Initial Business Response / [redacted] (1000, 5, 2017/08/23) */ Approx2/10/- We noticed a chip in the front porch and notified the concrete contractor to repair/patch at their next visit Approx4/25/- We repaired the chip by using a generally accepted construction process by applying Ardex CD Fine to the chipThis is a concrete resurfacing compound made for situations like this and is modified with high-performance polymers for high bond strength Approx4/27/- During the final homeowner walkthrough, we pointed out the patch and explained that the patch was common practice for situations such as this, the color will not perfectly match, and the patch would blend better as the patch and the concrete were weathered by the sun and the elements 5/22/- We received notification from the family: "Previously fixed builder-caused breakage in concrete still not rectified" 6/2/- We sent out an internal work order to examine report 7/7/- We visited the home and responded to homeowner with the following email: "I have been to your home to look at the concrete issues you have questions aboutAt this time, neither the thin crack nor the patch meet the standards in the warranty that would trigger repair." 7/8/- We received the following notification from the family: "Porch concrete still severely discolored" During July of 2017, there were several phone conversations between us and Mrto discuss options to appease the family despite the fact that the chip was already repairedIn a conversation with Mrduring the week of 7/31/17, we proposed that, as a courtesy, we would purchase a perennial of the family's choice or a reasonably-priced bush to be placed in front of the patch while it weathered with the concreteMrverbally approved of this course of action 8/9/- We received the following email (stating it was written by Mr.)Note that there is no number discussed, nor had there been one up until this pointWhen we discussed this email with Mron 8/10/via the phone, he confirmed that he did not write the email and that he would discuss it with his wife "Hi XXX, Haven't heard from you in a while regarding what is happening with the poorly done concrete on the porchWe have waited on the landscaping since we were anticipating it being fixed as promised, so if Steiner is going to offer a landscaping allowance in replacement of the concrete being fixed we need to know what that offer will beI will be blunt and say we will not agree on a dollar amount for a single bush to be placed in front of it, as we never intended on putting landscaping all over the front of the porch and will now be required to do so to hide the faulty work done by the contractorsPlease let me know Steiner's intentions so that XXX and I can decide how to proceedThanks XXX" 8/11/- We called Mrand stated that we would still be willing to provide a perennial of the homeowners' choice or an affordably-priced bush as a courtesyMrstated that, after speaking to his wife, he will refuseHe stated that they wanted more and that they would be calling a lawyer We have included two photos of the location in question - one shortly after the repair and one from last week As much as we like to accommodate our homeowners and address their concerns, the expectations in this situation seem unreasonable Initial Consumer Rebuttal / [redacted] (3000, 7, 2017/08/24) */ (The consumer indicated he/she DID NOT accept the response from the business.) First and foremost, the defect was not originally noted by Steiner homes, but by us during a walk-through with our superintendent, ***This issue was present prior to close and occurred as a result of negligence by the builder's contractorsRegardless of the builders opinion on the severity of the defect, it is a defect that never should have happened and that the builder should not expect a homeowner purchasing a brand new home to be content with given it is very obviousAdditionally, and most importantly, it is a defect for which we were promised a remedyThe builders representative did agree to purchasing one bush AFTER we had suggested that an allowance be given for landscaping, however, we must now change our landscaping plans in order to cover this defectIt was never our intention to add bushes all the way across the porch, and as a result of this defect, it will now be necessaryWe have stated numerous times that, if they so choose, Steiner homes can come out and rip the entire porch out and start from the beginningHowever, a quick poorly done patch job does not equal a remedy for such a defect on a brand new homeWe feel Steiner and its representatives have been deceptive since the notation of this defect in order to pass is along without taking accountability

We have been working on this to pull together a timeline regarding this jobIt is attachedIn summary, we would like to let you know that we signed a house for this customer on a lot of their choosingOur bank allows us to carry the
construction loan for the customer as long as the customer has provided us with a commitment letter from their bank saying they will pay for the home at closingIn this case, the customer was informed that the municipality would require them to create what is called a 'minor subdivison'This requires reviews and meetings of the municipality which Steiner Homes has no control over
So we accepted their deposit, and once we had banking approvals we were able to close on the lot (August 5)This is the date that we were able to start working with their municipalityWhile there are no problems with the approval for the minor subdivision, it does involve a process and we are subject to their (municipality) timelineNow Steiner Homes is paying interest and owns a lot on Delaware Stthat we did not choose to purchase, rather we purchased it on behalf of the customer and have incurred many costs on their behalf which will need to be paidWe just received a surveyor's bill todayHowever, Mr*** feels that it is taking too long and is asking for his money backBut according to our contract, we can only refund him whatever portion of his deposit that is in excess of our costs
