At the end of October, I was informed by [redacted] , owner/instructor, that I had lessons left on the prior contract and it was time to move on to the next level [redacted] is not a franchisee, he is the studio [redacted] I am the only franchisee/ ownerMs [redacted] had cancellations under hours, these lessons are typically charged and not honoredBut as an act of kindness to her- Mr [redacted] , her instructor, asked my permission to still honor these private lessons and I allowed itHowever, these lesson would now count as bonus private lessonsI signed contract #with the studio on 11/1/( [redacted] did not provide a copy of the contract, only a copy of of the American Express payment.) This is accurate, the student purchased Private Lessons and Coaching sessionFor paying her tuition in full, Mr [redacted] gave her Bonus Private LessonsTo save paper, all students are asked if they would like to keep a paper copy of their enrollment at the time of purchaseIf student turns it down, we keep a paper copy here and inform them, if they ever need it, we have it on file for themOn 11/12/17, I sent a letter to the studio requesting a refund of the total contract $ [redacted] This Refund request letter from [redacted] was received at our studio on November 16, Ms [redacted] does not qualify for a full refundI had not returned to the studio after signing contract #so I had not started using the classes for this contract Correct, the student had not been in for Private SessionsHowever, she did cancel again under hours on November 7, at 6:30pm and she was charged that timeIn addition, it is written in our Lesson Tuition Agreement ( Paragraph #5) Student agrees that, in consideration of the Studio’s ongoing overhead expense and the full time employment of trained dance teachers to deliver the dance lessons contracted for within the specified term, the private dance lessons will be charged against Student’s untaught lesson balance as used with a minimum charge computed on the basis of the monthly average of Student’s frequency of attending lessons or four hours per month, whichever is greater Class dance lessons, student group practice parties, and video study sessions, will each be charged off proportionately to private dance lessonsPlease note, that we did not actually do any charge off lessons, we simply will not refund lessons that have no cash valueThe total amount minus a service fee ($+ 5% of value if over $1000.00) must be refunded Once again, this is not the caseit was explained to [redacted] on the phone and via the refund release letter how our refunds are calculatedAttached you will find a copy of the Conditions & Definitions listed on the back of Ms***'s sign Lesson Tuition AgreementPlus when she requested refund, all her lessons she cancelled under hours were chargedLessons cancelled under hours do not qualify for refundIn their response to my letter requesting a refund, they have deducted $for bonus lessons that have no value and were not mentioned as available when I signed contract #Ms [redacted] accumulated multiple bonus lessons through her time at our studioUnfortunately, Ms [redacted] is mistaken when saying Bonus Lessons - he offered to pay her the full refund out of his pay because he feels awful that Ms [redacted] feels betrayed by him, but I denied this requestMs [redacted] informed me her complaints were Ms [redacted] claimed [redacted] lied because she asked him if we take American Express and he told her no, but then at a later date we accepted American ExpressShe claimed that because of this she felt he was in-genuineHowever, she was unaware that Mr [redacted] was actually trying to help her out because he went to his office and called me to asked permission for this to happenOnce I agreed to take Amex, he informed her he could now accept her preferred method of paymentMs [redacted] also said she just felt [redacted] was in-genuine and promised a lot of things that he could not back up [redacted] has a proven track record of achieving goals he sets with with students and has always surpassed everyone's expectationsNow, we know not every personality clicks or meshes wellwhich is why we offer the buddy system that offers each student to work with multiple instructorsWe also have students grade all their lessons; Ms [redacted] never once complained about anything until after requesting her refund and finding out she did not qualify for a full refundAt this point, I have not alerted social media or Channel of their "scam" We are not a scam and have been in this industry for a combined total of years and never experienced someone with such dishonestyWe are transparent and have nothing to hideWe truly believe that dancing spreads joy and betters everyone's lifeThis is our mission, you do not get in to this industry and pursue it as a career for moneyyou do it because you like helping people and enriching peoples lives through the many benefits dance offersMs [redacted] should be ashamed of her slanderous remarks toward a teacher that went to bat for her multiple times and continuously tries to do the right thing for herI am giving them a change to right the incorrect calculation of the monies owed to me and to make sue their other students don't continue to pay for new contracts when they have bonus lessons dueStudents move on to their next level when they are ready, not depending on how many lessons they have remaining on their current levelWe don't hold anyone back, if their teachers think they are ready for more advanced material, and the student and management agree, they move onIt's very simpleWe charge bonus lessons off on a daily basisit just depend on each individual studentThe private lessons Ms [redacted] had remaining on November prior to her Preliminary Bronze enrollment, were in fact all bonus lessonsHas she decided to wait until she has private lessons remaining, then they would have been charged offbut she made the decision to continue on by purchasing a special we were running that day Ms***'s refund, that she qualified for will be refunded to her within the days of her requestThanks for your time, [redacted] Studio Director [redacted]
