I have been retained by Frank's Diner to handle the above listed Complaint made by *** ***Below is my client's response to the complaint as narrated by *** *** the manager:
Mr*** came into Frank's Diner on Friday, August 7, at 8:05am (the diner opens at 8:00am)Prior to this date, Mr*** had not been in the diner for over a yearPrior to that it was over six months; Mr*** does not frequent our diner two times a month as he statedFurther, our diner has only been opened since As background information, I have regular customers who come into the diner nearly every day for breakfastTwo of those customers are Bob & *** *** who are currently in a custody battle for their grandson, ***Mr& Ms*** had custody up until about a month ago; right about the same time as this eventOn August 7th, Mr*** came into my diner while Mr& Ms*** were there with their grandson, ***Mr*** became verbally abusive, yelling at *** was noticeably upset and near tears with Mr***'s behaviorMr& Ms*** quickly removed *** from the dinerThere were other customers who came into the diner at this timeI decided to personally wait on Mr*** in hopes to calm him down and to prevent further disruption to my other customers
Mr*** ordered a bowl of gravy and a cup of coffee to goThen after *** left, Mr*** decided to dine in and added over medium eggs and goetta to his orderMr*** was sitting in the first booth next to a wall with his back to the kitchen areaI refilled Mr*** 's coffee and asked how his meal was and he responded, "Everything is wonderful...the gravy was outstanding." Mr*** finished his breakfast and gave him his check at 8:25amAll prices are clearly marked on his check Mr*** paid his check and left me a $tipWe do not give receipts unless requested; Mr*** did not request a receipt11611oReal Mr*** out the diner door and told him not to come back into Frank's Dineradvised him that screaming at any guest was not toleratedMr*** began to raise his voice and argue with me, but I cut him off and said that I have the right to refuse my services to anyone and am refusing himAs walked back into the Diner, Mr*** yells back, "Thanks for a wonderful breakfast! "
I thought that this would be the end of this situationThe same day, Mr*** filed a complaint with the State of Ohio Board of HealthThe inspector came into the diner on August 11, and found the complaint could not be confirmedThe inspector advised me that he was going to contact Mr*** to advise the sameThe inspector advised me that his supervisor was shocked about the complaint because Frank's Diner has been awarded the "Clean Kitchen" award for the past two yearsThe very next day, Mr*** filed the complaint with your agencyThe Revdex.com, alleging the same ActsMr*** complained about the egg scrambling machine not being cleaned; the diner had just opened and had not used the machine yet that day as no one had ordered scrambled eggsIt is cleaned every evening during closing and as needed throughout the day per Ohio Board of Health GuidelinesHis complaint is unfoundedAir*** complained about dirty carpetsAs per the inspection done on August 11, by the State of Ohio Board of Health, the carpets were not dirtyThis complaint is unfounded
Mr*** complained about his food being cold The gravy is made fresh every morning and we opened at 8:00am, the gravy was just madeMr*** came in at 8:05am and left at 8:25amMr*** did not ask for his gravy to be reheated nor did he make any comment about his breakfastMr*** was the fourth customer that day, after Mr& Ms*** and ***Mr*** never commented on his breakfast and left a $tip for his service; well above the 20% customary tipAll prices are clearly marked on the menuHis charges were as follows:

Total $Mr*** is an angry man because he and his wife are in a custody battle with one of my regular customersAfter Mr& Ms*** lost custody they have begun to harass anyone that is friends of Mr& Ms***I have learned that Mr& Ms*** have lodged several complaints against Mr& Ms*** at their companies; which are also unfoundedClearly, as evident in this narrative, my client has done nothing to violate any business practice or lawFrank's Diner will riot be refunding Mr***'s money nor will he be receiving an apologyMr*** did not have any problems with his meal or service at Frank's Diner until after he was told not to come back due to his own behaviorIt is my client's position that this is a continuing line of harassment by Mr& Ms*** and my client will pursue legal action if the harassment continuesIf you have any questions or need any additional information, please contact me at any timeSincerely,
