Mr. [redacted] has a service agreement thru Everdry which is due every year in the month of February. The due date is based upon the date that Mr. [redacted] signed off that the job was completed. Mr. [redacted] signed off completion on Feb. 16, 2015....

Mr. [redacted] is not obligated to renew the service agreement every year. A reminder service agreement invoice is sent out at the beginning of every month for those customers whose agreement fall within that month. A courtesy call is then placed to each customer who has not paid at the end of the month reminding them that the service agreement will expire at the end of the month. Mr. [redacted] did not send in his payment by the end of February, therefor his service agreement lapsed and was expired. Mr. [redacted] contacted the office in June requesting to pay his service agreement. There was a late fee of [redacted] per month added to the warranty to bring the service agreement current which brought the total to [redacted] Mr. [redacted] was not happy with the process of late charges that Everdry includes, but said he would send a check in for it. To this day Everdry has not received a payment for the service agreement at Mr. [redacted]'s property.

Mr. [redacted] contracted Everdry to do waterproofing on 1 outside wall of his home and rebuild a corner on a separate area of his home. Everdry scheduled this work to be done on March 23, 2015. After scheduling the work, Mr. [redacted] called...

our office with concerns about his rebuild and that part of his wall would be opened during the rebuild and would expose his house to the very cold temperatures that followed the winter months. Everdry and Mr. [redacted] made an agreement that we would perform the waterproofing on 1 wall on this date and would return when the weather was better for the rebuild. At this time, Everdry has only charged Mr. [redacted] for part of the contracted work, which Mr. [redacted] signed off on the completion of the waterproofing. During the waterproofing installation, Everdry found that Mr. [redacted]'s home did not have a footer, and to perform the remaining work, a footer must be added. Everdry was going to incur the costs for the footer, but had to subcontract this out because it is not work that Everdry typically performs. Due to the abnormal amount of rain we received during June and July, Everdry decided it was not in the best interest of Mr. [redacted]'s house, to remove the wall to perform the rebuild work. A representative from Everdry went to Mr. [redacted]'s home on July 2, 2015. The representative also met with the City of Decatur regarding the home, since there was no footer...Everdry wanted to gather all of the information needed and follow code by the city to have work performed properly. Everdry spoke with Roger [redacted] at the Decatur Building Department about this unique job and pulled the necessary permits to perform the work. Everdry has continuously made attempts to contact Mr. [redacted] in the past couple of months to schedule this work to be done, and to have a footer poured at Everdry's expense...however Mr. [redacted] has said he does not want Everdry back to his home to do the work.
Everdry is willing and able to perform the work that is needed for Mr. [redacted]'s home.

I do not accept this response. Primarily because it is so demonstrably false, it's an outright lie. First of all, they were scheduled to come in January and said they would have to shut my heat off for 2 days(temps in the teens) which was unacceptable. Thus, we rescheduled for March, they came and did less than half of the job and said they would do the rebuild in a few weeks. After 2 months of hearing nothing from them, a rep stops by the house in June and offers me a free inspection. I told him I already had a contract and that his company hasn't come by or called since March. The next morning I got a call from Everdry to schedule my free inspection. Finally I was able to get ahold of someone at everdry and they didn't even know what work had been pperformed yet. So in July they sent another inspector and I haven't heard from them since despite me calling numerous times, with one exception: at the end September I went to the Decatur Police Department to file a police report on Everdry. Officer Gerber called and shockingly, no one was there other than a secretary. I had no choice but to hire a lawyer. The day after I hired the lawyer, Everdry called to kind schedule a date, but not really. I entered into contract with Everdry on 10-1-2014, they ignored every attempt at contact by myself, wife, the Revdex.com, the Attorney General, and the Decatur Police Department. For them to not only claim to have attempted to contact me continuously (not once since July 2) but also to claim to be the victim is heinous. Phone records and timelines will easily show Everdry is lying, just look at their response date. They could at least have the balls to tell the truth.

[redacted] was installed by another Everdry franchise. Everdry of Northern Indiana has never been in contract with her nor did we...

collect any monies from her original install in 2002. Everdry of Northen Indiana began business in 2006 and did not acquire any assets from any other Everdry franchise or take over any previous Everdry business.
Everdry of Northern Indiana has provided Mrs. [redacted] with a no obligation service agreement for her waterproofing system. Our service agreement supports subsoil masonry seepage in any areas that have a complete waterproofing system.
After our service manager assessed the area that Mrs. [redacted] was concerned with, he found that there was no leakage in this area. Mrs. [redacted] would like Everdry of Northern Indiana to replace her wall. However we do not replace walls, nor would this fall under the guidelines of our service agreement coverage of "subsoil masonry seepage." The wall replacement is outside the scope of any work performed by Everdry of Northern Indiana. However Everdry could recommend a local rebuild company. We have set up an appointment for Thursday, December 17, 2015 with Mrs. [redacted] to explain this.

Everdry contacted Mr. [redacted] on 1/27/16 to set up a time for the owner and production manager to come to his house and address any issues he was having. The inspection was set up for 2/3/16, which happened to be a great day to inspect his...

system because this area just had a heavy rain the previous day/night on 2/2/16. When the owner and production manager arrived at Mr. [redacted]'s house they found his basement to be dry, the previous days rain had no effect on his house, which was proving that the system had worked. A few things they found was that the digital display was not working on Mr. [redacted]'s BBU, but was still functioning. Everdry is willing to replace the whole unit. Also the cracks that Mr. [redacted] was referring to are called stinging cracks, which are superficial cracks that just cosmetically need to be readjusted, due to the thickness of the concrete, the owner told Mr. [redacted] that we can cut out and repour the concrete in this area so it looks cosmetically better. Those were the findings of the inspection that took place, other than that the system seems to be functioning properly. After Everdry initially installed their system, one of the discharge pipes blew apart due to the amount of water that was flowing thru it, which caused Mr. [redacted] to get water in his basement, this was not due to faulty work. Everdry turned the information over to their insurance company, so Mr. [redacted] would be compensated for this incident. Everdry has spoke with Mr. [redacted] several times after this incident, and has followed up with their insurance company regarding this claim. Everdry's insurance has paid out an amount of money to Mr. [redacted] for the remediation and damages of this incident. Everdry's insurance company in no way, shape, or form asked Mr. [redacted] to pay a deducible to them. Everdry spoke to Mr. [redacted] on 2/9/16 to schedule these repairs and Mr. [redacted] said he does not want us to do the work. To this date Everdry is willing and able to perform this service work for Mr. [redacted].

The discharge pipes were installed by Everdry. The pipes separated from each other because they were inproperly installed, My basement flooded and it took Everdry 2 months to respond to this. During all these times I had the ordeal of contacting the people who can clean the basement of the wet carpet and repair the wall that ere contaminated with water. I spent 2 months trying to take care of all of these. Everdry does not consider this as faulty or something they are responsible for. When they visited the premises they found more mistakes in what they did. I said I don't you to touch my basement. I am demanding a refund because the main reason I had Everdy do the work was to avoid my flooding on my basement. 2 weeks after they did the job, my basement flooded. Enough said.

After Everdry assessed Mr. [redacted]'s property on 2/3/16 and found the few items that needed serviced...the production manager, Brian called Mr. [redacted] on 2/9/16, and then again on 2/12/16 and spoke to Mr. [redacted]. Brian told Mr. [redacted] that we would service his house on 3/4/16, which would only take a few hours. We would replace the bbu, rerun the discharge line, and repour the area that had stinging cracks. Also, Mr. [redacted] was offered $500 for any inconveniences he had. Mr. [redacted] refused to accept the schedule date Brian offered to him b/c he said he did not want Everdry to service the system, that he would do it himself and send Everdry the [redacted]. As of this day Everdry is still willing and ready to service Mr. [redacted]'s waterproofing system and make any necessary repairs. Mr. [redacted] is not willing to let Everdry service his home, which Mr. [redacted] entered into a service agreement with Everdry when the system was installed, if any future repairs needed to be done.

Mr. [redacted] our financing department took your call on Friday, April 6th to process a return of your deposit.  During this time, our office manager that authorizes outgoing checks was out of town on vacation.  Today, April, 9th the return began process and the refund will be sent back to...

although, Everdry will try to hand grade the area in which Everdry worked to help curb appeal even out. Everdry did perform a service on her discharge line. This is not a "completion" of the job, but a service for existing work. This service was completed, in fact since it came apart once, it was not only glued, but also Tile Taped in July. On September 3, 2015 Mrs. [redacted] called regarding her yard. Everdry scheduled her for 9/21/15 in which she later cancelled. Everdry is prepared to schedule again for 10/6/15 to perform service on her yard and discharge. The discharge may or may not be able to be buried due to the nature of the land surrounding Mrs. [redacted]. That will be determined and discussed with her at time of service.

Everdry is not sure whether there is miscommunication, or what might be happening. Everdry received a call from Mr. [redacted] on November 7, 2018 regarding leaking of his basement. Everdry scheduled an inspect of the area for November 30, 2018...

during that call. Multiple calls without a return call is confusing because he was scheduled and Everdry is not aware of any calls not returned. At any rate, the inspection did take place on November 30 and a diagnosis was understood. Water is coming in through a basement window. Everdry is a subsoil masonry leaking company and the window is not within the scope of the warranty, however, Everdry is going to resolve this leaking for Mr. [redacted]. This work to resolve the leaking is scheduled for January 16.

Upon further conversation in response to the interaction between our Production Manager in the customer and to better answer the specific complaint, there are three important areas to discuss. First, the porch is an attached porch to the home,...

closed in porch, this would be considered major construction. In being able to accomplish this concern it would require a construction company who is an expert in such work to complete. Additionally, the production manager does not believe this to be an area that would need to be accomplished based on the work that was completed at the house. Second, If in fact the pipe is on an upward slant we will do all that is necessary to fix that work. Based on the secondary inspect done by Brain, he does not believe that the pipe is on an uphill slant. One concern that was shared to Brain during the secondary inspection was around check valves, which Brain determined to be present in the home. There was not water or mud in the basement. Again, we will do what it takes to explain the job and if there are concerns or areas that need to be addressed we will address them. Third, we can have Brain and [redacted] come back out to the home, in making sure time is spent efficiently, we do ask that we are focused on fixing the solution versus the adversity that Brain faced in his time spent during the secondary inspection.

Not if it is October 1st. I was told September 1st. See how incompetent they are. Over six months and they still have not completed this job. Plus they will not send a representative to my house to talk with me after 3:00 pm. I've already had to take time off work. My employer is not going to want to give me more due to Everdry's incompetence. They certainly have not gained any references or recommendations from me, and justifiably. As long as I've been tore up around here and as unhappy as I've been you would think they would send someone to my home to talk with me after I get off work. But their people don't or rarely know what it is to work past 3:00 pm. I'm totally displeased with their workmanship and their untimely manner of completing a six day job. Which will be 7 months by the time they get to finally finishing my basement and then I seriously doubt it will be waterproof. They're simply that negligent, incompetent, and inept in operating as professionals. If this job is not done very soon, there will be action taken and most likely will if my basement leaks severely which it did 3 times majorly and 2 times minorly after their so called completion. If they knew what they were doing I could have been relaxing in the recliner after those heavy rains we had instead of battling water for over 100 hours total in those 5 heavy rains.
Since they worked on my place I now have blackish water coming into my sump pump pit. That never happened before. The water was always clear. I need to talk with someone. Like the big boss himself. He came once before and he can come again or at least send a man who knows what he's doing and talk to me about these last couple issues left to correct.

At this point, Everdry met with Mr. [redacted] and the basement was dry, although, Mr. [redacted] has a pump set up in which has nothing to do with Everdry and this pump's discharge is not functioning properly. Everdry told Mr. [redacted] that even though the pump is not ours, we will run a new discharge for him free of charge.

Everdry is sympathetic towards the leaking happening for the [redacted]'s. During initial installation, Everdry made every effort to install the Multi Step System with intent to stop all leakage. Unfortunately, the basement has been finished with...

drywall the entire time, therefore, finding all cracks had to be done from the outside. Cracks can sometimes pinch together creating an image displaying no crack. Everdry is going to stand behind the warranty and get a resolution. Waterproofing is not a one and done situation, that is why there is a service agreement. Most of the time, depending on the home and situation, Everdry tries to keep homeowner costs down by not having to move appliances, drywall, and other obstructions for waterproofing. Although, if that resolution can get accomplished, the Everdry contract states the homeowners obligation is to make the area bare and accessible for resolution. Everdry is scheduled to service the system and resolve issues on May 15, 2017. Also, after the last service, Everdry found what seems to be a cistern under ground next to the foundation. Everdry plans to excavate around the foundation to see this cistern and how it could be affecting the foundation. If in fact it is leaking and creating the source of moisture, the homeowners will want to find resolution to the cistern. Everdry has full intent to help resolve this issue at the [redacted] residence.

Going back to the original service, if Everdry had dug all the way down, all the way around, like they are supposed to, perhaps they would've seen the cracks that were missed the first time or two. If it was imperative that the drywall and/or framing be removed, it should've been requested then. I would say that after paying [redacted] + several un-paid days off of work, and making sure someone was at the house each time Everdry came out, any additional costs should be covered by Everdry. That includes the time and money it takes to remove and replace any drywall and/or framing, re-landscaping the yard and hooking up the a/c unit again. Since our house was built in the 60's, I doubt there is a cistern next to it. At this point, I would expect any further issues, including that, to be covered by Everdry. Everdry's system has failed time and time again, for over a year's time. I want a full refund, or, if service is to be done, it needs to be done in full, with no more cost to my family. I don't want us to have to spend any more of our time or hard earned money on this. We suffer from allergies, and without our a/c hooked up, (it can't be hooked back up until Everdry finally waterproofs our basement, so the ground doesn't have to be dug up again), we have been miserable, needing to open the windows to try to keep the house cool. Concessions need to be made by Everdry. Bottom-line. If they want to fix it right, beginning on the 15th, that's fine. They will need to come out and prep it, and then put things back where they belong, or pay to have them put back. Again, using the car analogy, if you purchased a new car that would not stop leaking after a year, you would expect a replacement car, or your money back. We expected to get what we paid for...a dry basement...a year ago, and it's still leaking. Everyone should agree that this is unacceptable! Everdry needs to make this right!

performed our 20 point inspection on 07/14/2017. During which we understand that there is a substantial amount of information that we address during this process. It is for that reason we ask each customer we work with to have all parties involved in the process. In regards to sharing credit information over the phone, as a part of clearly educating our customers we find it very valuable to read through the financial agreement in person to address any and all concerns. The cancellation form was post marked by the post office on 07/25/2017 and was received after that date. At that point we make every attempt to contact the customer to inform them that we will discuss the cancellation in person. Today 8/09/2017 we were given permission to have our inspectors return to the home to discuss the paperwork as well as cancellation.
