[redacted] signed a cap price agreement on 8/**/2014 for a max rate of 3.599/gallon. This was a discounted rate since our regular posted price at that
time was 3.959/gallon. Our prices have been steadily decreasing since a high in January of 4.499/gallon. Our current price is 3.649/gallon
The cap price agreement states that the oil will be delivered at the cap price or our daily posted cap program price, whichever is lower. At this time, his cap price is less then our posted cap program price which is our current price of 3.649/gallon. Some customers signed in June or July at cap rates of
3.699 to 3.999 /gallon and are now paying the lower rate of 3.649/gallon.
If prices continue lower and we lower our higher price inventories with colder weather, I feel that [redacted] will see his price go lower. I would be more than happy to speak with [redacted] and see if we can come to a satisfactory solution to his complaint.

Frank Bros service has always been outstanding. Their techs are very helpful and always take their time to go over the details of a problem.

What I am having a problem with is their oil prices. I signed a contract for $3.59/gallon at max rate. It can never go above that price but it will go down with the market. I keep checking prices with all Frank Bros competitors and the competitors prices keep falling. Every time I call to speak with the sales team at Frank Bros they keep saying sorry that is the price and it's not falling.

That is 100% not fair when Frank Bros know I signed a contract and can't leave to get a fair price. I am locked in with them and they won't adjust their prices with the market even though they said they would.Desired Settlement: I would like for my oil prices to be fair and just compared to all of the other oil companies on Long Island.
