My car was towed Monday March 10th. I called my lender and the [redacted] police, but no one could tell me where my [redacted] was. I called every day there after, but no one had any idea. The Frankies had hauled my car off and never called it in. In the meantime, I was without a vehicle. After two weekes, I called and the lender was still unsure. They told me [redacted] had it (these are the auctioneers). I called them, no answer. it was now noon Friday March 21st.Monday March 25th, my lender said [redacted] had it. [redacted] from [redacted] said the tow company had not called it in to lender or her... that she would try to find out where my car was. 28 calls to my lender, 13 calls to [redacted] and still nothing. Tuesday, I did not call [redacted] as they are too busy and clainmed they would call me. No one called.Wed March 26th...5 calls to my lender and they finally were able to track down my car. Again, Frankies had never called it in according to 3 of the customer service people at loan mart. [redacted] was waiting for the car, but they never got a call back from [redacted] was give [redacted] I called it 49 times throughout the day. It seems very shady. The anser message says... "this phone does not have voicemail set up" Then it hangs up on me. It has nothing on it to even let you thinnk its a business...very shady.So, I have been with out my vehichle 3 weeks. I paid my lender weeks ago but no one knows what Frankies is up to.I want my car back. Its a 2001 [redacted] in immaculate condition and low miles! Did "Frankies" not report it so they can drive it around? Is it at a chop shop? Who will pay my days without a vehicle?I will be retaining an attorney and filing a police report as well as a civil complaint.Account_Number: Licence plate [redacted]Desired SettlementI can't tell you want I need when my car is in Frankies possession. He has kept it and has not released to me. So what I want depends on where my car is.... Does he want to pay for a car rental? for my friends gasoline? for the value of the vehicle on a daily basis that I don't have it. It will depend on what my attorneys decide.Business Response This customer's unit was repossessed on 3/10/2014 @ [redacted], Tn and was immediately reported to the[redacted] Police Department's [redacted] Division where we are suppose to notify within 1 hour that the unit has been repossessed and for whom and this was done and the case number that goes to this repossession is [redacted] and was reported to [redacted] @ 3:30pm on 3/10/14. Also, at the same time this was input into the main computer system which is tied to our Forwarder that issued us the repossession on behalf of the lender[redacted] and notified both of them that this unit had been repossessed by our company and the location as to where this unit would be stored at until notified of the disposition of this unit and this is where this unit was stored until we released the unit back to the Debtor as a Debtor Redemption. On 3/26/2014 we received notice around 2:38pm that the customer was going to be redeeming their unit back. On 3/26/2014 at around 5:30 to 6:00pm I received a couple of calls from the lender and the debtor about redeeming this unit. On the morning of 3/27/2014 I myself ( [redacted]) did make contact with the lender and the debtor and made the arrangements to get the unit back to the debtor that afternoon. We had some issues in who was going to pay the fees of which the debtor paid part and the lender paid the other part of the storage fees on this unit. At the time the debtor came to pick her unit up she went into great detail about her getting the run around from her lender and that she had a different number for me which is not the correct number for debtor's to reach me at and I apologized for them giving her the wrong number to reach and when I had made contact earlier in the morning I gave her the correct and number and apologized at that time as well.None of our units that are repossessed are driven at all. Once they are repossessed they are stored at our secured storage facility and not moved until we are to release them either to the auction or debtor of which we are instructed to do so by the lender. I can't respond to the auctions situation I can only speak about [redacted]'s Towing and only myself. I have paper work to show that the release did not come over until 3/26/14 in the middle of the afternoon and we did get it released back to the debtor on 3/27/2014. I have also looked at my phone records of my personal number that was given out to the debtor and there was not 49 calls made to my number. However, the minute that we did get a call from the debtor on 3/26/14 we did return her call and got her unit released the next day. All of this in a nut shell is this. The lender itself knew the day it was repossessed that we were the ones that repossessed this unit for them and where it was being stored at and knew how to make contact with me. So, how they handled this with there customer and what they told her I can't answer that but they did know whom repossessed it and where to get in touch with us from the day it was repossessed. I can only release a unit to whom the lender authorizes me to do so and when they say so and until that point I am responsible for keeping this unit secure and that's what we did. When the debtor came to redeem her unit she was allowed to Inspect her vehicle and personal property to make sure it was all there and in the same condition as when it was picked up and she agreed to this and signed the redemption forms agreeing to that. I do have the paper work showing all of this if I need to provide this paper work then please advise me and I will submit all of it. I am sorry for this customer's situation however the fault does not lie with [redacted]'s Towing and Recovery in any way at all. Thanks, [redacted]
