First, I would like to address the first statement about it being impossible to get documentation from our office and that when they did receive the documents, they were incorrectI have one email received from *** *** POA for *** ***on 12/stating they had an issue that the “when
recorded return to” portion of our recordable document had our addressI explained to her that we put that on the document so that we receive the recorded documents back from closing and are able to prepare the owners policy, per the terms of the contract. I also explained that once we had both of the recorded documents in our office and the owners policy prepared, we would mail them to the buyer at the address provided prior to or at closing.Second, I would like to address the complaint that no documents were provided at closing provided to the buyers. This was never brought to our attention and per our notary closer, copies were provided at the time of closing, per my request. I didn’t find out until 12/that the buyer didn’t have copies of the documents and we sent them via email at that time, per the request of *** *** POA for *** ***.Finally, I would like to address the recording of the documents. The buyer states that, by law, the documents are to be recorded within days of closing, and that as of the date of the complaint the buyer still did not have them. It is our practice to submit documents for recording within hours of closing, but we are then at the mercy of the recorder’s office to review, and either record or reject a document. In many counties, including this one, the recorder’s office can get behind in either recording the documents, or getting them back to us if they are rejected for some reason, so that we can address the issue. As of 1/the documents were not recorded and I emailed *** *** *** *** and *** *** (all of my contacts for the buyer prior to closing) to advise that I had left numerous message for *** *** on 1/15, 1/20, and 1/22. I needed Mr*** to provide a physical address after receiving a recording rejection from the county on 1/(I was out of the office on the 13th and 14th or I would have addressed it sooner)Then on 1/27, after still not receiving a response, I sent an email to obtain the address for purposes of getting the document recorded. That is when I learned that we were either given the incorrect phone number for *** *** or we transposed a number when writing down the information*** *** disagreed with me on why the documents were rejected by the county, so we provided her with the written rejection letter from the county. She continued to disagree and was unwilling to provide the physical address needed for recording. During the process of emailing back and forth with *** ***, *** *** POA for *** ***, provided us with a physical address, we corrected the documents and sent back via *** overnight delivery to the county for recording on 1/28. At that time, I provided *** *** with the tracking number for the documents being sent back to the county. All documents, including Power of Attorney, Special Warranty Deed and Stipulation, recorded on 1/and have since been returned to *** *** at PO Box *** *** *** WI *** * ***Escrow OfficerFreibert & Mattingly Title Group, LLC*** *** *** *** *** ***
