On June 22,2015, the complainant moved out of our property and turned in keysI confirmed his forwarding address with him and at this time he had not provided an apartment numberHis lease did not expire until July 31, I was able to re-rent his apartment on his behalf for June 29,I
processed his move-out disposition and submitted it to our corporate officeOn July 8, 2015, a letter was sent out to the complainant, along with a check for the balance of his security depositThe only charge taken out was carpet cleaning, and the balance was sent back to him to the address he had provided to usOn August 10, 2015, he called our office and stated that he had not yet received his deposit refund and was wondering if it had been processed yetI assured him it had already gone out over a month ago and that I would check with my corporate office to see if it had been received back as returned mailThe person that handles the deposit disposition refunds and charges was out of the office that day but would be in the next day to check on it so I called the complainant back to relay this information to himI also confirmed again what his forwarding address was and asked if there was a unit number that he had forgotten to tell meHe said there was a unit number for his address and gave it to meI told him to check with his apartment community's rental office to see if, by chance, they had it in their office because it didn't have a unit number on itHe said he would do that and get back to me to let me knowOn August 11, 2015, the corporate office called me to let me know that we had not received the check back in the mail, nor had it cleared the bankI had not yet heard back from the complainant to see if his rental office had the checkOn August 24, 2015, I called the complainant again and left a message to see if he had been able to check with his rental office and/or if he had received the checkHe called me back later that day and said that they didn't have it in the office and that he had still not received the checkI told him we would have to put a stop payment on the check and would re-issue itI then informed the corporate office that he has not yet received itThe check is being reissued and sent back out to him at the full forwarding address with the apartment number includedThe deposit disposition for this apartment was processed in accordance with Montana Landlord Tenant LawWe were not aware there was a problem until after the day requirement had passedMTLA 70-25-202(3) states, "It is not a wrongful withholding of security deposit funds if the landlord mails the funds to the last-known address of a tenant who has departed and the tenant does not receive the funds because the tenant has not given the landlord the tenant's new address, but the landlord remains liable to the tenant for the amount due the tenant." We have shown due diligence in resolving the matter and do not feel that any additional reimbursement other than what is due back to him should be awarded in this matterWe look forward to resolving this matterPlease do not hesitate to contact me if you have further questions or concerns
