Fuel-N-Wash

I went in to purchase $40 gas on pump 2 on 2/5/14. The cashier ([redacted]) swyped my debit card I entered my pin, the machine made a sound and he swyped again. I asked are you sure it didn't go through the first time, [redacted] said no. I stated I will go somewhere else to purchase gas. I did not receive any gas from Fuel-N-Wash. I called my cardholder the following morning and was told the transaction went through four times the four time was voided but there were three that needed to be reversed totalling $121.65. I spoke with the owner [redacted] on 2/15/14 and showed him the paperwork I received from the cardholder, he stated I need to file a dispute through the cardholder. I explained and showed him the paperwork from the cardholder advising me to attempt to get a refund, he refused. He stated his machine was malfunctioning and his workers was aware of that however he would prefer I pay to file a dispute claim. I have all paperwork showing the fraudulent charges. I am willing to fax or mail in all documentation received from the cardholder supporting my complaint to the Revdex.com.Desired SettlementI'm owed $121.65.Business Response I am so sorry that the customer felt this way. we tried explaining to the customer that since you already filed a complaint with your credit card we can not do anything about it.Once you file our hands are tied and they will take care of it. Again we would like to apologize for any inconvenience.Final Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)The bank mailed me documentation on their letterhead to present to the owner to resolve this matter. At the time I presented him with the documentation (envelope/ALL paperwork) from the bank a dispute had not been filed. I explained that to him repeatedly, and allowed him to read the information for himself. He avoided me for nearly a week and refused to return my calls. He refused to cooperate, thinking I would go away. The documentation was clear, stating "because this was a PIN based transaction it will automatically be denied if a dispute was filed and my card will be assessed an additional $36 filing fee." Please carefully review my attachment and you will notice even his time (register time on receipt versus actual time from the bank)is off. The receipt from [redacted] Gas will prove that Fuel-N-Wash time is NOT correct on the receipt. If I had not kept the voided receipt or the receipt from [redacted] Gas he would have taken my money without my authorization knowing he was wrong. The clerk should not have been able to do a PIN transaction multiple times off my one time of inputting my code in. My documentation will confirm that the owner/I both know "he was trying to stiff me"! I will NEVER support this business again! The bank waived the fees and got my money, because I was prepared to file a civil suit. Thanks for everything Revdex.com.
