Because Mr*** contracted directly with Mr***, I have no knowledge of what their contract amount was, but I do know that Mr*** also gave Mr*** a deposit on the same day, but again, I have no knowledge of how much that deposit wasThat was between the two of them.We talked for another hour or so, and upon leaving, I told Mr*** that we would see him sometime in the middle to end of January. On 1/4/16, Mr*** contacted me to see if he could start his workI explained that I thought Mr*** was in Florida, but I would callMr*** agreed that we could begin work on 1/11/Mr***’s report does not indicate that I contacted him on this date, but states that I called him on 1/8/to let him know we would be starting on 1/11/16.On 1/11/(8:00am - 4:30pm Mark, Spencer, Grant, myself) my team and I began and finished the demo, and removed the walls, as needed for the plumberAt this point, Mr*** asked if we could also remove the carpet, and I agreedThe carpet removal was not part of the original contractMr***’s report indicates that I called Mr***, and that he wouldn't be able to start for a few days.On 1/12/Mr*** contacted me and said that the Mr*** need some additional framing completed for the plumbing rough-in, and I told him we would be there on 1/14/to complete this additional framingMr***'s report does not indicate that the plumber arrived the very next day.On 1/14/(8-00am - 4:30pm Mark, Spencer, Grant, myself) my team and I removed most of the carpet, and framed all of the walls at Mr***’s requestAll work was completed so that Mr*** could begin his workMr***’s report doesn't mention the extra carpet removalMr*** and I also discussed the electrical line and some miscellaneous wiring issues including junction boxes in the ceiling that would be covered by dry wallI explained that I was not comfortable burying the junction boxes and the line was too short to move to the back wallMr*** suggested relocating the line from the electric panel at the front of the basement, to a secondary panel box in the back of the basementHe also told me that he previously had issues with breakers melting in the rear boxI told him that I knew an electrician I and I could call himNothing further was discussed about the electrical work On 1/15/Mr*** called me and asked, “Can we barter on the electrical?” I asked what he was proposing, and he suggested that if I was willing to install a ceramic tile floor in the bathroom, that he would contact an electrician friend to move the line and complete the electrical roufor the bathroomI responded by telling him that, “I’m looking at a couple of bags of floor leveler sitting on my floor,” and that would be greatWe would have to level the floor after the plumber was finished, and we would be more than happy to barter on this projectMr***’s report simply says I was not comfortable moving the line for the dryerIt does not mention anything about the previous issues he had with melting breakers in the box where he wanted to line connected to.The plumber completed the rouwork on 1/18/Mr*** reports that after the plumber left they had no hot water, and that he contacted me and Mr***Per his reportMr*** realized his mistake and explained to Mr*** how to fix it because he couldn't get back down thereBecause Mr*** was my customer and I felt obligated to do everything in my power to keep him happy, I went to Mr***’s house this evening and helped him resolve the problemNote again, that Mr*** contracted directly with Mr***, and I did not have anything to do with this workMr*** reports that I said I felt it was my responsibility since Mr*** was my plumber and my contractAgain, Mr*** contracted directly with Mr***It was never my responsibility, nor did I indicate that it was, but because I held the primary remodeling contract, I felt morally obligated to keep the customer happy. On 1/19/(8:00am - 4:30pm Mark, Spencer, Grant, myself) my team removed the remaining carpet, rerouted the wiring, rerouted the cable line (all of which was not part of my contract), and started preparing for drywall installation. On 1/20/(8:30am - 4:30pm Mark, Spencer, Grant, myself) my team continued with rerouting the wiring, rerouting the cable line, and preparing for drywall installationAlso, at Mr***’s request, we installed additional soffit framing, added insulation to the office wall and windows, and rerouted a cable box, which his brother would then hook-upAgain, rerouting the wiring was no longer part of my contract, and Mr*** was contracting with his own electrician, and all of this additional work was not part of the original contract. On 1/21/(10:00am - 4:30pm Mark, Spencer, Grant, myself) my team completed framing, removed carpet from the steps, installed doors, and unloaded garbage at the landfillA good bit of this garbage was from the plumbing demo, which again was not part of my contractOn 1/22/(8:30am - 3:00pm Mark, Spencer, Grant, myself) we started installing drywallOn 1/25/(8:00am - 4:30pm Mark, Spencer, Grant, myself) we continued installing drywall, and I met with *** *** (drywall finisher), who quoted me $1,to finish all of the drywall once installedI told Mr*** to put us on his schedule. On 1/26/(8:00am- 4:30pm Mark, Spencer, Grant, myself) we continued installing drywall. On 1/27/(9:00am - 2:30pm Mark, Spencer, Grant, myself) we finished installing the drywallI called Mr*** to finish the drywall, and he said he could be there Tuesday 2/2/I told Mr*** that the drywall finisher was coming on 2/2/Mr*** agreed, and paid me another $4,toward the contract balance. On 2/2/(8:00am - 10:00am Mark, Spencer, Grant, myself) I met with Mr*** and introduced him to Mrs***Mr*** said he was fine, so I told him to get Mrs***’s number and call her as he was coming and going, and I left the jobMr*** called me at 11:00am and said, “The drywall guy said that I’m supposed to pay him.” Mr*** then notified me that he had me on speaker phoneI told Mr*** that I was going to pay Mr***, and not to be concernedIt sounded like a miscommunication between Mr*** and myselfMr*** then said, “I want a couple hundred dollars for material.” I asked Mr*** if he could pay Mr*** a couple of hundred, and I would subtract it from his balance dueI also told him that if he couldn’t, that was fine, and I would come over and pay Mr*** myselfMr*** agreed to pay him, and gave him $100.00.On 2/8/Mr*** called and said the drywall was finished and we could start paintingMr***’s report indicates that Mr*** never stayed for more than hours a day over a day periodIt only took *** six days to finish the drywall. On 2/9/(8:00am- 4:30pm Mark, Spencer, Grant, myself) we started painting. On 2/10/(12:30am - 3:00pm Mark, Spencer, Grant, myself) I called Mrs*** and told her that we had a beam that we needed to install on another project and it should only take a couple of hoursI called Mrs*** again around 10:00am and told her that we were having issues and it would take a little longerMrs*** hung up on meWe finished the beam at 12:30pm and went straight to Mr***’s houseWe leveled the floor in the bathroom so that it would be ready for tile in the morningIn Mr***’s report, he is upset that we only worked for minutes on this dayWe had to wait for the floor leveler to dry before we could paint the walls. On 2/11/(8:00am - 2:30pm Grant, myself) we arrived at the job at 8:40am and began paintingMr*** arrived at 10:30am and was getting very upsetHe was complaining about the plumber and the dry wall guy, and how long the project was takingI explained that I thought we were doing everything in our power to complete the project in a timely mannerHe complained that the plumber wasn’t showing up, and when he did show up, he didn’t know what he was doingHe complained that the dry wall guy was leaving dustOn 2/9/I walked through Mr***’s house and saw no evidence of dry wall dustAt this point, Mr*** told me that we had to be finished by 2/19/or I could pack my things and leave nowThen Mrs*** came in from the office and began yelling incoherentlyI told my team member to go into the garage, and I sat down on the steps and let them yell and ventI told Mr*** again, that I felt like we were there every day we could have been, and the only days we weren’t on site, is when the plumber or the drywall guy were there to complete there workMr*** said yeah, like yesterday (we didn’t arrive on site until 12:30pm)I apologized for the one day we did not make it at a reasonable time, but we did get the floor leveled and ready for the tile to be installedThings calmed down and we continued paintingMr***'s report indicates that I told him everything would be done by 2/12/16.On 2/12/16, (8:00am - 4:30pm Mark, Spencer, myself) we painted and installed the tile in the bathroomAll of our work was complete to this pointI told Mr*** that we needed the floor installed before we can install the base and casingHe said his guys would install the floor on Mondaytold Mr*** that the next payment ($2,000.00) was due, and he told me that he had given *** $100.00, so he would pay me $1,900.00, and I agreedMr*** left around 3:30pmI called his cell and asked if he would be back before 4:30pmHe said he would be back around 4:30pm and asked if I could waitAt 4:the guys left and I stayedMrs*** came out about minutes later and paid me the $1,I apologized to her again, and told her we would see her on TuesdayShe also apologized for yelling at me the day before.I told her that I understand and we would be fine.On 2/15/we did not work as the floor was being installedMr***’s report indicates that the plumber didn’t show up because he was sick.On 2/16/several of my team called and said the roads were bad and icy, so I called Mrs*** and told her that due to the bad roads, we would not be working, and she hung up on me.I called her later this same day and told her that Mark, one of my lead guys who has been working at their house, was in the hospital, and that I needed to go to *** on 2/17/for a funeralShe again hung up on meMr***s report indicates that I called and told him I couldn't be there because had to start another job.On 2/18/Mr*** called and said the plumber showed up and leftI told him I didn’t know what was going on with the plumber, and I tried to explain that Mark was still in the hospitalHe said he didn’t want the plumber back and he didn’t want me backHe said he would hire someone else and take me to small claims courtMr***'s report indicates that Mr*** told him that I never told him the rouwas not in the correct spot and had to be moved, so the plumber leftAgain, plumbing was no longer part of my contract.I tried to reason with him and told him it was unfortunate that Mark was in the hospital, and my Uncle passed away, at the same time, but I was not comfortable sending my other helpers there to install trimI asked Mr*** to understand, and that it would only take me and one of my helpers one day to complete the jobHe insisted that we not returnContract summary of payments: DESCRIPTION PAYMENTS BALANCE Original Contract $ 10,12/14/- 1st Payment $ 3,$ 7,1/27/- 2nd Payment $ 4,$ 3,2/2/- Payment to Mr*** $ $ 3,2/12/- 3rd Payment $ 1,$ 1,Deduct for Plumbing $ $ 1, Mr***’s complaint states that there is a disputed amount of $2,Based on the calculations above, I only had $1,worth of work to complete, and we are more than willing to finish the work.In summary, based on the original scope of work, we stated that the project would take approximately 2-weeksBased on the changes in scope including the additional demo required for the plumbing rough-ins, the tile floor, carpet removal, wiring, relocating the cable box, etc., and then several unforeseen/personal circumstances including Mark’s hospitalization, and a death in my family, the project was extended an additional weeks, which in not unrealisticAdditional Work $ 1,I apologize that the project did not go exactly as Mr*** had originally expected, but this is quite often the case when additional work is added and additional time is needed for things such as concrete demo and curing.I feel that Mr***’s claim of $2,is unreasonable and unrealistic, and if anything he should be responsible to pay me for that additional work that I completedAlso, his statement not only with the Revdex.com, but also on *** *** does constitute a defamation of character law suitIf Mr*** is willing to retract both of his claims, I am willing to let all outstanding monies be a wash, but if Mr*** is not willing to issue a retraction to the Revdex.com and on *** ***, then I feel I have no alternative but to take the proceedings to Small Claims Court, and look for not only the $1,in additional work, but also loss income due to his unjustified negative public reporting, which can and possibly already has, affected my potential incomeSincerely,Charles ** ***Owner

I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. Review: Chuck and I agreed to a contract for him to remodel my basement and install a bathroom. we agreed and signed his contract on 11/16/15 for $10,000. He also brought his plumber with him, [redacted], and they looked at the job and said it was going to be a additional $1500 for breaking up the concrete and installing the rough ins. I agreed and paid the plumber $500 that day. [redacted] said he would coordinate everything with Chuck . I Also gave Chuck $3000 on 12/14/15 and agreed that he would start the work after the new year so that he could finish up his other jobs before starting the work for me. He said the work would only take a couple of weeks. I said 2 -3 and he said "YES". On January 8, Chuck called and said he would be starting on Monday the 11th. The crew showed up and removed the paneling and did some framing. Then Chuck called the Plumber, who couldn't come for a few days. When the plumber showed up, he said he needed more walls formed before he could rough in anything, So he left. Chucks guys came back and did some more framing. The plumber came back and busted up the concrete, put in the rough ins and reconcreted the floor. He also put in the water lines. After he left, We had no hot water. I called Chuck and the plumber . He realized his mistake and told ME how to fix it. As I began to work on it, Chuck did show up and help me. Chuck said it was his responsibility since it was his plumber and his contract. Chuck said he wasn't comfortable moving the electric for the dryer since it was a 220 line. I told him I have a friend that is a electrician, and he would do it and I would minus it from Chucks contract. Chuck Agreed. So my electrician came in and did the work at a cost of $1400 for all of the wiring in Chucks contract. I told Chuck later that if he installed the flooring, we could minus that from the electrical. Chuck agreed. Now Chuck hires someone to finish the drywall(Genuine Drywall Co. )[redacted]. He can't come for several days. So when he does come, He stays for no more than 3 hours a day over 10 days he is here 5 days and works on finishing for a total of 13 hours. The last day he was here sanding, Eric said "everything is done except behind the washer and dryer, I don't have time to move them, Chuck will have to do it".I called Chuck and complained that this job was taking too long and asked when he would be done. Chuck said everything would be done by Friday, 2/12. Chuck said they would be here wednesday 2/10. He called that morning and said he had to set a beam at another job and they would be here by noon. They showed up at 3pm and worked for 30 minutes and went home. Thursday, 2/11, I complained to Chuck that there was no way he was going to finish by Friday as promised. At that time, I told him he had one week to finish. If he wasn't done by Thursday, 2/18, I would fire him and Hire someone else to finish. Chuck said no problem, We can be here Friday ,2/12 and Tuesday 2/16 and get everything else done. They finished Painting on Friday 2/12/16.The Plumber told Chuck and I that he would be here Monday 2/15. He didn't show up, when I called him he said he told Chuck he was sick.My flooring crew worked from 7 am until 8 pm Monday so that the floors would be done and not hold up Chucks Crew. Tuesday morning, Chuck calls and says they are not coming because it snowed. I had no problems driving from 4 am to 4 pm for my job. Chuck said he couldn't come Wednesday because he had to start another Job. He said he would be here Thursday. Chuck called Wednesday night(2/17) and said he couldn't come Thursday because His Main worker, Mark was in the hospital. The plumber shows up Thursday and said Chuck never told him the rough in was not in the correct spot and had to be moved. So the plumber leaves. I phoned Chuck and said that he has missed all of his promises and I didn't want him back. It is his responsibility to fulfill the contract. I have paid him $9000 and the project is going to take several thousand to finish.Desired Settlement: I want Chuck to pay for the new plumber and carpenter to finish what he didn't do .

March 14, 2016 RE: Complaint ID [redacted] Following is a detailed response to the complaint number shown above, filed by my customer [redacted] on February 18, 2016. Mr. [redacted]’s complaint remarks from this complaint are noted in red. When I first looked at the project, Mr. [redacted]’s basement floor, where the bathroom was to be installed, was covered with clothing and other debris, but he assured me that the rough-ins and piping were there, and all we would have to do is install the fixtures. On 11/17/15 I met with Mr. [redacted] and we signed a contract for $10,782.04 for which the scope of work included the following (copy of contract / quote / sketches attached) • Detaching existing gas dryer • Detaching existing washing machine • Detach existing laundry tub • Removing existing paneling in basement • Furnish and install lumber to reframe basement walls per sketch • Furnish, install and finish drywall for basement walls per sketch • Paint new walls and ceiling (2 coats) • Furnish and install baseboard per sketch • Minimal electrical - labor only to set relocate switches and outlets • Furnish and install four (4) new interior door knobs • Install only a sink and faucet • Install only a toilet • Furnish, install, and finish drywall for bathroom • Minimal plumbing to connect new fixtures to existing plumbing rough-in • Paint new walls and ceiling in bathroom (2 coats) • Furnish and install lumber to reframe laundry room • Furnish, install and finish drywall for laundry room• Install only bi-fold door• Minimal plumbing to reconnect washing machine to existing plumbing rough-in• Paint new walls and ceiling in laundry room (2 coats)• Furnish and install baseboard in laundry room• Install only existing gas dryer• Install only existing washing machine• Install only existing laundry tub• Furnish and install lumber to frame new closet• Furnish, install and finish drywall in new closet• Paint new walls and ceiling in closet (2 coats)• Furnish and install baseboard in closet• Furnish and install lumber to frame in furnace roomMr. [redacted]’s report indicates this meeting took place on 11/16/15 with a contract amount of $10,000.00. His report also indicates that my plumber Mr. [redacted] came with me to this meeting, where in we look at the job and said it would be an additional $1,500.00 to break up the concrete to install the plumbing rough-ins. and that he gave Mr. [redacted] $500.00 on this same day. You will notice below that the plumber was never on the jobsite prior to 12/14/15.On 12/10/15, Mr. [redacted] called me to let me know that they cleared the basement floor and found that there were no pipes coming up for the bathroom rough-in. I explained that I had only figured for minimal concrete demo and installation of the sink drains and toilet to the existing rough-ins. I had not figured for the additional work, which would include additional concrete demo, and the material and labor necessary to install the actual rough-in piping. At this time I also told him of a plumber, Mike [redacted], whom I have used in the past, and offered to call Mr. [redacted] to see if he would come and take a look at the job and see what we were getting into. Mr. [redacted] agreed, so I contacted Mr. [redacted] and scheduled an appointment to meet with Mr. [redacted] on 12/14/15 at 6:00pm.On 12/14/15 Mr. [redacted] and I met with Mr. [redacted] and looked at the location for the powder room and no rough-in piping existed. At this time, Mr. [redacted] told us that he would also like to install a shower, move the hot water tank, and re-plumb his main supply shut-off. I explained to Mr. [redacted] that this amount of work was definitely not in the original contract, and I proposed that Mr. [redacted] contract directly with Mr. [redacted] for all plumbing work, to which they both agreed. Since Mr. [redacted] was now contracting directly the Mr. [redacted] for all of the plumbing work, I explained that I had figured $500.00 into my original estimate, and proposed that we deduct that amount from our contract, which would bring it down to $10,282.04, to which Mr. [redacted] agreed. Mr. [redacted] agreed to coordinate his work with me. At this point, Mr. [redacted] gave me a deposit of $3,000.00. I told him per the contract, he was only obligated to a deposit of $2,500.00, he said it would be fine, so I accepted the extra $500.00 deposit toward the total contract amount. Because Mr. [redacted] contracted directly with Mr. [redacted], I have no knowledge of what their contract amount was, but I do know that Mr. [redacted] also gave Mr. [redacted] a deposit on the same day, but again, I have no knowledge of how much that deposit was. That was between the two of them.We talked for another hour or so, and upon leaving, I told Mr. [redacted] that we would see him sometime in the middle to end of January. On 1/4/16, Mr. [redacted] contacted me to see if he could start his work. I explained that I thought Mr. [redacted] was in Florida, but I would call. Mr. [redacted] agreed that we could begin work on 1/11/16. Mr. [redacted]’s report does not indicate that I contacted him on this date, but states that I called him on 1/8/16 to let him know we would be starting on 1/11/16.On 1/11/16 (8:00am - 4:30pm Mark, Spencer, Grant, myself) my team and I began and finished the demo, and removed the walls, as needed for the plumber. At this point, Mr. [redacted] asked if we could also remove the carpet, and I agreed. The carpet removal was not part of the original contract. Mr. [redacted]’s report indicates that I called Mr. [redacted], and that he wouldn't be able to start for a few days.On 1/12/16 Mr. [redacted] contacted me and said that the Mr. [redacted] need some additional framing completed for the plumbing rough-in, and I told him we would be there on 1/14/16 to complete this additional framing. Mr. [redacted]'s report does not indicate that the plumber arrived the very next day.On 1/14/16 (8-00am - 4:30pm Mark, Spencer, Grant, myself) my team and I removed most of the carpet, and framed all of the walls at Mr. [redacted]’s request. All work was completed so that Mr. [redacted] could begin his work. Mr. [redacted]’s report doesn't mention the extra carpet removal. Mr. [redacted] and I also discussed the 220 electrical line and some miscellaneous wiring issues including junction boxes in the ceiling that would be covered by dry wall. I explained that I was not comfortable burying the junction boxes and the 220 line was too short to move to the back wall. Mr. [redacted] suggested relocating the 220 line from the electric panel at the front of the basement, to a secondary panel box in the back of the basement. He also told me that he previously had issues with breakers melting in the rear box. I told him that I knew an electrician I and I could call him. Nothing further was discussed about the electrical work. On 1/15/16 Mr. [redacted] called me and asked, “Can we barter on the electrical?” I asked what he was proposing, and he suggested that if I was willing to install a ceramic tile floor in the bathroom, that he would contact an electrician friend to move the 220 line and complete the electrical rough-in for the bathroom. I responded by telling him that, “I’m looking at a couple of bags of floor leveler sitting on my floor,” and that would be great. We would have to level the floor after the plumber was finished, and we would be more than happy to barter on this project. Mr. [redacted]’s report simply says I was not comfortable moving the 220 line for the dryer. It does not mention anything about the previous issues he had with melting breakers in the box where he wanted to 220 line connected to.The plumber completed the rough-in work on 1/18/16. Mr. [redacted] reports that after the plumber left they had no hot water, and that he contacted me and Mr. [redacted]. Per his report. Mr. [redacted] realized his mistake and explained to Mr. [redacted] how to fix it because he couldn't get back down there. Because Mr. [redacted] was my customer and I felt obligated to do everything in my power to keep him happy, I went to Mr. [redacted]’s house this evening and helped him resolve the problem. Note again, that Mr. [redacted] contracted directly with Mr. [redacted], and I did not have anything to do with this work. Mr. [redacted] reports that I said I felt it was my responsibility since Mr. [redacted] was my plumber and my contract. Again, Mr. [redacted] contracted directly with Mr. [redacted]. It was never my responsibility, nor did I indicate that it was, but because I held the primary remodeling contract, I felt morally obligated to keep the customer happy. On 1/19/16 (8:00am - 4:30pm Mark, Spencer, Grant, myself) my team removed the remaining carpet, rerouted the wiring, rerouted the cable line (all of which was not part of my contract), and started preparing for drywall installation. On 1/20/16 (8:30am - 4:30pm Mark, Spencer, Grant, myself) my team continued with rerouting the wiring, rerouting the cable line, and preparing for drywall installation. Also, at Mr. [redacted]’s request, we installed additional soffit framing, added insulation to the office wall and windows, and rerouted a cable box, which his brother would then hook-up. Again, rerouting the wiring was no longer part of my contract, and Mr. [redacted] was contracting with his own electrician, and all of this additional work was not part of the original contract. On 1/21/16 (10:00am - 4:30pm Mark, Spencer, Grant, myself) my team completed framing, removed carpet from the steps, installed doors, and unloaded garbage at the landfill. A good bit of this garbage was from the plumbing demo, which again was not part of my contract. On 1/22/16 (8:30am - 3:00pm Mark, Spencer, Grant, myself) we started installing drywall. On 1/25/16 (8:00am - 4:30pm Mark, Spencer, Grant, myself) we continued installing drywall, and I met with [redacted] (drywall finisher), who quoted me $1,400.00 to finish all of the drywall once installed. I told Mr. [redacted] to put us on his schedule.
