I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.To whom it May Concern: Most of the assertions made by *** *** in her reply are blatantly false I will address them in the order of her letter She states that I did not pay in full the $3,of our contract This is true, but I am contesting as I did not receive the trainingI was promised *** states that I did not come down consistently every weeks, nor did I actively train with *** at any time in his training This is untrue I came every two weeks on Saturdays and *** never trained with me When we were at her place, she was always busy doing somethings else: running errands, eating or visiting with friends I was there at her house on the Saturday that she mentioned in her reply, but she spent the time eating *** and visiting with everyone else there and had my dog, ***, playing with her client, Laura's, golden retriever puppy The other Saturdays, she or her dad loaded the dog in my car and told me to take him to El Cajon park and play with him there She states I live 3-hours away I live in Los *** which is 1/hours away I was late on one occasion due to traffic, but I was on time all of the other occasions *** denies that *** was underweight and refers to the texts in which I did not mention his weight The day after I picked him up, I took him to the vet He had an ear infection and the vet weighed him and said that he was underweight and that his hip bones were showing *** boarded with *** for all of the previous months I paid for his food but it was her responsibility to feed and care for him, which obviously she did not do to adequately enough I informed *** that *** needed to be house-trained She stated that I gave one excuse after another The truth is as a disabled person with a hip fracture, it is essential to me that *** be house-trained and not in a kennel. I do not have room in my house for a kennel large enough to accommodate him I can not get him in and out of a kennel, nor can I risk tripping over it in my house. As part of the training I was paying for, I asked that he be removed from the kennel and house-trained and she agreed Furthermore, I asked that she train *** to ring a bell when he needed to go out to the bathroom and she agreed, but neither this nor the house-training every occurred *** stated that I didn't give the dog a fair chance As soon as we left ***'s house with the dog, we stopped in Oceanside at a *** for lunch and we brought *** inside It just so happened that we met a woman in *** that works for *** Companions for Independence and that trains service dogs She told us that *** was out of control and needed a lot of training I told her that the trainer, ***, had said he was ready for Advanced Training She said "He is no where near Advanced Training." The reason I called *** so quickly after bringing *** home is that *** pooped, urinated on the carpet, drank out of the toilet, pulled trash cans down, jumped up on the kitchen counters and pulled food and prescription medication bottles down This, after *** stated that he was ready for Advanced Training She states that she had had *** out in public and that my accusations were false, but she told me that she had not taken him out in public and he was not yet ready for that training until after he passes Advanced Obedience Training. *** always knew my situation She knew that I am disabled She knew that I live in a townhouse without adequate space for a kennel She knew that I have only a patio She knew that I needed a dog that was trained to walk beside me and to stay inside my house most of the time I took *** home when I did only because she was going out of town Her contract may state that the funds are nonrefundable, but when the services promised are not rendered, I feel that she broke her own contract.Sincerely,*** *** ***
