Please note, Ms. was not an employee of FrankCrum Staffing, Inc., but a leased employee by contract to FrankCrum 1, Inc., a professional employer organization. Clients contract with us and we process payroll in accordance with the hours which are reported by the client. We reported 2015 wages as earned under the Social Security Number and name the employee provided upon hire in 2014. The employee provided a copy of the Georgia driver's license and SSN at time of hire in 2014. She was transferred to another client in 2015 of which we have internal documentation. Client reported wages to us. Employee was paid by direct deposit in 2015 with checking account information she provided with a canceled check as proof of bank routing and account number. We reported this information timely to the employee in January 2016 on 2015 Form W-2 and mailed to the address of record. We have no record of the W-2 being returned as undelivered. She was again paid in 2016 to the same direct deposit again and the 2016 W-2 was mailed in January 2017. If she failed to report any of this income timely or feels she was incorrectly paid, she would need to contact the client because she received those funds according to our records. She was instructed by telephone in July 2019 that the only remedy would be to contact the client. FrankCrum 1, Inc. is contracted to pay as directed by its clients.

1. Frankcrum filed taxes as if I was there employee not under the Business that I work for which is illegal...

2. Yes, I've lived at the same address
XXXX - XXXX *** XXXXX... July 2015

2016-Frankcrum sent W2 to *** XXXXX.

So this is unacceptable...They knew where Iived and cause me unnecessary Hardship.

1) FrankCrum 1, Inc. is a professional employer organization (PEO). Your direct employer contracted with us and you became a leased employee by virtue of said contract. If you would like to contact us directly in writing, we are happy to provide you with the leased employee application which explained this and that we would file your W-2 under FrankCrum's Federal ID Number. You signed this leased employee application stating your understanding of this arrangement. There is nothing illegal about this relationship and there are laws in many states, including Georgia, which explicitly recognize and allow the PEO arrangement.

2) The 2016 W-2 and the 2015 W-2 have the Decatur address printed on them. This is the address they were mailed to initially. We have documentation that you contacted FrankCrum on 2/17/17 requesting an address change and a copy of the 2016 W-2 be mailed to the Ellenwood address, which you must have received given your rebuttal. We have no record of any W-2s for any year being returned as undeliverable for you. If you did not receive them, however, you could have contacted your direct employer or FrankCrum 1, Inc. directly and to have one reprinted and mailed to you. Further, you had access to our online portal to make address changes and reprint the document(s) at any time.

In closing, FrankCrum 1, Inc. has now explained to you why your wages were filed under our Federal ID Number as required by law and the contract signed by your direct employer with FrankCrum 1, Inc. Further, it is evident you received your W-2s from your rebuttal. we believe this response should satisfy your concerns and conclude this matter. We are happy to assist you further at any time, though. Please feel free to contact us directly.
