Horrible company
We rented a boat for a vacation from 10/03 to 10/07. Paid in full. The hurricane hit the area on 09/29 so we were forced to cancel. The company refuses to refund our money. Now we are forced to sue them. Avoid this company!

We rented a boat during our vacation from this company. It had numerous problems and we were promised a partial refund. Owner will not respond/refund
We booked a two week vacation in Cape Coral FL. The whole reason for selecting this area was the ability to enjoy the water and surrounding islands of SW Florida.

The property rental agency (for our rental property), Florida Perfection LLC, also rents boats to guests and after viewing their website chose to rent through them. The pictures and descriptions of boats offered on their website indicates new(er), beautiful well maintained boats. We mistakenly fell for this misleading advertising!
The delivery of the boat was delayed by two days due to a maintenance issue with the prop. During this delay, I contacted three other boat rental agencys in Cape Coral, but they did not have any boats available at that late time for the entire 7-day period we were seeking. If we wanted to have the use of a boat during our stay, I was forced to wait for the repairs to be accomplished.
What was delivered to us was an old, heavily used deck boat with numerous safety items that weren't working. On our second trip out, an alarm sounded referencing engine oil! We immediately returned and reported the problem to the owner, Bjoern Stillman. His answer was that the oil needed changed but to ignore the alarm and warning. He knew the oil service was required but while it was supposedly at a boat repair service for the prop, chose not to have it performed. His Jack-of-all-trades maintenance man came out and pulled the wire to the alarm so we didn't have to listen to it. What other warnings may have used that alarm were now also silenced. He confirmed the oil quantity was full so we felt the motor was safe enough to use, but overdue for service.
*Next we noticed the boat registration had expired, including the registration decal on the side of the boat. He assured us it was registered but couldn't provide a photo to present to authorities should we be stopped.
*Of most concern to me was the lack of a working depth finder, especially when operating in unfamiliar, dark water that SW FL is known for. Again, MTC man arrived, stated the transducer failed. Parts were supposedly ordered and promised to be repaired soon. That never happened!
*Where there was supposed to be a toilet, it had been gutted and removed.
*Horn did not work
*Battery charging selector did not work, though I was told to always turn it off at the end of the day. It's position made no difference on the operation of the electrical system at all.
*I was told the interior had just been replaced. The driver's seat was literally, excrutiatingly painful to sit on. The bolster was only wood covered in vinyl..no padding! Absolute torture!
Fire extinguisher holder was broken, and EMPTY!
Initially the sound system did not work, but they did eventually resolve that problem. Score one for them!
Steering this boat was a FULL time job, it wanted to go everywhere except where you had it pointed. Having owned boats previously, It is safe to say that the steering linkage required adjustment or repair.
Engine RPM's had a mind of their own. Like the steering, without any movement to the throttle, the engine RPM's would increase or decrease and require constant adjustment. Operating the boat in this condition was totally unenjoyable!
It is safe to say that this boat is very poorly maintained!!! And, the business misrepresents their product to the unsuspecting customer. What is worse, is that after discussing this with Mr. Stillman, he assured me of a "decent discount" for my troubles. Now, after returning the boat he is claiming I bent the prop and is holding me responsible. Again, the depth finder doesn't work(!!!) and we did slowly traverse a shallow SANDY area with the motor tilted up. There is absolutely no way it would have damaged the prop the way he is implying. He does not hold himself at all responsible to any degree and dismisses my assertions that a depth finder was necessary,and would have provided the needed information to avoid this.
Fuel gauges were very inaccurate.

Desired Outcome

Our experience was terrible! The boat is inexcusable and its condition reflects on Mr. S's concern for his customer's well being. I have attempted to reach out to Mr. S politley, and respectfully to resolve this dispute and have him issue his promised refund. His responses are always hostile in nature, and unreasonable. He has absolutely zero concern for the customer's satisfaction and seldom uses facts in his response to my questions or comments. He accused me of leaving the boat without the adequate amount of fuel. The gauges were showing slightly more than what I received it with. Since the gauges only gave vague readings, I agreed to do the "right" thing and take the boat for fuel service, which I did. The tank was totally full. He still accuse me of robbing him of fuel, even though I have explained to him many times, with photos, that it had been topped off. I offered to split the rental with him 50/50. We had been charged $1300 for a 7-day rental which is what other, reputable boat rental agencys charge. Their boats were less than two months old!!! His boat was probably produced shortly after they invented fiberglass. Given our experience, I thought it a totally fair compromise. His response is NO, I don't want to talk about it anymore. AND, you bent the prop and owe me $215 for it's repair. As previously stated, I did not hit anything during our usage that would have damaged the prop. He asserts that a new prop was installed immediately prior to our rental. I seriously doubt that. I asked for an invoice that he claimed he had showing the prop replacment, but he never provided it. A guest we took out on day one stated he looked at the prop during our trip and assured me it was most definitely NOT a new prop! It was faded and nicked and had lost most of the paint.This on our first day of usage! Again, the boating portion of our trip was miserable due to the problems we encountered with this boat. We had no other options for boat rentals at this late time, so we waited for the late delivery. The longer we had the boat, the more problems and difficiencies were uncovered. During this time, Mr. S promised a partial refund which is what I am seeking with this complaint. Half of the rental fee, $650. Thank you

I never refused to be the owner of Florida Perfection SW Corp and the owner of FPSW Boats LLC. However, I want a complaint to be filed under the company it belongs to.

Regarding the complaint of the customer. The customer complained about the boat on the first day of his rental. I initially offered to take the boat back if it is unacceptable for him and don´t charge anything. After research he decided to keep the boat because others were more expensive.

After his rental duration Mr. literally extorted me to give him an outrageous discount. He started with the offer to get the boat for free for a week (so a 1300$ discount). Then he offered to pay 50% of the rental fee. After I denied this solution he left an unacceptable review on VRBO/Home Away.

I have attached screenshots as a proof that Mr. was offered to return the boat right away after 2 days of usage for no charge. Also it contains the proof of the outrageous demands of discount he asked for and the threats of a bad review he finally left on VRBO/Home Away

Mr. left the boat in horrible conditions. He broke the new propeller and left the boat with 20% less fuel than he got it. I ended up with a loss of 250$ for the propeller exchange and the refuel costs of 48$.

If you wish I will upload a statement from the Marina. Mr. got the boat with a little delay because the propeller was in need to be changed. He got a brand new one. I have screenshots from the conversation with Mr. about getting a boat with a brand new propeller as well.

It is quite obvious that the customer tries to harm my business just because I failed to fulfil his outrageous demands. He did this with VRBO/Home Away and is trying to do this here as well. I´m in business with the boat comapny for many years and never had issues like this. Certainly especially with boats and unexperienced customers issues are quite normal and I am usually very generous when it comes to customer satisfaction. But this customer was from the beginning outrageous in his demands and threats. My inner voice hardly refused to solve this problem with money. It would be easy for me to waive on the money and stay out of this anger but the way he addressed his issues and the way he keeps trying to attack me shows me that I did the right thing.

Please review all documents and make yourself your own opinion about the situation. I´m sure you will make the right decision just based on the facts. I appreciate your help and work in this matter

Hello:

I would ask that my previously provided statements and attachments be reviewed as a recap to our experience with this boat rental and Mr. S. It would be a collective waste of our time for me to rewrite that information, and submit your office to having to reread it.

I would like to provide a factcheck on what Mr. S. last wrote in the order it was written.

1. Our vacation to Cape Coral was entirely predicated on it having a boat rental. When the numerous issues arrised with Mr. Stillman's boat I did attempt to rent from another vendor. Unfortunately, at that late time there were none available so we were faced with either accepting Mr. Stillman's boat or not having one at all. We begrudgingly accepted his. It was not because the other boats were more expensive, just not available.

2. During the frustration and aggrivation of the numerous issues this boat had, (please see that list on my original complaint) I did suggest he refund our rental fee. I later realized that was unreasonable on my part as we did have "use" of a boat and proposed what I thought was a fair compromise, a 50/50 split which he declined. His assertion that there is a bad review on VRBO because of that is totally untrue! In fact, there is no review on VRBO/Homeaway from me or anyone in our party referencing our experience! This can be verified by going to VRBO and looking up this property's ID#***.
3. Again, THERE IS NO REVIEW ON VRBO/HOMEAWAY from me or anyone in my party and in no way am I trying to "harm" his business!
4. I did not leave the boat in horrible condition, he delivered it in horrible condition! I did not damage the prop during our use and I have repeatedly asked for proof from him that it came with a new prop when we took delivery, AND that he had to install another new prop after our rental as he alleges. He has never provided that documentation and left the boat at the home's dock for the next renters to use immediately after our departure from the property. Lastly, I completely filled the fuel tank on the boat prior to returning it which was not how it was delivered to me. Our agreement was for him to deliver it full of fuel, and I would return it full of fuel which as a man of my word I honored!

It is frustrating and offensive to be accused of extortion, leaving the boat in horrible condition as well as trying to harm his business through a review that doesn't exist. Mr. S. has never acknowledged that we rented a property he represents for two weeks as well as a boat rental for 7 days. This amounted to a large sum of money and should warrant a little appreciation to me the customer. When an issue arrises and a customer complains, he becomes defensive, accusatory and uses everything but facts to slander his customer. I have tried more than once to politely and respectfully resolve this matter, and can only hope an acceptable resolution can be obtained.

It´s getting more and more strange with the statements of this customer and it´s tough to understand the motivation of this customer.

Mr. states indeed he never left a review on VRBO/Home Away ? This is one more proof in this matter where the customer shows how dishonest his statements are. He left a review. Please check the attachment

After I complained about this review at the customer service from VRBO/Home Away they agreed with me and fortunately removed this scurrilous and business disruptive review. Please check the words he used. He called me unethical and unreasonable. He warned others to do business with me and mentioned my name.

If you need to I will involve the customer service who can confirm that Mr. left this review and they deleted it. She already agreed to write a statement for me. Attached is the screenshot of the deleted review.

I don´t know why the customer lies about facts that can be easily be proofed as a lie. But i´m sure this next evidence will help you to make a decision.
