I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.I looked over the rebuttal from Badger Fitness and the owner indirectly admitted that he did not give me the payment agreements when they were signed which is required by Wisconsin Statutes Chapter Section and Section (b). The payment agreements do not have a Cancellation or Refund clause require by Wisconsin Law found in Wisconsin Statute Chapter Section (a). I would like to be refund the two charges of $and $since I was overcharged and the payment agreements failed to comply with Wisconsin Statute Chapter 100.177 Section 2, Section 6(a), and Section 6(b).Below are the three highlights on my complaint. The first disputed payment of $was charged to me on 12/2/2015. I am disputing this charge since Badger Fitness charged me a second time for using a personal trainerI should only have been charged once for the personal trainer in November and not a second time in December 2015. The second disputed charge is for $on 12/31/which is made up charge that the gym owner made up. There is no cancellation fee in the payment agreement which violates Wisconsin Statute Chapter Section (a), Fitness center and weight reduction center contracts which requires the contract or payment agreement to have a caption printed in boldface uppercase type of not less than 10-point size entitled "CANCELLATION AND REFUNDS"In addition to Badger Fitness having no cancellation or refund policy I did not receive copies of any of the agreements at the time of purchase from the gym owner which violates Wisconsin Statutes Chapter Section and Section (b) for not providing me days to look over the agreement and cancel by the third dayI did not receive either payment agreement until December 28th, 2015.Please let me know if you have any questions.Thank you for your assistance.Respectfully,*** ***

[redacted] was a member of my gym and he's concerned with 2 contracts he signed. Our prices are the same for everyone and they are as follows: 1 year membership gym only - $25/monthNo contract membership - $39/monthly Personal Training - [redacted] signed for 1 year at...

$312/month. Our contracts are written out plain and bold without hidden agreements.  [redacted] signed up for the year of training because it's the absolute cheapest option. Using [redacted]'s information he wrote concerning the costs of what he thought personal training was would break down to $3.25/hour. The industry standard in Madison Wisconsin is $35-$75/hour.  He signed up for 8 sessions a month for 12 months at $312/month. [redacted] claims he's been requesting copies of his contract since November. That is not true. [redacted] and I have spoken primarily through e-mail so I'm sure he'd have a copy requesting that if it were true. [redacted] Salm has received all copies his contracts on Monday 12/31/15. Contract for $25/month for a year gym membershipContract for $312/month for Personal Training[redacted] came to my office this morning and I believe we resolved all issues. Out of courtesy, I let him out of his contract if he paid a difference of going to both PT/Gym short term contracts. Unfortunately this customer is being dishonest. We are an honest business and truly bend over backwards for anyone. We serve thousands of customers annually, we have 5 star reviews on [redacted] and [redacted] etc and unfortunately this customer is trying to take advantage of us. We have sacrificed profit...

many many times to keep a customer happy. So, we were willing to do the same in this situation. The customer purchased custom printed cups, they are not resellable because they have the customers name on them. Custom printed products are not returnable unless there are major flaws. This is all spelled out in the Terms and Conditions the customer agreed to. The customer complained that all the 30,000 cups had issues with the rims, the rims where coming unrolled. We received the photos of a cup with a rim issue with the customers stating that all the cups had the same issue. We took the customers word for it that all rims were ruined like in the photo. We went and picked up the cups and processed them all through our quality control process. We checked every single rim, and NONE of them looked like the photo. NONE. We feel the customer deliberately pried the rims up with their fingernail and took a photo.  We don't know why any reasonable person would even ask for a refund when none of the rims have any issues at all? I have attached photos of our investigation showing that none of the cups have the same rim issue as the photo the customer sent.The customer agree to Terms and Conditions, they received a wonderful product and we feel they are attempted to fraud us by asking for a full refund when the issues they claim are not real.Because of the dishonesty here we are looking at our options legally.
