Review: On June **, 2013, I bought a pair of (allegedly) gold earrings from Frankel’s at[redacted], in Brooklyn. In the beginning of October 2013, my wife showed me that the earrings had started to disintegrate and that there were actual holes in both earrings.

On October **, 2013, I went back to Frankel’s and spoke with the store manager, Barry. I showed Barry the holes in my wife’s earrings, and I asked for a refund for the defective merchandise. Barry saw the holes in the earrings and said that the earrings were "poorly manufactured," but he was not responsible since he "didn't make the jewelry." He refused to give me a refund.

Frankel's sold me these earrings as 14K gold, and the price I paid is what 14K gold earrings would cost. These earrings turned out not to be gold, as gold does not disintegrate and develop holes in it. I will not accept a store credit, as I no longer trust the merchandise that Frankel’s carries. I do not want to give my business to a store that has already sold me defective merchandise.

I have photos of the defective earrings, if you would like to see them.Desired Settlement: The store was dishonest when they claimed the earrings were 14K gold. They sold me defective merchandise. They should not be permitted to profit from such dishonest business practices, and certainly not at my expense. I want a full refund in the same form as I originally paid, which was cash. I paid $160 plus tax, for a total of $174.20.

Response:

First of all the customer complained to the Department of consumer affairs and they closed out the case because we did nothing wrong. Second of all the customer states the earrings aren't gold because they're disintegrating. The customer is incorrect. They are not disintegrating, they just have tiny holes in them because they were Diamond-cut a little too deeply by the manufacturer and pierced the metal in a few places. This is a manufacturing defect. The customer was told that, but decided to change the story that the earrings are not gold in hopes of obtaining a refund in that way, even though the customer had no proof or any documentation stating that the earrings are not gold. Also, the earrings were estate(used or secondhand), which was boldly stated on his receipt and are sold as-is. We have reached an agreement with the customer and I now consider the matter closed. We have been in business for over 67 years and in all that ti me we have received just a few complaints. Our reputation for honesty and integrity is matched by no one. That is why we have received so few complaints over the years and are in business for so long.

Response:

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that the business's response is not accurate.

First of all, though the matter is now resolved, that is not because the Department of Consumer Affairs thought Frankel's "did nothing wrong," as the business states in their response. The DoCA resolved the case by mediating a full refund from Frankel's for the defective merchandise I had purchased from them. Secondly, the earrings are disintegrating. As you can see in the attached photo, there are large holes in both earrings that are not simply due to being Diamond-cut too deeply. If the holes had been caused by being "pierced" in the manufacturing process, then the holes would've been there when I purchased the earrings, which they were not. The holes, which are not at all "tiny," developed over the few months that my wife owned the earrings; the earrings began to open up, or disintegrate, over a very short period of time. 14K gold does not just spontaneously develop holes, which leads me to believe these earrings were not 14K gold as I was told they were. Thirdly, selling "estate" jewelry does not give a retail store the right to sell defective merchandise, or to misrepresent the composition of the merchandise, and as you can see on the attached receipt there is no statement that the jewelry was sold "as is." The earrings were intact without holes when I bought them, which should have been how they remained.

Though I strongly prefer to give my business to local, family-owned stores, I am disheartened by the treatment I received from Frankel's and would not shop there again.
