I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below
I apologize for the delay in respondingMy family and I were on vacation. I am very disappointed with Ms***'s responseLet me address each point stated in her response. 1)The company did install the Elk Prestique Plus shingles, a 50-year shingle with a 40-year warranty (100% replacement years thru and a prorated warranty between years 40-50)Perhaps Ms*** is confused with this warranty when she states that they provided us a10-year warranty on laborThis is absolutely not trueThe labor warranty in no way states years anywhereA copy of the warranty is attached. 2)While the roof may have been installed using the number of nails required per shingle, GAF specifications for fasteners for this particular shingle due to the thickness is 1.5” - 1.75” nailsI had a certified GAF approved roofing contractor inspect our roof, and he informed me that the roof was not installed according to specifications back in I have a copy of that report which also states the cost to replace and can provide you a copy of this. I am also awaiting pictures that clearly demonstrate the improper installation and would be happy to provide those as well. 3)Ms*** did, in fact, send out her foreman to repair the original damage from the shingles that were blown off in the stormHe returned after the roof leaked again, causing water to run through our bathroom lights in one bathroom and down the window in our second bathroomThe water was pouring in the attic and I had to put buckets to collect the waterIt was the second time that he told me the only way to take care of the problem was to replace the roofHis visits and repair were indeed at no costHowever, the labor warranty has not expired. 4)Ms*** did say she would fix any leaks we hadHowever, this isn't the caseI contacted her several times about the continuous leaks in the attic after rains, but nothing has been doneIn my last communication with her, she told me she was sending the boss, along with a GAF rep, out to look at the roof and that never occurredSo she has not kept her word. I am not satisfied with Ms***'s response and am prepared to take whatever steps are necessary to get resolution to the problem. I await a response. Thank you. Best Regards,

Our company, Francis Pollinger & Son, Incwill repair any area on the rear of Mr*** roof that he states that he is still having a concernIt was a thirty year warranty that Mr*** was issued, as noted on Mr***'s proposal and it is on the shingles not the workmanshipIn 1990, the shingles that Mr*** chose were years, as stated on his proposal and our company warranty theworkmanship for ten yearsAs stated in previous correspondence, our company foreman was to evaluate and make necessary repairs to the area on the rear of the house where Mr*** was said to be experiencing a leak and that is what he didAs noted, our company will return to make any additional repairs that are needed to the area of concern. If Mr*** would please provide to our company, the name of the GAF approved roofing contractor whom he said inspected his roof and provided him with the information about the specifications that were required by GAF back in the year of 1990, it would be greatly appreciatedAlso, a review of the original proposal would be appreciated .Again, our company is willing to make any necessary repairs to the area of the rear of the roof where Mr*** states he is having a problem

Please accept my sincere apology for not returning our company, Francis Pollinger & Son, Inc., correspondence sooner but I had emergency surgery and was not in the office to reply to Mr. [redacted]'s concern. Our company installed and Elk Prestique Plus shingle roof which carried a 40 year...

Warranty on the shingles. We also provided Mr. [redacted] a 10 year warranty on labor not a 30 year warranty as he has stated. Our company installed the shingles according to the manufactures specifications that were detailed back in February 1990 when Mr.[redacted] contracted us to install his roof. When Mr. [redacted] contacted our office to inform us that he was having a leaking issue on 4/23/15, I, [redacted] sent our foreman out to his house to make any necessary repairs that may have been causing the said water filtration at no cost to Me. [redacted] even though the workmanship warranty had expired. The installation of the shingles in 1990 were certainly up to the standards that were outlined by the manufacturer atthat time.[redacted] has discontinued manufacturing shingles which occurred around 5 years ago. I stated to Mr. [redacted], that our company is willing to make any repairs to correct any leaks he may be having but as to installing a new shingle roof as he is seeking, I do not believe that is an option for our company. As I stated, the shingles were installed according to the specifications of the [redacted] when the roof was installed in February 1990.Please contact me with any further questions or concerns. I am back to work but for only a few hours a day which is normal y between 12 & 4:00 p.m.

Review: During a rain and wind storm in April 2015, a section of our roof was lost. I noticed that the bath carpet was wet but didn't realize at this point that the roof was leaking. Since that storm, we had other storms that caused heavy leaking from the recessed lighting in our main bathroom and leaking down the window of our master bathroom. After several phone calls to the company, they finally sent out a roofing contractor. He informed me that he put a temporary patch on the roof. He said, from his inspection of the back of the roof (our bathrooms are located at the back of the house), it needed to be completely replaced down to the plywood. Since then, I have called and visited the company office several times. They have made many promises, but to date nothing has been done. During my last conversation on July 17 (when I went directly to their office which no one was returning my calls), the roofer was going to come to my home, along the the roof shingle company representative, to access the roof. This was to have occurred on July 18 but never did. I have made more phone calls on July 20, 21 and July 27 and have not received a reply. In the meantime with the rains we have been having, I need to put a bucket in my attic is collect the leaking water. When we purchased the roof, we purchased a 40-year with guarantee and a 30-year guarantee on the installation The roof is 25 years old, and I feel at this point that I paid for a 40-year roof and received a 25-year roof. Additionally, it is apparent that the installation was not up to standard. We saw the damaged shingles and the required nail length was not used consistently on the shingles (which I believe is a contributing factor to the damage that has occurred).Desired Settlement: My desired outcome is the roofing contractor take responsibility and replace the roof. I am expecting that a reputable roofing company acknowledge the workmanship was not up to standard and honor the warranty on the workmanship.
