In reference to ID# [redacted] we submit the following reply.  The complaint as written is somewhat confusing since the money Invoiced was for a  progress payment for work already completed...

on the project and it is money that was given to [redacted] for the specific purpose of architectural work.  Absolutely no money is coming from [redacted] with the exception of extra work she specifically requested and that was discussed over a several week period.
All money with exception to client requested work is paid by the NY Risings Program.
[redacted] has received money that was supposed to the architect (we have a signed agreement with them) but unfortunately she has spent that money on other things.  The money was due and payable upon signing the agreement; we agreed to wait until the documents were complete to submit in light of their mistake in spending the money.  The time it took to complete the work gave them time to come up with the money.  When the documents were complete, [redacted] said she had no money.  We simply cannot proceed without a guarantee of payment for services.
It seems they have picked up some legal terms – meeting of the minds, null and void, etc. and have provided absolutely no examples of these things.
They are deliberately making misrepresentations and deliberate and false allegations.
 Examples:
“We’ve yet to see what if anything was actually done for our home.” - Renrick H[redacted], our Project Manager meet in person at their home and discussed and left a copy of the architectural plans for their house.
“The June deadline came and went …” – As seen from this email from the NY Risings programs dated Apr **, they extended the deadline for submission which we were aware of prior to this letter yet the [redacted] attempts to suggest it is due to her efforts to have the deadline extended or negligence on our part.

Review: This Architect came to my home solely as a result of Super storm Sandy. To expound, but for Hurricane Sandy I would have no need or desire to deal with an architect. It is our claim that Frank S[redacted] along with his project manager Renrick H[redacted] came to our home through the referral of an architect who was actively working with the NY Rising Storm Recovery program to take advantage of and commit fraud against us by being misleading and trying to extort thousands of dollars from us that were to be dispersed through the program. They played on our vulnerabilities and misused our trust by asking us to believe in their familiarity, knowledge and prior dealings with the program, which we were enrolled in seeking to elevate our home and make it flood safe, IF WE WERE ELIGIBLE. We followed all protocol by obtaining specific documentation in advance that would tell the "professionals," FSS ARCHITECTS, if we would in fact be able to elevate our home as per the program's guidelines. We gave them a good faith deposit of $2500 in April 2015, in the event we were approved they could get started right away! As per protocol, we sent them the documents via email in May 2015. Their claim of knowing the program, they should have known FULL WELL from that document that we were NOT able to elevate according to the program because our main level was already above the flood level, yet instead of telling us that, they began asking for more money! So we contacted the program to explain the situation and we were informed that we were not eligible to elevate and NOT to give these contractors another penny, as they should have told us and given the money back. FSS and their engineer, Renrick H[redacted], have refused to refund the money to the program and just today are continuing to send us harassing invoices for yet MORE MONEY!! They have defrauded us and the program and are continuing to ask for more money which they will NEVER EVER EVER GET!! BEWARE! Shady characters!Desired Settlement: YES!! FSS Needs to refund the program's $2500 immediately. After FSS continued asking for more money, yet hadn't showed us what all they had "supposedly" done, We got suspicious and had another architect come out to give a quote, without ever mentioning FSS. He took ONE look at our documentation (that FSS had as well) and told us he could not in good conscious take any money from us because we could not elevate as per program's guidelines. We confirmed this with NY Rising and had to opt!!!!!

Review: My family and I are victims of Superstorm Sandy. We are participating in the NY Rising program to elevate our home. We were introduced to this architect by a third party. He said he would be able to do the job. We agreed to give a $2500 down payment up front and then after the elevation package required by the program was successfully submitted and accepted we would pay the balance of $3500. The deadline for that submission was June [redacted]. We paid the $2500 to his project manager in April and the check was cashed. We've yet to see what if anything was actually done for our home. We had three conversations with this man but the product was not produced in timely fashion. The June deadline came and went and nothing was ever submitted on our behalf. I put in for an extension and, thankfully, the program extended the deadline for everyone. After that, we received a threatening email/invoice from this architect asking us for more money, thousands of dollars, with no reflection of the $2500 we had already paid, and extra fees for things he never told us were considered "extras". At that point we lost total confidence, trust and will to work with him any further. We feel these are unprofessional and subpar practices and he is trying to force us to continue dealing with him. He and his project manager refuse to refund us the program's money. As far as we are concerned this contract has been breached on their end and we need to higher new professional. They have not done what is required, yet they are trying to hold our project hostage and extort more money from us. They have not done what they were contracted to do which was submit all proper paperwork, drawings, and accompanying documents to the program for our home elevation project, so they are not entitled to the initial payment or our project in general. In researching this architect (S[redacted], Frank #[redacted]) we found he has a lost legal proceedings before. We are hoping to avoid a legal proceedings in our case. Please help.Desired Settlement: A refund. The communication breakdown, lack of professionalism, unjustifiable fees and service in poor taste have destroyed our confidence in this service provider and prevents us from wanting to work with these individuals any further. I am not sure we can recover the relationship to do business together. The trust and mutual meeting of the minds has been fractured thus rendering this relationship null and void. We are due a refund of $2,500.00.
