To Whom it My Concern,This is in response to a complaint Full Cycle Cellular received on the May 11th ID # [redacted] .Attached is the costumers invoice, On the bottom of each of our invoices it mentions our warranty policyAny physical damage or water damaged phones voids all warrantyOur warranty includes functionality of the part, and does not include any physical damage that my occur to that part.The costumer mention in her complaint, that her phone was cracked, and unfortunately glass does not crack on its own and so that would fall under Physical damage and voids the warrantyIt has to be dropped or struck in order for the glass to breakOne last thing, She mentions that our credit card machine was down, which on Sunday May 3rd that was correctWe had ran out of the thermal paper necessary to operate the machine, and it will not run card #'s without receipt paper in machineIssue was corrected Monday as soon as out Local First Bank openedThank You, [redacted] ***

Complaint: [redacted] I am rejecting this response because: 1) The vendor was very clear that the price was a maximum and made a particular point of saying that since the part cost was only $20, that the labor costs would be a maximum of $and he would try to even beat that price2) The vendor took quite some time to quote the price on the phone AFTER researching the part costsThe vendor confirmed the part costs were a maximum of $again when I dropped off the watch3) I have a receipt from the vendor showing the $as the price and it is NOT indicated as an estimate4) The vendor's unilateral mistake of fact as to the price of the parts is on its shouldersThe vendor clearly contracted to repair the watch at a maximum of $Colorado law imputes the unilateral mistake of fact upon the vendorFor instance: [redacted] [redacted] [redacted] [redacted] *** [redacted] There are more cases on point5) The vendor has absolutely no right at law or in equity to unilaterally change the terms of a contractYes, a contract was formedWe have offer, acceptance and considerationThe fact the no repair was done YET, because of the vendor's error, is NOT dispositiveAll the facts and the law are against the vendor's perspective Regards, [redacted]

I am rejecting this response because: Since I left my cell phone with your employee (who has been since fired), I believe my identity has been stolenI have received phone calls from my auto insurance company that someone has been inquiring about my account and opening a new policyMy phone was with the employee for approximately two hours and during that time he had access to my personal account information. I have since been monitoring my personal credit information because I am deeply concerned this employee stole information from me while he had my phoneIf you do not refund my $80, I will be forced to tell everyone I know about what a SCAM you are running. You aren't an actual business, you simply tell people your credit card machine is down so your employees can pocket cash
You run a terrible business and I hope you go out of business after I have told everyone I know on ***, ***, ***, and more about your terrible business practices

repairing small electronic devicesWe oftenquote prices over the phone to the best of our knowledge with the information given to us, but it is onlyan estimate and final repair price will be given when we can confirm model/part costOnce we wereable to gather the proper model information from your *** watch, we determined the screen for thisparticular model was times the cost of the quote given over the phoneI do apologize if this was notcommunicated to you properlyAs far as our records show you were never charged for this repair nor dowe have a signed invoice relating to this repairWe will make sure to include the word “estimate” whengiving quotes over the phone from this point forwardOnce again I do apologize for this inconvenience,and misunderstanding.#***
