Complaint: ***
I am rejecting this response because:Details from vendor are invalidAustin Police Dept contacted the vendor as a courtesy to our personnel on location as they do not work that area and are not familiar with available resourcesAs such, the requested services were between FESCO Ltd and the vendor, not the Austin Police DeptCell phone records belonging to FESCO personnel show that at no time while awaiting arrival of our representative did the recovery driver make any additional phone calls, nor was a voicemail left with our company's management representative alerting us that no one had arrived on siteOnly upon our personnel's arrival and subsequent inability to find either our asset and/or the recovery driver was it known that the vehicle had been taken to the recovery company's facilityRecovery company personnel should recognize that it is considered a moving violation for our personnel to make a phone call while operating a commercial vehicle while they were en route to his locationIn addition, when our personnel arrived at the recovery company facility to render payment both the day of the incident, as well as the following day, our valid company issued credit cards were declinedOn the second day it was discovered that the reason for the decline was due to the recovery company's credit card equipment for the processing of payment was improperly configured to meet standard credit card processing security standardsThis was verified by contacting the bank that issued the company credit cards, Wells FargoWells Fargo verified the status of the recovery company credit card equipment was configured as such that all attempts to process payment showed as a fraudulent chargeAs a result, FESCO Ltd was required to contact Wells Fargo via phone so that a representative could be on the line to verify the validity of the charges and manually authorize them in the bank system when the credit card was swiped by the recovery company

Pronto Engine & Transmission[redacted]October 19, 2015Revdex.com Corporatei Office1005 La Posada DriveAustin, Texas 78752Attention: Ms. [redacted]Ms. [redacted]:We are respohding to the second complaint ID# [redacted]; dated October 16, 2015. As previouslymentioned, Or wrecker company is on an Austin Police Department (APD) list that APD calls whenvehicles are stalled in the public highways. If the individual or company do not have a regular towcompany at hand to service them, APD will call the next APD Service Rotation Company on the list. Itwould not have mattered which company showed up to render the services the charge would still be thesame as previously broken down. Let it be known that the officer that respond to the scene of a stalledvehicle are not the ones that call the towing service directly, their dispatchers from the main APDheadquarters are the ones that look at the schedule C list of towing companies that they have listed andthat is where the calls come from. The officers just respond to the scene. If we were not on the list wewould not have been called, because out of hundreds of towing companies that are in the City of Austin, not all towing services have the privileges that certain companies have such as ours. The wreckercompany tow trucks have to be certified, licensed, and registered through the City of Austin to renderthese types of services.Again, on OctOber 1, 2015, our wrecker company was dispatched by Austin Police Department (APD) toa Service Rotation Class C, because FESCO LTD's 18 wheeler was stalled in the middle of the roadblocking traffic. APD Service Rotation and Class C Collision Rotation rates for Class C vehicles areregulated and are already set by a vehicle schedule_ The amount charged is what is regulated in the Cityof Austin. It is true that after APD summoned our wrecker company out for the service; it is between our companyand FESCO LTD to figure out where they want the disabled truck towed to and for us to collect for ourservices rendered. But again, APD has a list of schedule C vehicle tow trucks that they call for service. The charge would have been the same whether ours or another tow company rendered services. The FESCO LTD driver told our wrecker driver that his supervisor/manager was on the phone andwanted to speak to him. Our wrecker driver was instructed by the FESCO supervisor/manager to takethe disabled truck to the Freightliner Dealership in Austin, Texas. He gave him the name of the servicedepartment manager at the dealership. Our wrecker driver called the dealership service manager to ensure that they would pay with a creditcard or check when he dropped off the truck. The dealership service manager told him that they do nothave any credit cards on hand to pay with; he then asked him if he had other means to pay for the tow.He responded that he could give him a purchase order number. Our wrecker driver responded that ourcompany accepts company checks, credit cards, cash, cashier checks, and corn data checks for payment. The service manager said he could not help him with that request.2nd AnswerPage 2Policy is that the wrecker driver should wait only _?.,0 minutes for payment; if he waits longer he isallowed to charge wait time. In this case, he waited an hour because according to thesupervisor/manager that our driver spoke with from FESCO's LTD another driver was 10 minutes behindhim with payment. (If our wrecker driver wanted to he could have charged for the hour wait, but out ofcourtesy he did not). Even though the 10 minutes turned out to be 3 hours before the other driver forFESCO LTD showed up. The supervisor/manager could have been a little more honest that his otherdriver for FESCO LTD was coming out of Corpus Christi and really was not 10 minutes behind the wreckerdriver as he mentioned. A little honesty would be appreciated as he also mentioned that our companycredit card machine was not working properly, that is untrue_ We just updated our credit card machine amonth ago and it has been working accurately. When our company called Wells Fargo again thefollowing day the Wells Fargo representative said "it was FESCO's pin number that was the issue." Thenext day when; they tried the credit card 3 or 4 more times it still kept declining FESCO's company creditcard. Therefore, no FESCO LTD was not double charged on the amount for the tow; below is the breakdownon the charges as on the invoice that was previously provided:$800.00 - Class C Tow$35.00 - Class C Storage Charge$20.00 - Impound Fee$4.54 - Tax$35.00 ed Day Storage_$2.89 - Tax on ed Day Storage$897.43 — TotalIn conclusion, please let it be known that our answer stands; we will not be giving any refund becausethe charges are legitimate. If FESCO LTD would have claimed their truck the first day from our storagefacility the amount would have been $859.54, but because their company card kept declining and thefreightliner dealership did not want to be responsible for FESCO's tow bill, the truck remained in ourstorage lot for a second day, Therefore, there was another day storage fee plus tax, which raised theamount to $897.43. This is our final answer to this complaint; we did nothing wrong, if FESCO LTD feelsthat they were charged the wrong amount, they have the option to take it to court.Regards,9_[redacted], Owner
