Initial Business Response /* (1000, 5, 2014/06/16) */
Dear Sirs:

Four Leaf Finance advocates strongly on behalf of its customers, and we take pride in the service we provide. We are extremely disappointed that despite our repeated efforts to explain this situation to Ms. [redacted] in...

simple terms, we have been unable to ally her concerns. Our internal records show that there have been at least seven distinct conversations on this same issue - all resulting in heightened escalation. We appreciate the agencies efforts, therefore, to assist us in addressing the compliant and resolving the issue.

As explained to Ms. [redacted] on numerous occasions, In order to meet the stringent guidelines outlined by all of the credit agencies, any new company wishing to report payments must reach a certain number of accredited accounts. While it works to meet those requirements, Four Leaf has, behind the scenes, already established an account with TransUnion and has already created the account databases in anticipation of reporting in the very near future. All current payments from our customers have already been uploaded and are ready for submission. Once we hit the reporting thresholds, we will be ready to report. When that time comes, all of Ms. [redacted] payment activity will be uploaded - dating back to her first payment - such that no payment 'credit' will be lost. This has been explained to her each and every time she has contacted our team.

Ms. [redacted] first complaint on this issue was not received and logged until March of 2014. We stipulate that Ms. [redacted] of our team did suggest that reporting "should begin" within 90 days, but never promised nor guaranteed that outcome. On the contrary, and owing to her experience with reporting similar activity through other finance companies, Ms. [redacted] indicated to Ms. [redacted] that reporting was always subject to the approval of the agency, and that Four Lead did not have ultimate control. No one has been lying, no one has been purposefully misleading, nor attempting to obfuscate the truth. Ms. [redacted] and later Ms. [redacted] in every conversation have indicated that all payments would eventually get reported and that we are working toward reporting in the very near future.

It should be noted the Fair Credit Reporting Act does not require a finance company or any lender to report payments. We are doing this as a service to our customers, and at our own expense, but it was never guaranteed nor promised as a condition of Ms. Dickmans contract with Four Leaf. It would also not give her ample justification for missing payments, or refusing to respond to collection efforts. We are operating within the law, and providing the best level of service we can within the confines of the restrictions imposed on us.
Initial Consumer Rebuttal /* (3000, 7, 2014/06/16) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Unfortunately I reported 11/2013 as my purchase date of said vehicle when it was actually 11/2012. I started inquiring about the status of reporting to the credit bureau's in June 2013 - roughly 6 months after purchase. I am given the same answer every time - 30-90 days. I have been told this by [redacted] and [redacted]. My last phone call with [redacted] was roughly 1 1/2 months ago - she advised me they needed 10 more purchase contracts and everything would be reported but she requested I speak with [redacted] as she knows more information about this. I called [redacted] (who was clearly irritated by my call) and advised her what [redacted] told me. [redacted] didn't think that was information I should know, and maybe I shouldn't however [redacted] shared that, and just again advise me that everything would be reported in 30-90 days. I advised [redacted] that is an answer I can no longer accept as I have been told that for roughly 1 year. Mind you, I have never had a conversation with Four Leaf screaming or using foul language, so I am not sure what "resulting in heightened escalation" means unless of course we are referring to [redacted] who chose to end our last conversation on the phone because I advised her I needed a truthful answer as to when reporting would start. I also feel in the response above that Four Leaf Finance feels that have explained to me "in simplest terms" the situation, when in fact they have not. All I have ever asked is one thing - when will reporting start. To date I still do not have that. So let me be as clear as possible - in the last year I have been advised by [redacted] and later [redacted] that Four Leaf Finance would be reporting to the credit agencies within the next 30-90 days. Your answer above states "In the very near future". Please supply me with a date as "in the very near future" if too vague and open for interpretation. It is also worth noting that your records show I didn't inquire about this until March 2014, [redacted] knows I have been inquiring about this for more than 3 months, and your response in general above confirms that as well. I have never ignored a phone call from Four Leaf as inferred above - I in fact welcome them.
I look forward to your response of an exact date of payment reporting to the credit bureau's.
