Ms. [redacted] purchased a 2007 Audi Q7 with 155,479 miles. Because the vehicle has over 150,000 miles we could not offer a warranty...

thus we sold the vehicle to her as-is. As Ms. [redacted] acknowledged in buyers guide, she was aware that major defects may occur in used vehicles with such high mileage. At the time she bought the vehicle there was nothing apparent that would indicate the vehicle was not in working order. She took the vehicle on a test drive and was happy with the ride. We do not know or have no way to know what happened between the time the vehicle left our lot and the time Ms. [redacted] brought the vehicle back for repair. We have been more than generous from a customer service stand point to assist Ms. [redacted] with repairs. We replaced the motor on the Vehicle and paid for her rental car during that time. Ms. [redacted] subsequently brought the Audi back with a transmission problem, we took the vehicle to a transmission mechanic and it was explained to us it was likely the vehicle was forced into gear thus causing damage to the transmission. Freeway Auto cannot and will not be responsible for user error. Generally, a 9 year old vehicle with 155,000 miles will need to be maintained more than the newer less driven vehicle and Ms. [redacted] has assumed that risk when she knowingly bought the vehicle as-is. We have gone over and above our obligations in the contract because we like to keep our customers happy. However we have no obligation to repair or pay for anything or any additional damages Ms. [redacted] claims as the Vehicle was sold to her as-is.
As Ms. [redacted] has now sued us in State Court our position will be as it has always been. She bought the car as-is. It is her responsibility to maintain her vehicle and Freeway Auto Center will offer nothing else in that regard.
