would like to make a statement in the reasons behind why I am not allowing a refund.
Mary purchased a ring from FCJ on August 18, 2013, invoice #XXXXX at Bayfront Art Fair in Duluth, MN. We do not have a "layaway plan" but because Ms. [redacted] was very interested in a ring from out inventory and lacking the total funds to purchase, I agreed to for her to make payments, with balance paid in full by the end of 2013.
That did not happen. Attached are copies (8) of correspondence with Ms. [redacted] over the past 2.4 years with "promises" to make payments and reasons why she could not.
I was very generous on allowing a longer payment plan.
You will notice on the lower portion of the original receipt that "sales are final and exchanges are allowed with in 7 days".
I have paid federal and state taxes on the monies received, state sales taxes, and merchant fees on the monies collected.
I gave her a 60 day notice, (due October 27, 2015) to make full payment on the ring. I also notified her that I would not take her to small claims court to receive the balance due of $268.87 which would complete the purchase.
We have not had a problem with past customers in the 25 years I have been in business in MN.
I do not plan on refunding the money to Ms. [redacted],
