At the request of *** ***, I am writing to you concerning the complaint of *** ** ***French Lick Springs Villas Owners’ Association, Incis the Indiana non-profit corporation comprised of all the owners of villas in the French Lick Springs Villas DevelopmentIt did not sell the
timeshare unitThat sale was by French Lick Springs Villas, Inc., the now defunct for profit corporation which originally developed French Lick Villas as timeshares. The French Lick Springs Villas Owners’ Association, Incis an entity which makes certain that the development is kept up to date, pays its taxes, keeps its common areas and the buildings themselves and contents up to dateAn annual maintenance fee is charged to all owners to maintain the project.French Lick Springs Villas Owners’ Association, Incis regulated by its covenants and restrictions and by-lawsEach of the members, including *** ** ***, votes for a Board of Directors which actually operates the association.The Owners’ Association does have a divesture program to allow those owners to no longer have to pay maintenance feesIn order to participate, *** ** *** must be current in his maintenance fees, not have his week banked with one of the trading organizations, and pay a fee to the association for so doingThe fee is $1,for a red week and $2,for a white or blue weekIn addition, Mr*** would be required to pay the cost to an attorney of his choice to do the documents transferring the unit by deed to the Owners’ Association.If Mr*** is interested in the divesture program, please have him contact meThe Owners’ Association cannot settle for anything other than what is required by the divesture programIt did not sell the week to *** ** ***, nor did it ever represent anything at all to him.With best regards, I am,Yours very truly,*** ***

IN REGARDS TO COMPLAINT #***
The owner Ms *** received her statement in early Octoberand in the fall newsletter it says it must be in this office on or before January of each year It also states on the acknowledge form that she signed that she understands it is due and
payable on January 1, of each year Our business is closed on New Year’s Day as is most businesses in our areaShe had her bill for approximately month and a lot of the owners had theirs paid before the due date. Credit card companies are not open on major holidays eitherThe late fee cannot be waived per my Board of Directors%

This is a timeshare property and I don't doubt that this person was told that his week 31 red time would get him anywhere he wanted to go. We had several sales people that told prospective buyers anything to sell a unit in the sales department. The owners association had nothing to do with the...

selling of weeks.
However the exchange companies also change their way of doing business. Such as changing the color code of weeks from Red time or White time or Blue time, as well as the method of exchanging their time share such as going to points. You say you have enjoyed many vacations, yet you want to get rid of your deeded property at this time. I guess it is like buying something and then returning it when you are through with it. We will buy your unit back for 1000.00 however, you will need to Have an attorney do the deed and then it has to be recorded in the auditor and the recorders office in Orange county. If this person wants to call our office we will be more than glad to give them the procedure according to the rules set forth by the board members,
