July 19, 2017Dear *** ***:Funding Metrics, LLC has received the above referenced complaint and takes these alleged incidents very seriously,The Merchant had returned payments on March 10, 13, 14, 15, and 16; May 21, 28, and 31; June 4, 5, and Merchant stopped payment on July 9,
Merchant was charged NSF fees pursuant to our contract and less than the amount permitted by law,Merchant was in default after numerous consecutive returns and when a stop payment was placed on the accountThe default fee was not accessed until July which was after the Merchant stopped payment on the accountWhat constitutes a default is clearly explained in our Purchase Agreement in sections and 3.13.Our remedies for default are clearly defined in section Our default fees are defined in Section Our NSF fees and default fees are also outlined on page of the Purchase Agreement.This was not a loan and the merchant did not pay any interestThe balance was not paid in full as two bounced payments remain outstanding for a total of $The balance owed is $5,Funding Metrics offered to settle this matter for $2,but the Merchant refusedBullying tactics are not a part of this company's collections procedure, Our *** lien does however, provide Funding Metrics with a lien on the Merchant's assets.Sincerely,Paulette YEsq.

On November 29, Funding Metrics, LLC ("FM") received an application from anIndependent Sales Organization (“ISO”) on behalf of *** *** *** ***for a MerchantCash Advance which was executed via *** by *** *** on November 28, 2017.This application authorized FM to
run a credit report, which it did on November 29, at11:a.mThis is the one and only time FM ran a credit report.*** *** was approved for fundinq; however, the ISO withdrew the agplicationstating that *** *** was no longer interested.Funding Metrics, LLC has two dbas in the Merchant Cash Advance industry and operates thesecompanies with full disclosureFM does not offer loans and never sells the merchanfsinformation.FM does not have knowledge as to who else, if anyone, the ISO sent the application to nor dothey have knowledge as to who else may have ran a credit report; The Application executed by*** *** reads in part “ ..Authorizes the ISO and each of its representatives,successors, assigns and designees ("Recipients") that may be involved with or acquirecommercial loans having daily repayment features or purchase of future receivables includingMerchant Cash Advance transactions, ..to obtain consumer or personal, businessand investigative reports and other information about you, including ..from reportingagencies, such as ***, *** and *** and...... August 1, 2016Dear *** ***We received the complaint submitted by *** ***, the owner of *** *** *** Prior to funding we do a recorded funding call with the merchantIn this call we remind them to reread our Fee Schedule which is attached to our Purchase AgreementOur definition of
the term "default" and our fees are also clearly set out in the body of Agreement.As part of the recorded funding call, the Merchant is asked, "Do you anticipate closing your business for any reason over the next months including planned vacations, renovations, seasonality, slow business periods or selling it?" To this question, *** *** responded noIf she closes annually during July she should have disclosed that information during the call, not after her payments returned for NSF.The only merchants who are "surprised" by the default fee are those who fall to read the Purchase AgreementDefault fees are customary in the Merchant Cash Advance Industry.To resolve this matter Funding Metrics will agree to a onetime waiver of the default fee on this accountPlease do not hesitate to contact me if you have any further questions.Sincerely,Jimmy BResolution Manager

Merchant was charged NSF fees pursuant to our contract and less than the amount permitted by law,Merchant was in default after numerous consecutive returns and when a stop payment was placed on the account. The default fee was not accessed until July 10 which was after the Merchant stopped payment on the account. What constitutes a default is clearly explained in our Purchase Agreement in sections 3.12 and 3.13.Our remedies for default are clearly defined in section 3.15. Our default fees are defined in Section 6.2. Our NSF fees  and default fees are also outlined on page 10 of the Purchase Agreement.This was not a loan and the merchant did not pay any interest. The balance was not paid in full as two bounced payments remain outstanding for a total of $430.30. The balance owed is $5,430.30. Funding Metrics offered to settle this matter for $2,430.30 but the Merchant refused. Bullying tactics are not a part of this company's collections procedure, Our [redacted] lien does however, provide Funding Metrics with a lien on the Merchant's assets.Sincerely,Paulette Y. Esq.
