submitted an application to rent an apartment at [redacted]the “Rental Application) on April 24, 2017. The standard charge to process an Application is $295.00 which represents an application fee of $45.00 and a holding fee of $250.00. On the submittal date of the Application, the Applicant requested to be placed on a waiting list for a specific apartment type.The Applicant executed the Application and qualifying criteria (the “Qualifying Criteria, (copies attached), which documents clearly state as follows:1.) APPLICATION FEE. A non-refundable $45.00 for the application fee will beSubmitted by each applicant over the age of 18.2.) HOLDING FEE. A Holding Fee of $250.00 (to be put towards 1st month’s rent or security deposit) will be submitted along with the rental application(s) to reserve an available apartment home. Applicant(s) have 48 hours to cancel their application(s) in Writing and receive a full refund of their Holding Fee as set forth above and as more specifically set forth on the application. Application(s) may take longer than 48 hours to verify based on the information provided by the applicant(s). Therefore an applicant(s) 48 hours written cancellation policy is not contingent upon the applicant(s) application being approved. If an applicant(s) application is denied, based on an applicant(s) not meeting Managements leasing criteria, Management will refund, in full, the Holding Fee within 30 days from the date of denial. Once the application has been approved, the Holding Fee shall be applied as such to the applicant's account. May 11, 2017 the Applicant informed our office that they wished to cancel the Application via email. The Applicant was approved which rendered the Holding Depoist Non-Refundable in accordance with the policy as set forth above. However, in good faith, we refunded the full holding fee of $250.00 to the Applicant long after the refund period of 48 hours had expired. Moreover, we refunded the Holding Fee within 24 hours of the Applicant’s cancellation.The Application Fee of $45.00 is clearly Non-Refundable as noted above. We incurred the cost and expense of processing the Application as requested by the Applicant via the simple act of Submitting Such application.We have more than honored the terms of the Application and Qualifying Criteria by fully refunding the $250.00 Holding Fee to the Applicant which we clearly were not obligated to do.Please feel free to contact our office at [redacted] if there are any further questions that we may assist in answering as it pertains to this complaint.Sincerely, ETP Hunt Club, L.P.[redacted]
