[redacted],
On behalf of FTL Finance, please accept my most sincere apologies for the miscommunication that was delivered to you regarding your account XXXXXXXXXX. I understand that your interest rate and payment history have not been clearly...

communicated to you. Please view the details below as well as the attached payment history to view how interest has accrued on your account and how payments have been distributed between interest and principal.
Account XXXXXXXXXX
Interest Rate: 9.9%
Due Date: 22nd of each month
Attached: Payment History
The interest rate has remained at 9.9% for the entirety of the loan. Our Account Edit History, where all changes made on the account are recorded, shows that the interest has never been changed.
I believe the confusion regarding your interest rate arose due to the differing amounts of each payment that is distributed to interest and principal. As you can see from the attached payment history, between $19-$99 of each payment was applied to interest, while the remainder was applied to principal. This variance in distribution is in no way impacted by a variance in interest rate, as the interest has never changed from the original 9.9% that is listed on your contract.
The variance in distribution to interest and principal is due to the date that each payment posted. Interest on this account is charged per diem. Therefore, the amount of each payment that is distributed to interest is based on the amount of interest per diem that has accumulated up until that payment posts. As you make payments on your loan, interest per diem decreases, as it is based on the remaining principal balance.
Your account is current and my office will respect your wishes that we not communicate with you regarding your account as long as you consistently submit payment as promised.
This information has been sent to [redacted] via USPS with the attached payment history. I have also faxed the payment history referenced to Revdex.com.

This response is in reference to the complaint #[redacted] that was submitted by [redacted]. Attached are the two documents that were sent to Mr. [redacted] and the Revdex.com after the original "non-complaint" was sent to FTL Finance. FTL has not conducted deceptive practices as indicated by his most recent...

complaint. All payment information had been provided to Mr. [redacted] upon creation of his account, and correspondence was then sent after the account became past due. Until that point, FTL had no reason to contact Mr. [redacted] because the account was current and in good standing. Mr. [redacted] could have remitted payment at anytime, the way he had done previously. FTL Finance has since made multiple attempts to resolve this matter, including offering a settlement. Mr. [redacted] then sought legal counsel and we have corresponded with his attorney with an additional settlement offer. FTL Finance will not remove the negative reporting to the credit bureau because what has been reported is an accurate representation of his payment activity.

[redacted] Ringgold, GA 30736   Account #: [redacted]   Dear Mr. [redacted],   Please accept our most sincere apology for the letter that you received referencing collections activity on your account with FTL Finance. Our goal is to provide excellent customer service to...

all of our customers and I am very sorry that we fell short on that commitment.   We recently changed the systemic procedure in how our past due notices are generated and consequently, we sent you a letter that was not intended for you. The letter that you received was sent out of error and the mistake has been corrected. The letter that you should have received would have reflected that your account was less than 30 days past due and would not have expressed an intention to repossess the equipment. We appreciate you bringing this matter to our attention so that we can resolve the mistake immediately.   Past due reporting to your credit takes place only if a payment is received 30 days or more after the payment was due. In this case, your November 1, 2016 payment was paid on December 5, 2016. Therefore, your credit report will reflect this payment activity, but will not have any additional indication of “collections” activity as you referenced in the complaint that you sent to the Revdex.com. We appreciate your payment and your account is now in good standing.   FTL Finance has an automated call system set up to remind you when your payments are coming due. The number we had on file that we were attempting to reach was [redacted]. We had updated your account with the number you submitted on the Revdex.com complaint so that we can provide these customer service reminder calls to you.   If you have any question regarding your account, please do not hesitate to reach out to me.   [redacted] FTL Finance Customer Service Manager [redacted]@ftlfinance.com

Please accept our most sincere apology for the miscommunication that our office has delivered to you regarding your account. Our goal is to deliver easy, simple, financing and friendly customer service. I am...

sorry that we fell short in our explanation and details of your loan.

Please see the attached account breakdown per your request. In this breakdown, you will be able to view how each payment has been distributed amongst principal, interest, and fees, as well as the remaining balance after each payment.
Upon analyzing your account, I noticed that your last payment on January 4, 2016 was applied to a late fee balance that had accrued on your account, totaling $298.68. Because of the outstanding fees, the account was not paid off with that final payment. I believe the distribution of this payment is what caused confusion at the end of your loan. I apologize that we did not recognize that issue earlier and better explain how that payment was applied.
As a customer courtesy to you, I have reapplied that payment so that it covers your remaining balance and waived the remaining fees. Your account is now paid in full and terminated. No further action is required by you and your paid in full letter is included as an attachment.
If you have any additional questions or concerns, please do not hesitate to reach out to me.
Thank you!

Initial Consumer Rebuttal /* (2000, 7, 2016/01/27) */
(The consumer indicated he/she ACCEPTED the response from the business.)
I sincerely appreciate this response and this action. I was completely unaware that there were any late fees as there was no correspondence suggesting such. If proper statements had been presented, I would have made my due diligence. Thank you for your time and attention to this matter.
