longer an issue. They are going to call me when they are done mowing for the year and seed/straw/dirt will be placed upon that call.Once again, these items have been addressed without receiving final payment after resubmitting everything to the mortgage company that they requested.
