I am unable to send any documents regarding this complaint as when the company towed my vehicle all official documents were in the glove compartment and I was refused entry to the car.  I called the police whom referred me to civil court. On December 17th, 2016, this customer came to our dealership to purchase a vehicle. She filled out an application and the information on that application turned out to be fraudulent regarding her residence and employment status. We delivered the vehicle in good faith but when we tried to reach her at home and work for collection purposes, we came to find out that she was already evicted from the address she used on her application and also did not work at the place she stated she did.So we had to begin looking for her with the help of some repossession companies to no avail. Finally after about two months one of her own family members gave us the information about where to find her. Thankfully that information was correct and we were able to retrieve our vehicle after two months from Maryland. In two months the vehicle had been driven [redacted] miles and we had not received a dime in payments. The vehicle had been removed from Virginia without lien holder’s consent and the lien holder was not even informed of the new location of the vehicle. Under Virginia law section 18.2-115, this action constitutes larceny. After the repossession the lien holder can demand the entire balance of the loan and in this case that right was exercised by us as the lien holder of the property.Repossession of the vehicle due to customer’s non-payment does not entitle the customer to ask for the refund of down payment nor have it removed from the credit bureau. If there is any further information needed by your office, please let us know and we will assist you in taking care of this complaint.sincerely,n g[redacted]Fredericksburg Public Auto Auction[redacted] **.[redacted], VA [redacted]ph: [redacted]http://www.FredericksburgPublicAutoAuction.net

Review: As the Revdex.com is aware I purchased a vehicle from this dealership October 2012 and the vehicle had been to the dealership on several occasions and also other mechanic shops to be fixed. On December 29, 2012 I finally took the vehicle to JT Automotive on [redacted] to [redacted] and he stated that the vehicle had a blow head gasket and according to how bad it was it had to been blown when I got the car. On December 31, 2013 the car wouldn't start again so [redacted] had my car towed to his shop at this point on January 1, 2013 I called Frederikcsburg Public Auto Auction telling them that I was voluntarily returning the car because they wouldn't fix it, they told me that they were going to get it. But they waited 2 weeks before the first attempt on picking it up and the shop had attached fees because the car was sitting the dealership didn't wait to pay the fees at this point so it sat a little longer. They finally did a repossession order and picked up the vehicle and paid the fees but the order wasn't necessary because the shop just wanted their money. Well instead of [redacted] at Fredericksburg Public Auto Auction putting it on my credit as a voluntary repossession he put it on as a involuntary repossession. I called him on June 26, 2013 and he said, "Oh no, [redacted] it is suppose to say Voluntary Repossession, don't worry I will get this taken care of". But he has not I believe he was just trying to get me off the phone. This involuntary repossession on my credit is hindering me from getting another vehicle.Desired Settlement: I just want the Involuntary Repossession on my credit report changed to a Voluntary Repossesion

Response:

After speaking with [redacted] from the company on 9/9/13 he stated the customer purchased the car As Is no warranty. Customer drove the car over 20,000 miles before the car boke down. The customer took the car to a mechanic shop and abandoned the car. The company paid to have the car released back to the shop. A Voluntary action is when the customer brings the car back to the shop they purchased the vehicle from.
