In response to this complaint, we did not ever intend to pass off a warranted issue To our previous knowledge the purchase of the Guardsman Warranty protection superseded the warranty that we have through our storeIt was never our intention to not warrant any service issue, and once we were made aware of the Guardsman policy we handled the service concern promptlyThe sofa has been reordered and will be delivered to the customer for a direct exchange once it is received in our store

I reviewed the response made by the business in reference to complaint ID [redacted] , and find the resolution is satisfactory to me

Benjamin Franklin acknowledged the on time guarantee on the original purchase priceSee the attached items(Invoice and final finance paperwork) See below for the breakdown:Original Price: $2,528Discount: $602Subtotal: $1,926On Time Guarantee (As agreed to by customer and Kory): $150Total Financed: $1,

07/10/2004: Benjamin Franklin was called out to make a repair under the sinkWe replaced shutoff valves and new piping, customer said she would install the faucet herself 02/04/2012: Benjamin Franklin was called out because the customer had a drain backup in the homeWe cabled the main drain line thru the cleanout to the city main sewer and restored flowGave a day warranty 12/03/2013: Benjamin Franklin was called out because of a drain backupWe cabled the main drain line, pulled roots with the drain machine blade out of the main line, we gave no warranty because of the pre-existing issue of the roots, and recommended to the customer to have the main line inspected for free with a camera machine to see what damage was done to the main drain line and where the damage was at 12/10/2013: On the previous appointment (12/03/2013) Benjamin Franklin advised the customer to schedule a free camera inspectionThis appointment (12/10/2013) was the free camera inspectionOnce the plumbing advisor was dispatched to the call, the customer cancelled the appointment 11/21/2014: Benjamin Franklin was called out for another drain backup issueWe cabled the main line again, and found a problem in the line going towards the house from the street city mainTalked with customer about setting up a free camera inspection and the customer agreed to do soCamera inspection was set up for 11/21/to scope the condition of the mainline given the fact we have been out once a year for years at this point 11/24/2014: Plumbing advisor was dispatched out to the customers home to do the free camera inspection of the damaged mainlineDuring the confirmation of the call, the customer cancelled this camera inspection 08/03/2015: Benjamin Franklin was called out for a drain backupWe cleared the line of the unknown clog and restored flow to the lineWe gave a day warranty 12/18/2015: Benjamin Franklin was called out for a drain backupWe attempted to unclog the main drain and found a bad spot in the main line outside of the homeTalked with customer about doing a camera inspection, and the customer declined having the line scoped to further identify what the issue wasThe technician that ran this call looked thru the previous history at this address and gave no warranty given all of the cancelled camera inspections and the previous drain problems We recommend camera inspections for any main drain line where we encounter roots, breakage, or belliesAnd, we do not charge for this service If you have roots throughout your main line, running a drain machine once a year every year will not fix that problem fullyYou run the chance of damaging the line further, or tearing up the drain machine or the components associated with itWe try to recommend to our customers their best solution and in this case after pulling roots from the mainline on the 2nd drain appointment, this customers solution to see what was happening within that main line was a camera inspectionWhich was accepted twice, but then cancelledAlso the inspection was offered a third time, and the customer declined fullyIt is not to clear a drain of blockage once a year or twice a year for a running total of yearsThere is a underlying issue, and pulling roots out of a main line is what that underlying issue can beIt’s sight unseen though without a camera inspectionThe roots will grow back into the pipe, continue to break it down, and running a drain machine over and over will just speed up the process of damaging that pipeAlso, once roots grow thru a drain line, it creates holes in that line also, which don’t aid in letting sewage drain easily I talked with this customer sometime in December and explained all of this to herWe went through each appointment, the findings, why there was no warranty and why I could not give her money backIf this was a failure on my drain technician’s performance I would credit the $back with no problemBut, in this scenario, this is not a performance failure of any of my drain technicians, her main drain line has issues that can’t be completely solved by snaking a drainIn the complaint the customer referenced she had Kelly Plumbing out to snake the same drain also and has no issuesThe customer didn’t have issues with us either between the appointments from to 2013, to or to The drains were working fine between each of those appointmentsI am confident that this drain will back up again and Kelly Plumbing or whoever will back out recommending the same thing we did I am willing to do a free camera inspection for this customerHowever, at this point, I cannot credit back the $because Benjamin Franklin Plumbing was never given the opportunity to prove or disprove our recommendation of the camera inspection

On 03/19/Benjamin Franklin Plumbing was called out to clear a kitchen sink drain that was draining slowly and had kitchen waste coming back up thru the drainThe appointment was scheduled in a - time frame windowOur drain tech showed up on time and proceeded to clear out the kitchen

Also please see the attached write up on pipe corrosion, causes, and protection suggestions Nick notated on this call about the age of plumbing system vs negligence of your tenants because of his observations on the drain lines in the basementHe also notated that there was a pinhole leak found on the garbage disposal line, and that could not be caused be cablingI spoke with Nick a few minutes ago and he does not believe he reached the point in question in the basement with the drain machineIt is possible there was not a leak before because of whatever item was clogging this specific lineAs your tenants said, they had back up in the kitchen sink and it was not draining at allTherefore, once we removed the clog, and restored drainage flow, with an aged plumbing system and possible corrosion issues, the flow restored to that drain line would leakUsually this is a small leak and goes unnoticed unless someone is spending ample time in that area to notice it I apologize for the leak in this room where you had items stored, but I don’t feel this was due to our cabling processIt may have just gone unnoticed until we were there to do the drain cleaning and Nick made you or your tenants aware while he was in the homeAgain, please see Nick’s notes below: And this is the email from Mr**'s tenant that they sent to him, please notice that we noted about the age of this plumbing system when we were out on 03/01/The person that came out on 03/01/was the first time we have ever been to this location and was a completely different plumber there to replace a tub and shower faucet that was leaking***,Greetings from IndyHope all is well with you and ***.Unfortunately, another plumbing incident occurred in the houseYesterday the kitchen sink was blocked upWe tried all the home remedies we could: using plunger, using baking soda and vinegar, then using DranoNo successI also used your drain augur (foot)No success eitherWe called in the plumber today (Ben Franklin) who had to use a foot augur twice to clear the blockageHe said the issue was due to the age of the systemThat came to $199.While the plumber was here, *** was doing her piano practice down in the basementShe ran upstairs to tell us that water was pouring into the storage room (where the HVAC system is)We found that the copper drain pipe carrying kitchen wastewater had also sprung a leakIt was a good thing she was practicing piano in the basement and heard it; otherwise, there would have been a huge basement flooding problem. The plumber who came and fixed the leaking water valve last time had told us that the entire house's copper plumbing system would eventually need to be replaced, due to ageI guess this was the next piece to failThe plumber is calling his associate to come in later today to replace the broken section of pipeThat will be a charge of $327.The plumber also determined that the garbage disposal also sprung a leak due to faulty part that needs replacementHe quoted something like $to replace thatWe decided to hold off on repairing the disposal (unless you want us to) and seeing if that will work out

We appreciate the feedback and concern from our customerAt Benjamin Franklin we like to hear all feedback from customer's on service visitsLet us first apologize for the mix up on this appointmentWe are a very busy, fast moving plumbing company and unfortunately sometimes things are shuffled
around and mixed up in the effort to take care of every customer same dayI will strive for a resolution on this service visit.MrsS***'s appointment was booked 04/30/around 1:00pm that same afternoonOur scheduling service put the customer's request in the earliest appointment time frame we hadThese windows fill very fast, sometimes days or weeks in advance for certain daysThe weekends are a very high volume time for us. This was a 6:00pm - 10:00pm No Time Frame Guaranteed windowThat means we will schedule you for same day service but cannot always promise to get a technician out same dayOur on call technicians usually start a later shift so they can cover these late appointment times and can be out past midnightIt really depends on their calls and types of service that is needed on those calls, in most cases late night appointments are usually emergency situations. The advertised on time guarantee does not apply to the No Time Frame Guarantee appointmentsThese are reserved times for "after hours"Unfortunately, in this case, our plumber that was on call was stuck replacing a water heater for a customer that was without hot waterI'm not sure why the scheduling center promised we would be there before midnight, and I do apologize for that mix upThis would be an opportunity for me to provide coaching on our appointment times with themI do intend to fully refund the cost of the service visit because of the scheduling mix up in the amount of what Mrs*** paidThat total is $137.00. Thank you,Kory K***Operations ManagerBenjamin Franklin Plumbing

We did go out and look at this customer's situation on Friday, 6/24. We gave a price to do the work but did not have manpower availability to do the work until Monday, 6/27. We did not charge for the estimate and scheduled the work for Monday. The customer wanted us to do it on Saturday, 6/25 but...

we simply did not have schedule availability. The gas company had already been out to this customer's home and shut off the gas supply because the lines were determined to be unsafe. This was not a quick fix situation and we needed time to get this on the schedule to accomplish the work safely and properly. The customer agreed to the Monday schedule. However, on Saturday they called complaining that we hadn't shown up. We let them know that they were on the schedule for Monday but they ended up calling back and canceling the work. Again, we have not charged this customer anything. We are sorry that we could not perform in the time frame they wanted, but we were up front with them on time frame schedules when we were out on Friday and again when we spoke with them on Saturday.
As I have already communicated to my superiors, I never intended to come across as being rude or uncaring. I was simply trying to work through the situation. I spoke to Ms. [redacted] for just two minutes on Saturday and with her grandson for about one minute. I would have continued the conversation but the grandson hung up on me. I do apologize if I came across in a negative way. I am also sorry we weren’t able to do a better job on scheduling but our weekend schedule was already filled before we even ran the call on Friday.
Additionally, this customer states that I would not give him my name, however following our conversation he called in again asking to speak with a manager over me and mentioned me by name. The following is a copy of this call from our call center.

In response to this complaint, we did not ever intend to pass off a warranted issue.  To our previous knowledge the purchase of the Guardsman Warranty protection  superseded the warranty that we have through our store. It was never our intention to   not warrant any service...

07/10/2004: Benjamin Franklin was called out to make a repair under the sink. We replaced shutoff valves and new piping, customer said she would install the faucet herself.   02/04/2012: Benjamin Franklin was called out because the customer had a drain backup in the home. We cabled the main...

drain line thru the cleanout to the city main sewer and restored flow. Gave a 67 day warranty.   12/03/2013: Benjamin Franklin was called out because of a drain backup. We cabled the main drain line, pulled roots with the drain machine blade out of the main line, we gave no warranty because of the pre-existing issue of the roots, and recommended to the customer to have the main line inspected for free with a camera machine to see what damage was done to the main drain line and where the damage was at.   12/10/2013: On the previous appointment (12/03/2013) Benjamin Franklin advised the customer to schedule a free camera inspection. This appointment (12/10/2013) was the free camera inspection. Once the plumbing advisor was dispatched to the call, the customer cancelled the appointment.   11/21/2014: Benjamin Franklin was called out for another drain backup issue. We cabled the main line again, and found a problem in the line going towards the house from the street city main. Talked with customer about setting up a  free camera inspection and the customer agreed to do so. Camera inspection was set up for 11/21/2014 to scope the condition of the mainline given the fact we have been out once a year for 3 years at this point.   11/24/2014: Plumbing advisor was dispatched out to the customers home to do the free camera inspection of the damaged mainline. During the confirmation of the call, the customer cancelled this camera inspection.   08/03/2015: Benjamin Franklin was called out  for a drain backup. We cleared the line of the unknown clog and restored flow to the line. We gave a 67 day warranty.   12/18/2015: Benjamin Franklin was called out for a drain backup. We attempted to unclog the main drain and found a bad spot in the main line outside of the home. Talked with customer about doing a camera inspection, and the customer declined having the line scoped to further identify what the issue was. The technician that ran this call looked thru the previous history at this address and gave no warranty given all of the cancelled camera inspections and the previous drain problems.   We recommend camera inspections for any main drain line where we encounter roots, breakage, or bellies. And, we do not charge for this service.  If you have roots throughout your main line, running a drain machine once a year every year will not fix that problem fully. You run the chance of damaging the line further, or tearing up the drain machine or the components associated with it. We try to recommend to our customers their best solution and in this case after pulling roots from the mainline on the 2nd drain appointment, this customers solution to see what was happening within that main line was a camera inspection. Which was accepted twice, but then cancelled. Also the inspection was offered a third time, and the customer declined fully. It is not normal to clear a drain of blockage once a year or twice a year for a running total of 4 years. There is a underlying issue, and pulling roots out of  a main line is what that underlying issue can be. It’s sight unseen though without a camera inspection. The roots will grow back into the pipe, continue to break it down, and running a drain machine over and over will just speed up the process of damaging that pipe. Also, once roots grow thru a drain line, it creates holes in that line also, which don’t aid in letting sewage drain easily.   I talked with this customer sometime in December and explained all of this to her. We went through each appointment, the findings, why there was no warranty and why I could not give her money back. If this was a failure on my drain technician’s performance I would credit the $128.00 back with no problem. But, in this scenario, this is not a performance failure of any of my drain technicians, her main drain line has issues that can’t be completely solved by snaking a drain. In the complaint the customer referenced she had Kelly Plumbing out to snake the same drain also and has no issues. The customer didn’t have issues with us either between the appointments from 2012 to 2013, 2013 to 2014 or 2014 to 2015. The drains were working fine between each of those appointments. I am confident that this drain will back up again and Kelly Plumbing or whoever will back out recommending the same thing we did.   I am willing to do a free camera inspection for this customer. However, at this point, I cannot credit back the $128 because Benjamin Franklin Plumbing was never given the opportunity to prove or disprove our recommendation of the camera inspection.

We will be contacting this customer today to address these concerns and to get this grade and seed work scheduled. The supervisor who will be on point to contact the customer and see this through to completion is Spenser H[redacted]. He can be reached at 317-[redacted].
