There was a fire outside my apartment last nightThe manager came through and yelled for everyone to get out of their apartments ONLY timeshe did not yell more than that, she did not make sure people were out of their homesI didn't even hear itMy children and I were asleepMy friend who was on the couch thank goodness heard it and smelled the fire and woke us upWhen we got outside everyone, including the manager were just watching the blazing bush like it was a candleA couple men grabbed the emergency fire extinguishers, which didn't even workThe manager left to go home to her teenagersShe didn't check to see if everyone was ok or out of their homes, she didn't even come backMy friend had to show the firemen where she livedShe didn't care about the tenantsShe didn't care about the complex
My friend ran to get my hose and the of us got the fire under controlIf it wasn't for my friend that fire would've taken over our complex before the fire dept got there and my boys and I would've diedAn older couple that live below me didn't even come out until they heard the fire trucksThey would've been dead tooThis management is a joke they don't give a f* about it's tenants just our moneyThey would've stood there and watched us die just liked they sat there and watched this fire blaze higher and higher

Initial Business Response /* (1000, 5, 2014/03/31) */
Initial Consumer Rebuttal /* (3000, 7, 2014/04/05) */
(The consumer indicated he/she DID NOT accept the response from the business.)
In response to Mr. St Clair's letter, first of all he offered an AC (duo-pac) signed by...

both parties thru addendum 2/18/13. On March 5, the appraiser Kirby Shropshire & Associates, which stated the increased value would be 132,000 with an addition of a AC (duo-pac) by a licensed and bonded contractor.
Mr. St Clair states that the age of the house is at fault and states we have the original windows.
In receipt of the appraisal reports. it states we have dual windows, all around the house, energy efficient, and not as Mr. [redacted] stated original windows. The home has dual pane windows long before I purchased the home. As for vaulted ceilings , homes in our area with vaulted celings have installed AC (duo-pac's).
The building permit was pulled on April 29, for an AC change out, not for installation of a new unit. We never had an AC system prior to moving in. The appraisal reports and photos show their is only a master cool, which I was aware of.
Mr. Hubbell was sent out to correct the problems to pass [redacted] inspections. It took 4 months from the time Mr. Hubbell started to finish the project.
Mr. [redacted] stated that Hubbell ran the title 24 test, this is not true, as Mike Sumner ran the test on 5/10/13. According to calibration of diagnostic equipment they must be re-calibrated monthly. The last time it was calibrated was April 1, 2013, the date of the test was done on May 10. 2013. The machine was 10 days past calibration. Mr. Hubbell is not licensed to do the HERS title 24 test.
Mr. St Clair states that I was aware of the AC unit that had been installed and not a (duo-pac), which is not true. I was not aware that a split system was to be subsittuded , Mr. [redacted] made that decision on his own. Daniel and I askaed the realtor why their was no (duo -pac) installed and he stated he was not allowed to answer that question. He did not know. My partner called [redacted] after we moved in to ask who the contractor was , because the unit did not turn on. He replied they no longer worked for him, and then sent Mr. Hubbell 3 days later to address the issues we had and to pull a permit. He had no idea why the permit was not pulled.
The unit is undersized. A 3 ton unit equals 400 sq ft a minute, big enough to cool a house, the size of 1,200 sq. ft. Our home is 1527 sq. ft. They installed a new coil that was manufactured in 2013 on a heater that was installed in 1982, which is not compatible to the old heater. The refrigerate line should have been 7/8 diameter, it is only 3/4 inch diameter. Several reputable AC licensed and bonded companies stated the condenser, the coil and the furnace are not compatible with each other. The return vent is too small and the registers are not the right ones for the house.
All [redacted] is proposing is to install a new heater to rectify the problem with the same old parts. Mr. St Clair spoke to Daniel my partner, per phone conversation that he tried to do it as inexpensive as he could. When Mr. Hubbell came to inspect the problems, he told Daniel that [redacted] stated he wanted the job corrected for under $600. Daniel's is prepared to testify in a court of law to the conversations he had to these events.
The money added for this addendum was not St. Clairs money. We paid full asking price for the house, and took out an additional loan for 4,000 dollars for a AC (duo-pac). He offered per addendum to install the AC (duo-pac). My partner, Daniel was here when the workers were
doing the jobs to make the AC unit work properly.
The unit still has issues, does not cool properly, runs 24/7, as I have the bill to prove for that month of July. The bill jumped from 107 to 405 a month. It did not and does not cool the house down. My partner's grandfather and brother own McKinney's air conditioner since 1934 and do quality work.
I honestly believed Mr. St Clair was installing a AC (duo-pac).... We learned upon final inspection that a split unit was installed instead without my knowledge. We brought it up to [redacted]'s attention at that time and he states it was done to be more cost effective and energy efficient.
I have bids ranging from 9,700 to 13,500 to install an AC (duo-pac) system. The vents would need to be replaced as they also detected leaks in the duct systems.
The only alternative would be to go to small claims and he can tell the judge why he did not honor the contract.
Final Consumer Response /* (2000, 21, 2014/04/28) */
Yes I agreed to the final agreement.I've already received the check
and today signed off on the small claims. Thank you for all the input.
