Regarding the complaint against my person stating "[redacted], who has also decided not to respond to any calls or messages," I have not taken more than two days off in a row in over nine years. From July 3-July 5 when the incident was occurring, I went to the coast the last half of the day July 3 and returned the last half of the day July 5 at which time I did have my phone silenced and/or turned off and checked messages periodically. I checked my message history and did not have one from Mr. [redacted]. I don't know Mr. [redacted]'s phone number and would have no way of knowing when he called because I do receive a number of calls daily. I also checked to see if I had any repeat calls with no messages and also did not see any. I do not return calls with no messages because I receive many telemarketing calls during the day. I also have a listing partner and usually if I am not available, agents or persons with questions about a listing call him with the question if I'm not available to answer. After discussing the matter with the agent in my office involved, I did find one message from Mr. [redacted]'s agent asking me to call at my convenience during that period. Not knowing at that time what the matter was and the matter not being stated in the message, and the fact that I was on vacation and an agent would call my backup with questions, that message was not returned. Also in matters involving agents in transactions I speak directly with the other agents manager. This being stated, I don't believe that "deciding not to respond to any calls or messages" is an equitable statement.Regarding the actual matter, I believe it has been resolved but was a matter of lack of communication between agents on both sides. As I understand, the seller needed to stay in the property an extra week which requires as CAR form SIP stating the terms for the occupancy. That form was signed by both parties stating terms but was not sent to escrow by either party (?) and caused the conflict to begin with. Not being involved with all transaction documents on a day to day basis I have no idea how that was overlooked by either the buyer or seller's agents, but I will go on record as saying it was less than efficient handling of documents on both sides of the transaction and I will take responsibility for the lack of attentiveness on our side. As I understand, the agreed upon payment has been made to Mr. [redacted] and the matter resolved. Although purchasing a home should be a positive experience, it is often frustrating and very stressful for all parties including the principals and agents involved. There are a lot of moving parts and lots of documents. Any failure to communicate can only add to the pressure and success of the transaction. Barring the frustration involved in his transaction I hope Mr. [redacted] is enjoying his new home.Respectfully,[redacted]Broker/ownerFresno Modern Real Estate

I am rejecting this response because:
The issue was not resolved.  [redacted] backpedaled after the fact, once she realized there was no signed SIP, and then the seller signed an old SIP that we had declared null and void.  At the time we submitted that SIP, she said no way and they absolutely would not sign it.  Then when she couldn't find any signed SIP, and submitted that one.  It was never submitted to us until after closing, either, long after we marked it null and void.  So it was not satisfactory, no.  I did not leave a message with Mr. [redacted], because I learned with [redacted] that she screens her phone calls and was ignoring calls from my agent -- so I wanted to try to reach Mr. [redacted] without him knowing ahead of time who was calling so that I may get an answer.  I tried several times over the course of a couple of days, and my agent tried a couple of times.  It was a very shady transaction.  The seller also left the house mess, didn't leave the check he was supposed to (which [redacted] finally did something upstanding and wrote one herself).  The seller had also agreed to leave all the warranty/manuals for the appliances, gardener's contact info, etc... and didn't.  The only reason I didn't fight the back-dated SIP that allowed me to eventually collect $200 (of the $800 requested in the latest valid SIP) was because I had accepted the fact that the seller's agent was not honest and upstanding, and decided that something was better than nothing -- which is what I had come to expect from this agency. I used to enjoy attending Open Houses, and taking friends on the market, and it really is unfortunate that Fresno Modern has left such a bad taste in my mouth because they represent some of my favorite homes in the market -- and I feel I can no longer attend or take anyone.
