[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the responseIf no reason is received your complaint will be closed Administratively Resolved] Complaint: [redacted] I am rejecting this response because: I believe that the company caused excessive damages without taking any action to mitigate the damages I would not, nor would anyone else expect the extent of damages caused by the rig to my sidewalk They were paid by comfort zone after they dug the first well and then paid $2,to fix the initial well which was not working properly My unit still is not working properly even to cool the house and I cannot say whether it was the work that funks did drilling the well or comfort zone installing the unit that is the reason for the unit not working properly currently Regards, [redacted]

June 10, Dear [redacted] ***As you are aware, our law firm is general counsel to Funk's Well Drilling, IncI am in receipt of your letter dated June 5, 2015, which was received in my office today, I attempted to reach you via telephone, but your voicemail indicates that you will not be in the office until after June 2nd (which it is now) and I did leave a voice message for a return callAs you are aware, a complaint was lodged by [redacted] against Funk's Well Drilling, Incand the general contractor that is involved and retained by [redacted] Funk's Well Drilling, Incwas hired by the general contractor to install a water well for the purpose of installing a geothermal HVAC system, Funk's did not contract, not did they install any mechanical equipment for the HVAC system, excepting the well and looping systemIt appears that [redacted] has changed the focus of his initial complaint now to also include damage to his sidewalkThis is a baseless accusation as I have personally inspected the sidewalk and it is extensive in age and has clearly been dilapidated as evidenced by the multiple cracks and grass and weeds that have been growing in those cracks for an extended period of timeMoreover, the location of the water well was accessed by Funk's with their equipment from the street, through the driveway entrance and not across sidewalksConsequently, any damage that [redacted] is experiencing either pre-existed Funk'sarrival or was caused by some other contractor of individualAs you are aware, Funk's Well Drilling, Incis a third generation family owned business with an impeccable reputationI caution any publication of the baseless complaint lodged by [redacted] without a formal investigation being done by the Revdex.com as to the veracity of this complaintFunk's categorically denies the allegations being made against itFinally, [redacted] indicates that “my unit still is not working properly...once again, [redacted] 's in privity of contract with the general contract and not Funk's Well Drilling, IncI Ic has additionally directed that Funk's Well Drilling, Incis not permitted onto his property and your June 5, correspondence is the first time the issue of the HVAC's operability has been brought to our attention.I look forward to speaking with you in the very near future,Very truly yours,

May 20, Dear *** *** ***This letter seeks to confirm receipt of your April 13, letter to Funk's Drilling in regards to a complaint filed by *** *** (ID ***)Funk's Drilling was a subcontractor responsible for installing a geo-thermal wellThis was done to
industry standardsThe release signed by the complainant references liability and releases contractor from liability for damage done to sidewalks and drivewaysContract also advises that contractor will not do any finished landscaping including seedingContractor gave site containment additional charges in the event they would be requested by complainant*** ***'s complaint about contamination to the *** Creek is falseA district technician from the Cumberland County Conservation District on orders from the Department of - Environmental Protection, inspected the property and the creek and found “no evidence of pollution occurring to the Condoguient Creek.” The complaint was CC’d on this report dated April 14, Funk's Drilling was not hired to “check the well water” as alleged in the complaintFunk's Drilling was a sub-contractor hired to drill a geo-thermal well, which was done to industry standardsComplaint alleges that he was charged $6,for Funk's Drilling services, this is falseFunk's Drilling gave complaint over a $2,discountComplaint was given a bill for only $2,on February 19", which was paid March 2nd, 2015, Very truly yours,

Funks has been on my property twice and they were told about the cracks to the sidewalk and driveway when they initially drilled the well and they did not respond The cracks were not there and I have several witnesses that can confirm the majority of cracks were caused by the drilling rig

I am rejecting this response because:  I believe that the company caused excessive damages without taking any action to mitigate the damages.  I would not, nor would anyone else expect the extent of damages caused by the rig to my sidewalk.  They were paid by comfort zone after they dug the first well and then paid $2,000 to fix the initial well which was not working properly.  My unit still is not working properly even to cool the house and I cannot say whether it was the work that funks did drilling the well or comfort zone installing the unit that is the reason for the unit not working properly currently.
