8/7/[redacted] Revdex.com Corporate Office [redacted] ***To Whom It May Concern:This letter is in response of a complaint made by [redacted] about billing or a collection issue.Let me start this letter by saying the we have reached out to [redacted] about her concerns, prior to this complaint, with billingAfter speaking with her about the mishap and offering her options to cancel or freeze her account, she seemed satisfied.I want to start by rsponding to the sexual assault allegationOn March 820171, [redacted] , received a phone call from a members Eating that [redacted] was attending our group classes discussing with other members about an incident between herself and one of our Personal Trainers who at the time was also our Manager and group instructorHer discussions with other members were stating that she had been exchanging text messages with him in which it had gotten out of hand and unprofessional and that she had reached out to the owners, myself, and the owners did nothing about it which is falseWe received no prior statements from her about this matterAt the time of receiving this inform ation, I immediately reached out to [redacted] stating my concerns about this matterWe then did some invetigating and handled the matter the saxne day by releasing this individualAt no time during our phone conversations did she mention she would like to cancel her membeshipIn fact, she stated she wanted to work with a different trainer which at that time I stated that I would give her information on our other trainers [redacted] said she would continue her membership and I encouraged her to stay on track with her fitnes journey.11:10Fox FitnessA couple of months go by and we receive a message from [redacted] on May 10, stating that she was uncomfortable going back to the gym and while eating at S ubway she overheard a few girls talking about her and the incident stated aboveHer mesage claimed that she was sure it was "he" that was pointing her out to peopleWe responded to her mæsage by first apologizing for feeling uncomfortable and then gave her instructions on how to cancel her membershipShe did not respond.On June rd we received a message that she having trouble paying her bill online and that she wished to be contacted on help to pay her billWe then assisted with the issue via mesage but was unsuccessful at resolving the issueAt that time, we responded that our Manager would contact her to help with billingThe same day she was contacted by our manager to help her with billingShe takes a payment over the phone and then asks [redacted] if this is the card she would like to keep on file [redacted] then states she would not like it on file because she likes to pay her own bill, however our software system is set up to automatically save credit/debit info unless it is manually toggled off which was mistakenly unnoticed when taking her payment over the phoneThe information that we are to keep a card on file is stated in the signed agreement.The following month on July31, [redacted] texted myself and the Facebook page upset that her monthly payment was pulled outThe payment was automatically pulled out due to her card being put on fileI kindly responded that our manager would call her to discuss the matterPer our manager, she was apologized to about saving the credit card infoShe was informed that the system saves and pulls payments automatically [redacted] was then asked if she would like to cancel or freeze her account and [redacted] 's response that she did not want to cancel or freeze her accountOur manager stated, she even encouraged [redacted] to come back and try our new classes.Our cancellation policy stats that the member is to come in and sign a cancellation formIf the membership is still under contract, which could be a lyr or month contract, and the member wishes to cancel, there is a $cancellation fee for breaking that contractShe has been made aware of the policy and has even been offered to freeze her account both options were deniedIt is also stated in her signed membership agreement that a cc is to be on file and if for any they wish to cancel it has to be in writing and the cancelation fee has to be paid in fullThe account also has to be in good standing in order to cancelThis policy is strictly enforced[redacted] The reason for the long response to [redacted] 's complaint is to give full understanding on the m ultiple issues we have had in the past with [redacted] leading up to this complaintWe have kindly encouraged her to continue her journey and help her in any wayBoth matters that were stated in her complaint were handled and taken care of in a professional matterWe will be readily available to assist her in canceling her membership at any time, if she wishe to do so, by following our cancelation policy[redacted] ***Owner

I am rejecting this response because: Per the paragraph it clearly states that I asked that my CC not be put on file, and *** clearly stated that she didn't save it Therefore, that is using my credit card without permission as I called on the phone June and made a payment which was a one time payment not to save my CC and that it was saved without my permission This is illegal and I should be refunded the money taken from that card as Fox Fitness didn't not have authroization to use that for except for June 23.There is so much more the the sexual alligations I have a neighbor that has heard from people at the gym who don't even know me or that we are friends but it's still being talked about. I went a few weeks ago with her and the next day she went without me and people were telling her to stay away from me because of all the stuff that went down.I'm just asking for the money taken off my credit card and I'm so done and over this because only permission was given on 6-when I called over the phone
