Practical Nursing program at Beckfield College in Tri-County on September 28,
On November 3, 2015, she arrived at the clinical site and mentioned to
the clinical instructor that she was
pregnant and had lifting restrictions per
her physicianThis information had not been disclosed to the clinical
coordinator and it was the first time the clinical instructor had been notified
of this change in the student’s health statusThe student also did not provide
documentation from her physician at this time to confirm that she was
physically able to attend clinicalThe student left the clinical site voluntarily
because she was unable to meet the requirements of the daily assignment and she
had not provided the proper documentation from her physician that would deem
her safe to be in the clinical setting
From a health status perspective,
the following areas apply to this student’s situation according to the
Beckfield Nursing Student Handbook, which Ms*** agreed to abide by when
she was enrolled at the school:
If an instructor deems a
student unsafe or unprepared for a clinical assignment, the student may be
excluded from the assignment and may not be able to meet the daily assignment
for that clinical (which may include sending the student home) and the course
requirements for the quarter
It is the student’s
responsibility to report any change in health status that may place the student
or patients at risk and to obtain a note from their primary care provider to be
able to continue to go to class and clinicalAny student who anticipates an
extended absence during a given term due to health concerns (physical or
emotional, pregnancy, etc.) must be aware that he/she may not be able to meet
the requirements of the courseThe student should make a decision in
collaboration with his/her attending health care professional and the nursing
faculty involved as to the feasibility of taking and passing the courseThis
decision shall require a statement from the attending health care professional
that the student is able to participate in the specified clinical assignment
each time they see their primary care provider including any limitations that
may be enforcedCollaboration between the student and the instructor shall be
needed to plan ahead for an alternative schedule
When temporary conditions
arise which restrict clinical work, the student must inform the instructor and
clinical coordinator immediately in writingThe instructor and clinical
coordinator shall require a signed authorization from a physician to return to
the clinicalThese restrictions could impact the student’s ability to complete
clinical assignments
As mentioned previously, Ms
*** left the clinical site of her own willShe did not provide prior
notification or documentation to her change in health status that would verify
any restrictions and that she would be safe to be present in the clinical
settingThis documentation was shown after the fact
Ms*** was subsequently
absent from clinical the following week on 11-10-due to a court dateThis
additional absence put Ms*** beyond the allowable clinical absence which
is one dayThe Nursing Student Handbook states that since time is limited for
mahours, only one macan occur with permission from the
instructor and the Associate Dean of NursingIt is important to follow the
policies that are in place and those polices should be fairly applied to all
studentsIf other students have had to withdraw from a class due to exceeding
the allowable amount of clinical time absences then those same rules must apply
to Ms*** as wellThis was made clear to Ms*** by the Associate
Dean of Nursing and the clinical coordinator
The Beckfield College Nursing
Student Handbook specifies excused absences as those that pertain to illness or
a serious and unforeseen emergencyPregnancy would not fall into this
categoryWhile it is understandable that court dates may be mandatory, the
absence for Ms*** on 11-10-pertaining to her court date would have
been considered the one clinical absence allowed to be made-upThe clinical
time missed on 11-03-put her beyond the matime that was allowableMs
***’s clinical instructor and the clinical coordinator were not made aware
of the 11-10-court date beforehandHad the student not left voluntarily on
11-03-15, the absence for the court date could have been accommodated and the
student would have passed the classThis same clinical attendance policy is
applied to all nursing students at the Tri-County Beckfield College location
The clinical coordinator at the Tri-County
Beckfield College location informed Ms*** on 11-17-that she only had
one nine-hour clinical maday available which is the equivalent of one
maday for the clinical in which the student was attendingThis is in
accordance with the limited clinical matime availability of only one day
Ms*** was never told by
the Associate Dean of Nursing at the Tri-County Beckfield College location that
she could not attend school due to her pregnancyDiscussion occurred pertaining
to her pound lifting restriction and if she felt she could safely attend
because of this limitation but Ms*** was not told she could not attend
schoolThe safety of the student and her baby were the primary concerns and pregnancy
in itself does not prevent any student from attending Beckfield CollegeIn a
clinical setting, it is difficult to predict potential incidents that may arise
and it is also difficult to gauge pounds of weight or pressureShe might
instinctively try to catch a patient as they fall, need to perform emergency CPR,
or lift the leg of a patient to place a pillow under it among other thingsThe
rolling book bag the student must lift in and out of her car most likely weighs
more than pounds but Ms*** felt the lifting restrictions would not be
a problem
Pertaining to the lifting
restrictions as mentioned previously, per the Nursing Student Handbook, any
student who may have a health concern or is pregnant, must make a decision with
their health care professional and the nursing faculty involved as to the
feasibility of taking and passing a courseThis decision shall require a
statement from the health care professional that they can participate in
clinical assignments each time they see their primary care provider including
any limitations that may be enforcedAgain, prior notification of the change
in health status was not communicated to Beckfield faculty by the student and
documentation from the physician was not disclosed until afterward
The focus has always been to
follow the Beckfield College policies that are in place and ensure they are
fairly applied to all students

We
would like to clarify that no one at Beckfield College, including the Associate
Dean of Nursing or the clinical instructor, ever told Ms*** that she
could not attend school due to her pregnancyThe issue with Ms*** is a
simple one of violating the Beckfield College clinical attendance policy
On
11/03/15, the student came to the clinical site without medical clearance from
her physician after a change in her health statusShe stated to the instructor
and staff that she did not want to lift after she had already been given her
assignment for the dayShe provided no documentation from her physician
stating she was safe to be at the clinical siteThe instructor met with Ms
*** and was willing to work with her but allowed the student to decide for
herself whether she wanted to stay or leave the clinical siteThe student
chose to leave
Ms
*** chose to leave the clinical site on 11/03/knowing she would be absent
the following week 11/10/for a court date and this would put her over the
time allowed to be absent from the clinical settingAlthough the student left
the clinical site voluntarily, it would have been reasonable if the clinical
instructor had chosen to send the student home, since she did not provide proper
documentation from her physician on 11/03/15, clearing her from a medical
perspective to be there
The
following are some but not all of the policies in the Beckfield College Nursing
Student Handbook that apply to this situation:
1. If an instructor deems a student

clinical (which may include sending the student home) and the course
requirements for the quarter

In
Ms***’s original complaint, her desired settlement asked for the
following:
An apology from the
school about what happened, the honest truth if what happened was right, if
making up the clinical hours were really possible, and contact by the business
1. We sincerely apologize if there was
any miscommunication, as we only want Ms*** to be successful in her goal
to become a nurseThere was no intention of deceit, only a desire to be fair
to all students and apply the written policies, which all students agree to
abide by when enrolled in the nursing program at Beckfield College
2. According to the policies in place
at Beckfield, the subsequent consequence was reasonable because all students
must abide by the clinical attendance policy, and must provide proper medical
clearance documentation from their physician prior to attending clinical. This documentation must state that it is safe
for the student to attendIt would be unfair to give special treatment to one
student, but enforce the policies on others
3. Making up the clinical hours was
not possible because of the limited clinical and site availability and more
importantly, it would be against the one-day clinical mapolicyThe
clinical instructor had one, nine-hour day available whereas the student needed
more than thisThis information was relayed to Ms*** by the clinical
coordinator
4. Ms*** is welcome to continue
her nursing education at Beckfield CollegeOur goal is to graduate successful
nurses who will become assets to the nursing community and provide excellent as
well as safe patient careA representative from the school will contact Ms
*** to see if she is interested in continuing her journey to become a
nurse through our institution

For your reference, details of the offer I reviewed appear belowI would like to say I Informed my clinical instructor I had a doctors appointment on 11-4-I stated to her this would be my first doctors appointmentI never once said I had restrictionsI repeatedly told the clinical intructor I did not feel comfortable lifting until I spoke to my doctor at my appointment which was the next dayConsidering how I had many complications with my first pregnancy I did not VOLUNTARILY leave I WAS TOLD TO LEAVEAfter I said I don't feel comfortable lifting until speaking with my doctorAlso I see no where in the response that she COULD HAVE offered me another alternative to not liftAlso, the clinical instructor knew I had to miss 11-10-due to courtThe clinical instructor and the clinical coordinator knew I was pregnantI had not yet had my first doctors appointment I was only weeks along when I spoke to both I did not see my doctor until a week or two after I found outWhich was the day after I was SENT home on 11-3-I tried to provide proof I was at court 11-10-and the dean told me she did not need the proof because it didn't make the absence excusableWhat happened was totally wrongAnd the response is totally wrongWhat is being said is not trueAnd I have other students to back me upAnother student was also SENT home with me because she also had not been to the doctor and didn't feel comfortable liftingAnother option could have been givenAs I am a STNA there is many other duties and skills she could have had me practiceLike stated in the first complaint, the dean should have told me day one when I spoke to her with the clinical coordinator present there was nothing they could do to help meInstead they told me they would see what they could doBeckfield college is full of itAnd it really upsets me what is being said isn't trueThe clinical instructor and the dean both looked at me and said because of me being pregnant they don't think I can finish school And I stated to the dean she cannot kick me out because of pregnancy Whether or not I told the clinical coordinator ahead of time about my court date should not have matteredI tried to provide proof I was in courtAs for my pregnancy, I provided a note the same day the clinical coordinator and I was in the deans officeI called the doctor and had them fax it right awayNot one word was said to me about the lifting restrictions being a issue until I approached the dean again about making up my clinical hoursThen she brought up what the doctor sent her and that I may not be able to continue school I feel like this matter was not looked into closelyEven when I approached the president I feel like everything was brushed and swept under the rug The dean lied to the president and told him she was not aware of why I missed on 11-10-which was a lieAnd the clinical coordinator was in the room with the dean when I tried to provide proof from court I was told by multiple staff at beckfield college the dean likes to do things her way and not by the bookAs I see the president does not look into things or respond back to emailsBeckfield college teachers warned me about the dean and also advised to me seek a lawyer when I was told I may not be able to finish school because of my pregnancy.

After what happened I don't feel comfortable ever attending Beckfield againEveryone was aware of my pregnancy not once did anybody ask for a doctors slip until I told the instructor I did not feel comfortable liftingA worker there offered to lift for me and the instructor said noShe could have gave me another assignmentShe did not have to send me homeThe option was lift or go home as another student was there and was given the same optionAs far as my pregnancy I was told by the instructor and the Dean they both didn't think I should continue nursing school because of my lifting restrictionsAs stated she told me it might be a issue picking up my book bagAlso as stated when Aimee R*** was in the office with me and the Dean why didn't the dean tell me right then and there I couldn't make up hours She said she would see what she could do and never did get back with me I had to keep locating herAs each time was a negative experience Which I was warned by staff it would beI am very disappointed at my attempts to reach the president and received no responseI was not going to put my pregnancy at risk before I spoke to the doctor the clinical intructor could have gave me another assignment as the president agreed when I first spoke with him
