*** ***,
Regarding your e-mail of 9/23/2014, if what you say is true
about your expectations and our conversations, we are truly sorryThere is no
excuse nor any acceptable explanation we can giveThe timeline for your yard
was as follows: weeds were sprayed on 6/30/2014, reapplied
on 7/16/due to
rain following the first application, and again on 8/20/The yard was
aerated and over seeded on 9/18/
Our estimate dated 4/2/stated that your yard was to
receive a weed killer application in April/June and in June/July with aeration,
over seeding, and topdressing in the fallOn 9/18/2014, you complained about
the aeration and over seeding before we had an opportunity to finish the job
Unfortunately, you never gave the selective herbicides or
seeding a chanceAs we verbally explained several times, chemical applications
take 3-weeks to show results and seeding 2-weeksWe timed the applications
for maximum benefitSince we had not received payment and appeared to be
unable to please you, we decided to eliminate our loss by not spending any more
time or money topdressing your yard
The cost for the level of service you are now claiming would
be significantly higherSimilar sized jobs with the level of service you
expect would cost almost double what we were chargingYour phone calls began
when the first weeds popped up in the spring and continued every time you saw
any new weedsYou obviously expected complete weed eradication in two
treatmentsUnfortunately, results are specific to each yardIt should be
noted, that when we suggested an additional application to kill the weeds for
$you declined
We regret the dissatisfactionWe should have terminated our
agreement in the early spring when it was becoming obvious that the time
restraints under which our service has to work would never meet your
expectationsNotwithstanding our belief that we did what we agreed to do,
there is no charge for the aeration and over seeding
As to the mowing, we apologizeTimely bi-weekly service for
your yard was not up to our standards this yearOur records show an unusual
late start date of 5/21/and a four week gap [7/30/to 8/20/2014] in service

Review: To Frank N[redacted] and Romilio M[redacted]:

In April 2014, you submitted and we accepted a proposal for a new lawn at the front of the house. As we walked the property and discussed what needed to be done I made it crystal clear that my major concern was not the cost, but the end result. Mr. M[redacted] and I stood there together in front of the house and I said—and he agreed—that we needed a new lawn. I said I wanted it to be leveled out so the ruts were gone and I wanted it edged so there was a neat demarcation between the lawn and the mulched beds. I also told him that I would be gone for most of the summer and would return on August 26. You said this would be an ideal time to seed.

The first step in the process was to kill the broad-leaved weeds in the spring. I assumed the point of this was to stop the numerous dandelions and violets from producing a new generation. When they were in full bloom and nothing had been done I contacted you in writing about my concerns. I received a reply back from Mr. N[redacted] assuring me that the violets would be killed when the weeds were finally sprayed. The spraying eventually took place after both the violets and the dandelions had produced their seeds. Furthermore, less than one hour after you sprayed the lawn there was a heavy rain that completely drenched the lawn. The notice you had left us after you sprayed made it clear that the lawn was NOT to be watered for a day after the application of the weed killer. I immediately wrote to you and told you about the rain. You wrote back apparently unconcerned, seeming to think it would work anyway, but saying that if it did not work after two weeks to let you know and you would respray.

It did NOT work. I did tell you this. The lawn was never resprayed. By the way, did you ever take the soil sample, as specified in the contract? If so, we heard nothing about it.

Meanwhile, you were failing to cut our remaining back-yard grass with any regularity. Weeks would go by and repeated messages were ignored. It was only when we spoke directly to a very apologetic woman who answered the phone that anything got done. As I write this it has been four weeks or so since our grass was cut. Again I have written and left phone messages. Again we have been ignored.

On August 18, while I was overseas, Mr. M[redacted] sent the following message:

" Hi,

I just wanted to let you know that we will be spraying the front lawn this week. This application will kill all the existing grass, after the treatment we may need to respray in a couple weeks. Once we have successfully killed all the existing grass, we will perform the overseeding and topdressing."

I was very surprised to hear that you had not yet got around to killing the existing vegetation until this late in August. I was even more astonished that you thought it possible you would have to spray again in early September. There was no explanation or apology for the schedule change. I was worried about this because we have several large tulip poplars that lose their leaves early. When I returned to the United States on August 26 it was to see that the lawn was nowhere near dead and was also full of weeds. On August 28 I wrote to tell you this, thereby confirming that you would indeed need to respray in a couple of weeks. Once again I received no reply and once again no respraying was done.

A full three weeks later, still having heard nothing from you—and still waiting for the grass in the back yard to be cut—we came home to discover that you had aerated and over-seeded the still-rutted, still weed-ridden lawn. There had been no discussion of leveling or new top soil, as specified in the contract. We had no advance notice of this work; you simply left a notice on our door telling us to water the seeds. What if we had been out of town?

Because there had been no leveling, no proper killing of weeds, or other proper preparation for seeding, the result was a mess. I sent you 10 photographs so you could see for yourself.

I have told you that your work so far has been completely unacceptable. I have done so by written message, voicemail, and by speaking to Mr. N[redacted] on the phone five days ago, September 18. He said he would contact me soon, but I have heard nothing. We have waited long enough.

Given your performance on this project so far, we do not expect you to do a job that we will find acceptable. We will find a different lawn service to complete this job and to mow our lawn in the future. Please do not send us a bill for the seeding; we will not pay for this shoddy work.

Sincerely yours,

[redacted]Desired Settlement: Apology and EXPLANATION for appalling service.
