I signed service agreement with Freedom Immigration (FI) on 1/16,2019. Agreement says they prepare and file form I-140 immigration petition and I-485. I paid by check payable to FI $14000 totally till now.
But it hasn't reached the step of I-140 nor I-485, on the step of PERM application FI filed before filing I-140, we got a denial letter on 6/ 15,2020, but the reason is FI posted position advertisement late, which should be made before 8/27,2019, they made it on 9/8,2019.It's their fault of the delay for the denial. And I asked them for solution to get to next step. Only PERM problem solves, we can get to next step of file I-140 as in agreement. The office kicked me back and forth without any solution, and asked me to pay all money again to restart the case, although they used to tell me they'll serve me until I -140 and I-485 was filed successfully.
Due to their fault, they wasted me 1.5 years from the beginning of the case, and collected me $14000 totally. But I got nothing. I asked for a refund, they refused. I'd like to explain more exactly about the whole thing, I think their behavior is a fraud and cheating.
The first step they did is applying for the Prevailing Wage Determination (PWD). FI filed this application, on the form of application, it marks a validity period from 5/29/2019 to 8/27/2019, which means this PWD will be invalid after 8/27/2019. FI filed the form and should know about this as a professional immigration company.
The second step is posting position advertisement based on PWD. Without a valid PWD, the advertisement will be invalid. FI started the advertisement until 9/8/2019. This is an invalid advertisement.
FI make an excuse the delay reason is the government asked for more information. We never know when FI started to work, although they promised to start working in June.
The government asked for information on 8/1/2019. FI came back to us for information until 8/9/2019. I provided all the information needed by 8/22/2019. I asked about the deadline date of submitting information, this can be as a remind of expiration date even if FI forgot it. FI didn't reply about the deadline. But FI still said they will submit them in September. FI should know about the expiration date of 8/27/2019, late submission will cause invalid advertisement, FI still did a late submission, we can see it is an intentional behavior. So FI got approval in September, and started advertisement in September. On this step, fault can be fixed. What FI should do is, stop posting the advertisement, because it is already late and invalid. FI should stop and restart the PWD. But FI didn't fix the fault. The advertisement wasted of money and around 4 months? time.
After the advertisement, FI came to the third step. FI asked for my payment again. They filed the Permanent Employment Certification (PERM). On this form FI filled in, they wrote the expiration date 8/27/2019, and date of first advertisement 9/8/2019. When FI filled in this form in person, it can be as another remind, the advertisement date is already invalid. FI should already know the PERM will be denied. They insisted submitting. It wasted me another 6 months time and money. Even if they forgot about expiration date during advertisement, at this moment, when FI filled the form in person, FI even should stop the PERM to save time and money and restart from the beginning. This is another intentional behavior in order to collect more money.
When we got the denial, FI asked us to pay once again to restart the case, and even asked me to invest on EB5. At the beginning of the talking about contract, FI used to tell me they can restart the case without payment in case of any denial.
From above points, we can see FI meaned to continue mistake, which caused the denial, so that they can collect more money for the case. It is a fraud and cheating behavior.
I have all evidence. $14000 is really a big amount for this poor service. I got nothing but lose $14000 and 1.5 year's time. And we really appreciated your help to have the amount refunded to me.

A brief explanation below for better understanding:
1. PWD valid before 8/27/2019, next step should post advertisement valid before 8/27/2019
2. Wrong process:
FI posted advertisement 9/8/2019 -- invalid advertisement
Correct process:
Stop advertisement, and re-file PWD if the advertisement was late
3. PERM form FI filled in indicated PWD valid before 8/27/2019, but advertisement posting on 9/8/2019 ----- obvious mistake will cause PERM deny
Wrong process:
FI continue to submitted the PERM, which will be denied
Correct process:
Stop submitting PERM, and re-file PWD
4. After the denial, FI asked me to pay once again and restart the case, or invest in EB5.
5. So I think FI's behavior is intentional and cheating, in order to collect more money.

Desired Outcome

Refund I hope to get my payment $14000 back.

We (Freedom Immigration "FI") have reviewed many of the communications that we have between us and you, as well as with the State of Florida. We will provide you with an overview of those.

1. On or about August 9, 2019; we communicated with you indicating that the government is concerned that the business is not real and why they believed this;

2. On or about August 9, 2019; August 14, 2019 you responded to us with information to attempt to clear, but information was missing.

3. In between August 9, 2019 and August 14, 2019; we responded to you that it could be an issue. During these communications we informed you that we still needed information of the real and active business to provide to the State of Florida.

4. On or about August 17, 2019; you informed us that the website was still pending creation and as soon as it was working you would send it to us so we can provide it to the government.

5. On or about August 21, 2019; you provided us the website for your business.

6. On or about August 22, 2019; to ensure that there were no additional situations that may arise, FI called the phone number on the website to make sure all was working right in the business since it was already creating doubts with the State of Florida. The phone number did not work, and we informed you. You responded back and informed us that you would not be able to fix this problem until you returned from overseas, on September 1, 2019.

7. During these dates FI, had several conversations with the State of Florida to get your employment advertising account activated.

8. On or about September 11, 2019; the State of Florida activated your account.

We are sad that you weren't able to receive the objective of your goals; however it is because of the State of Florida and their research into the validity of the business that delayed the process. Also during the days of September 1, 2019 through September 3, 2019; Hurricane Dorian was affecting the surrounding areas of Florida and this may have affected the efficiency of the State of Florida in providing your business the ability to advertise employment opportunities.

According to your reply, you just make excuse the reason of your delay of advertisement. But you never reply to my points. And the reason of your delay is not right. I'll attach our communication timeline to show it's FI's fault on the delay.
My point:
1. You know the advertising is already late on September, which will be as and invalid advertisement. Why don't stop it and start it over from PWD?

2. Why you never tell me anything about the expiration date, and the late advertisement? You continued to tell me everything is good and just asked me to pay. But the problem had been there in last September.

3. Why do you still continue with PERM with an invalid advertisement date on the form, which is obviously a denial result on PERM? You never mentioned about it, and continued to say everything is good and ask me for payment.

4. Why do you ask for me to pay extra again after your fault work to continue the contract?

According to your explanation of delay, I attach our communication timeline as follows to show the delay is caused by your fault.

On August 1, the government sent him email. You came back to me until August 9. There are 8 days delay here. Please see timeline here during our communication.

June 72019 FI told me PWD was approved, and asked me to pay another $5000 for starting next step of recruitment, posting advertisement.
June 15, 2019 I sent e-check to Freedom Immigration
June 25, 2019 You confirmed with me of receipt the check., and told me he will start advertisement.
July 23, 2019 I asked about the process, but got no reply about that. (Here I wonder if he already started working on my case, need to prove you didn't delay over one month's time.)
August 8, 2019 I asked about the process again
August 9, 2019 I got reply from FI. You said the LLC address shows a yard on google, and asked for explaination. FI received message from government on Aug 1, he came back to me until August 9 after my asking. Here showed he delayed 9 days.
August 10, 2019 Google is not correct, I attached the houses information, titles etc. The houses have been completed. (Here I attached details in time on what he needs to show the house is there.)
August 14, 2019 FI asked me further questions.
August 14, 2019 I answered to him, and sent him the utilities bills, electric bills, spectrum bills etc.
August 18, 2019 I asked FI the deadline of information, so that I can see if I can provide with more information. FI didn't reply to me about the deadline. (But the deadline should be on Aug 27, FI never talked about that, and never follow the deadline. We cannot see professional on the neglect of deadline. )
August 21, 2019 I sent the website information
August 22, 2019 I sent him bank statement. I have submitted all information he needed by Aug 22.
August 25, 2019 FI said he will submit until meeting with me in September. (Why he didn't consider date of deadline August 27. PWD will be expire on August 27. Posting advertisement will be not in effect.)

1. The last time you asked me for information was on August 18. And I offered all information you needed by August 22, including the website. I offered all information on time before August 27. In the email when you asked for more information on August 18, you said, "Your case has a little bump in the road, however, it shouldn't be too difficult." And you never say website or anything is a must, just need evidence to show business is actively working...
2. There had been some problems with my phone number during those days, and I'm unable to fix it until September when I was back to the US. But you never told me it is a must to get the number work right now, otherwise it will affect the active of advertisement. You never told me there is a deadline of the advertisement, although I used to ask for the deadline information. I paid huge amount for your service, you are professional, I don't know the exact details, and it should be your duty to tell me about this. If I was told the phone is a problem for the deadline and it is in hurry, I can change another number on the website.
My opinion:
1. The late posting advertisement is FI's fault.
2. FI continued the fault with INVALID advertisement and perm in order collect money from me.It's a fraud behavior.
3. It is a fraud behavior that FI refused to continue the lease and asked me to pay again.

We have done everything possible to resolve this matter with Mrs.. Our position is that we have sufficient evidence to prove that the outcome of Mrs. immigration case was not of our wrong doing. We have been trying to help Mrs. for the past couple of weeks to try to resolve this matter in a professional manner. In her latest communication with us, she stated that she has decided to take legal action against us. Because of this our legal advisor has prohibited us from any further communication with Mrs.. We did not want this case to get to this point, but as suggested by our legal team any future communication between us has to be done via attorneys.

FI never helped with me in any way, they are no professional at all. As they said, can they list what they helped me with after the denial? They even gave me an obviously wrong password intentionally of my account.They just pushed me back and forth like a ball. I asked them those questions weeks ago, they never answered to me why they still continue to collect money and proceed the wrong steps after the fault. Now they push it to the legal team don't want them to say. How ridiculous! I didn't take any legal actions.
